A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5TH'S OF THE MEMBERS OF THE CITY COMMISSION RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S EMERGENCY ACTION IN THE PURCHASE OF PHOTOGRAPHIC SUPPLIES FROM PITMAN PHOTO SUPPLY AND ALLOCATING FUNDS THEREFOR, IN THE AMOUNT OF $32,000, FROM THE POLICE DEPARTMENT GENERAL OPERATING BUDGET, INDEX CODE 290201-722. WHEREAS, the Police Department was authorized by Resolution No. 89-1092 to utilize the services of Pitman Photo Supply for the provision of photographic supplies; and WHEREAS, on August 9, 1990, the City Manager authorized the continued purchase of supplies from Pitman Photo supply; and WHEREAS, the City Commission on February 14, 1991 rejected the City Manager's requested formal extension or renewal of said agreement and directed that the Photographic Supplies Contract be re -bid; and WHEREAS, it was imperative that the Police Department maintain a store of photographic supplies for the detection, apprehension, and conviction of criminals during the time it takes to re -bid the contract; and WHEREAS, the City Manager made a finding in writing that the maintenance and purchase of these supplies constituted an emergency; and CITYP+t OF NOV 14 1991 roaurlos Ke..-__.—_-- L R J-91-734 10/31/91 - RESOLUTION NO. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. After a properly advertised public hearing, the finding of the City Manager set forth in the Preamble to this Resolution is hereby ratified by an affirmative vote of four - fifths of the City Commission and the emergency purchase of photographic supplies from Pitman Photo Supply, in the amount of $32,000, is hereby approved with funds therefor being hereby allocated from the Police Department General Operating Budget, Index Code 290201-722. Section 3. This Resolution shall become effective immediately upon its adoption. BACKGROUND: The Police Department was authorized to utilize Pitman Photo Supply, for photographic supplies by Resolution No. 89-1092. On August 9, 1990, the City Manager authorized an extension of the agreement, under the same terms and conditions, for an additional one year period, commencing November 30, 1990. The City Commission issued a directive that no extension would be granted and that the contract had to be rebid. Because of the vital role photographic supplies play in the detection, apprehension, and conviction of offenders, the City Manager made a determination that the purchase of photographic supplies constituted an emergency and authorized the Police Department to continue purchasing these supplies from Pitman Photo Supply, until such time as a new vendor could be selected. It is, therefore, recommended that the Resolution ratifying the City Manager's emergency action and authorizing the utilization of Pitman Photo Supply, in the amount of $32,000, be approved. On August 9, 1990, you authorized an extension of the agreement, under the same terms and conditions, for an additional one year period, commencing November 30, 1990. See, attached. However, the City Commission denied the extension and ordered that the 'contract be rebid. During the time new specifications were being developed, and the bid process was to commence, the Police Department made a decision to continue purchasing photographic supplies from Pitman. This decision was based on the department's inherent need for these supplies. Without photographic supplies the Department would not be able to photograph crime scenes, including: homicides, traffic accidents, robberies, and burglaries.. The Department would also not be able to photograph suspects. These limitations alone would prevent Department - personnel from successfully presenting cases in court and prosecuting offenders. The elimination of photographic supplies would significantly impair the Criminal Investigation Division's effectiveness. Because of the vital role photographic supplies play in the detection, apprehension, and conviction of offenders, the Police Department is requesting that you make a determination that the purchase of photographic supplies constitutes an emergency, and authorize the utilization and payment of Pitman Photo Supply, in the amount of $32,000, until such time as a new contract can be awarded.
