A RESOLUTION, APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST RECEIVED FROM POLYGEM SECURITY, INC., IN CONNECTION WITH THE CITY'S REQUEST FOR PROPOSALS (RFP) FOR USHERS, TICKET TAKERS AND PEER GROUP SECURITY SERVICES FOR THE ORANGE BOWL CLASSIC GAME AND OTHER EVENTS AT THE ORANGE BOWL, AS IT HAS BEEN DETERMINED TO BE WITHOUT MERIT. WHEREAS, on August 19, 1991, the City of Miami issued a Request for Proposals (RFP) for ushers, ticket takers and peer group security services for the Orange Bowl Classic Game and other events at the Orange Bowl; and WHEREAS, on August 27, 1991, the City of Miami received a protest from Polygem Security, Inc. (the Firm) in connection with said RFP; and WHEREAS, the Firm alleged that the RFP's requirements that the Proposer have a minimum of five (5) years' experience in peer group security, ushering and ticket taking services in a facility of over 50,000 crowd capacity disqualified all local minority companies within the security industry; and WHEREAS, the Chief Procurement Officer, pursuant to Section 18-56.1 of the City Code, in her role as arbiter, investigated the matter and determined that the requirements in .10 A, the RFP document were established with the purpose of ensuring that the City solicit only fully qualified and experienced firms to perform the required services; and WHEREAS, the Chief Procurement Officer has determined that the protest was without merit and has rejected the protest; and WHEREAS, the City Manager and the City Attorney concur with and approve the finding of the Chief Procurement Officer and recommend rejection of the protest filed by Polygem Security, Inc.; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Chief Procurement Officer's decision to reject the protest received from Polygem Security Inc. in connection with the City's Request for Proposals (RFP) for ushers, ticket takers and peer group security services for the Orange Bowl Classic Game and other events at the Orange Bowl is hereby approved. Odio City Manager ENCLOSURES RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution approving the Chief Procurement Officer's decision to reject Polygem Security, Inc.'s protest, in connection with the City's Request for Proposals (RFP) for ushers, ticket -takers and peer group security services for the Orange Bowl Classic Game and other events at the Orange Bowl. BACKGROUND On August 27, 1991, a protest was received from Polygem Security, Inc., relative to the above noted RFP. In its protest the firm alleged that the requirements that the Proposer have a minimum of five (5) years experience in peer group security, ushering and ticket taking services in a facility of over 50,000 crowd capacity disqualified all local minority companies within the security industry. Pursuant to Section 18-56.1 of the City Code, the Chief Procurement Officer investigated the matter and determined that the protest lacked merit. The Special Conditions in the RFP document clearly outlined several factors relevant to the City's requirements for acquiring the desired services, including the criteria for evaluating the proposals. The purpose of the minimum requirement of five year's experience in the field was to ensure that the City obtain the most qualified and experienced company to effectively perform the required services. The Orange Bowl Classic game is of such importance that it is in the City's best interest to procure services only from experts in the field, who have successfully completed projects of a similar magnitude. CESAR H. ODIO City Manager the City of Miami, have read investigated the issues, and pursuant to my duties under Code, Resolution of Protest The requirement that the proposer have a minimum of 5 years experience in peer group security, ushering and ticket taking services in facilities of over 50,000 crowd capacity/attendance was a business decision made to ensure that the City acquires only the services of firms that have demonstrated over a period of time that they are fully qualified to provide the type of services needed. While we understand that there may not be any locally qualified, minority -owned companies which meet these requirements we recognize that the City has an obligation to the patrons who attend these events. The City's best interest would not be served by selecting an inexperienced firm to do the job. Additionally, although we do try to encourage majority -owned companies to include minority -owned firms/subcontractors in their proposals, this constitutes only one factor in evaluating the proposals. It does not take precedence over other concerns, such as previous experience and past performance, which are essential to effectively performing these services.
