RESOLUTION NO. J 851
A RESOLUTION, BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE
MEMBERS OF THE CITY COMMISSION, CONCERNING THE
CONSTRUCTION OF SCATTERED SITE HOUSING HOMEOWNERSHIP
DEVELOPMENT PROGRAM -MODEL CITY PHASE II, PROJECT NO.
321034 RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING THAT A VALID PUBLIC EMERGENCY
EXISTED AND CONTINUES TO EXIST FOR SAID PROJECT
JUSTIFYING CERTAIN ACTION; RATIFYING, APPROVING AND
CONFIRMING THE ACTION OF THE CITY MANAGER IN
ACCEPTING THE INFORMAL BID OF APEX CONSTRUCTION
ENTERPRISES, INC. IN THE AMOUNT OF $134,500.00 AS THE
LOWEST RESPONSIBLE AND RESPONSIVE BID FOR NECESSARY
MATERIALS, CONSTRUCTION AND SERVICES TO COMPLETE
THREE OF THE FOUR HOMES IN SAID PROJECT; ALLOCATING
FUNDS THEREFOR IN THE AMOUNT OF $134,500.00 TO COVER
THE CONTRACT COST AND $9,262.00 TO COVER THE
ESTIMATED EXPENSES INCURRED BY THE CITY, FOR A TOTAL
COST OF $143,762.00; AUTHORIZING THE CITY MANAGER TO
AMEND THE EXISTING CONTRACT WITH ROBINSON_
CONSTRUCTION, INC., DATED FEBRUARY 27, 19909 BY
DELETING THE THREE AFORESAID HOMES AND REDUCING SAID
CONTRACT FROM $171,200 TO $42,800; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE AND/OR ISSUE
THE NECESSARY DOCUMENTS IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY WITH THE SUCCESSFUL BIDDER.
WHEREAS, the Ci ty Manager has made a written fi,ndi ng that
the , completion of Scattered Site Housing Homeowners hi p
Development Program -Model City, Phase, II, Project No. 321034.,
constituted a valid public emergency which -requi red .the immediate
procurement of materials, construction and services to protect
the health, safety and welfare of the community and for, the
convenience of the City; and
WHEREAS, the original contractor
project on October 5, 1990 but to
construction on three of the four homes
should have completed, the

`affi-mative` vote of 4/5ths of the members of the City Commission,
to amend the $171,200 contractl/ that exists with the
construction firm of Robinson Construct.ion,_Inc. datedFebruary
27, 1990,.authorized by Resolution No. 89-902 adopted October 120
1989,1to"reflect.the deletion of the three aforesaid homes that,
will now be constructed by Apex Construction Enterprises, Inc'.",
with the revised contract amount for Robinson Construction, Inc.
