A RESOLUTION DESIGNATING AS A CATEGORY "B" PROJECT THE ACQUISITION OF ENGINEERING SERVICES FOR THE REMOVAL OF UNDERGROUND STORAGE TANKS, CLEANUP AND MONITORING OF CITY OWNED UNDERGROUND STORAGE TANK SITES REQUIRED BY THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY; AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR THE REQUIRED PROFESSIONAL SERVICES; APPOINTING A CERTIFICATION COMMITTEE OF NOT LESS THAN THREE QUALIFIED PROFESSIONALS FROM THE CITY'S STAFF AND APPOINTING LUIS A. PRIETO-PORTAR, DIRECTOR OF PUBLIC WORKS, AS CHAIRMAN OF THE COMPETITIVE SELECTION COMMITTEE, ALL IN ACCORDANCE WITH FLORIDA STATUTES SECTION 287.055, AND CITY OF MIAMI ORDINANCE NO. 9572, ADOPTED FEBRUARY 10, 1983, WHICH ORDINANCE ESTABLISHED PROCEDURES FOR CONTRACTING FOR SUCH PROFESSIONAL SERVICES AND ALSO ESTABLISHED NEGOTIATION REQUIREMENTS WITH REGARD TO THE FURNISHING OF SUCH SERVICES; AND FUNDED FROM FISCAL YEAR 1590-91 CIP ORDINANCE NO. 10782 AND DIRECT REIMBURSEMENTS FROM THE STATE OF FLORIDA. ' WHEREAS, The City of Miami owns and maintains underground storage tank facilities on City streets and other City property; and WHEREAS, In 1984 the United States Environmental Protection Agency (EPA) added Subtitle I to the Rescue Conservation and Recovery Act by developing regulations to protect human health and the environment from leaking underground storage tanks; and WHEREAS, the new EPA Rule requires many municipalities Including the City of Miami to correct the problems created by the underground storage tanks under their Jurisdiction; and OFF NOV 14 1951 rM%XUTKsa so. --- WHEREAS, the three major objectives of the EFTA regulations are to prevent leaks and spills, to find leaks and spills, and to correct the problems created by leaks and spills; and WHEREAS, the EPA regulations also require the development and Implementation of a monitoring program to control groundwater pollution due to leakage and spills of the underground storage tank to the maximum extent practicable; and WHEREAS, the EPA has authorized the Florida Department of Environmental Regulation as the agency responsible for enforcement of the EPA underground storage tank regulations. The Request For Proposal will specifically require that the successful consultant provide all initial funding, Including all costs Incurred by City staff for preliminary project expenses and for all costs Incurred In fulfilling the Florida Department of Environmental Regulations requirements for Underground Storage Tanks, and complete all required documentation necessary to obtain funding reimbursement directly from the State of Florida. The City will not Incur expenses fulfilling Underground Storage Tank regulations; and WHEREAS, It Is In the best Interest of the City to engage a professional engineering firm with sufficient expertise to meet the aforesaid EPA requirements and deadlines for removal, cleanup and monitoring of the City's underground storage tanks; and - 2- s I ■ WHEREAS, the City Manager recommends that the acquisition of the aforesaid professional engineering services in response to EPA requirements be designated a Category "B" Project In accordance with the provisions of Ordinance No. 9572, adopted February 10, 1983, which now appears In codified form as City Code Section 18-52.3; and WHEREAS, City Code Section 18-52.3 also requires the establishment of a Certification Committee of not less than three professionals qualified In the field of endeavor or practice Involved In the project, to review the qualifications, performance data and related information provided by those firms responding to the City's Request for Professional Services; and WHEREAS, the City Manager recommends that Luis A. Prieto-Portar, Director of Public Works, be appointed as Chairman of the Competitive Selection Committee, in accordance with the provisions of City of Miami Code Section 18-52.3; and WHEREAS, funds for the aforesaid professional services are available from direct reimbursements from the State of Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained In the Preamble to this Resolution are hereby adopted by reference thereto and Incorporated herein as If fully set forth in this Section. - 3- Section 2. The acquisition of engineering services, for the removal of underground storage tanks, cleanup and monitoring of the City's underground storage tanks required by the United States Environmental Protection Agency Is hereby designated as a Category 118" Project in accordance with the provisions of the City of Miami Code Section 18-52.3, which established procedures for contracting for certain professional services and also established competitive negotiation requirements with regard to the furnishing of such services. Section 3. The City Manager Is hereby authorized to advertise for the aforementioned professional services, and to Issue a Request for Proposals for Professional Services document related to the procurement of such services, In accordance with the City Code, with funds for said services to be available from direct reimbursements from the State of Florida. Section 4. A Certification Committee Is hereby appointed consisting of the following City staff: Leonard Helmers, Engineer, James Kay, Engineer, and Clark Turner, Planner. Section 5. The Director of Public Works, Luis A. Prieto-Portar, Is hereby appointed as Chairman of the Competitive Selection Committee, In accordance with the provisions of City of Miami Code Section 18-52.3. Section 6. Following its review in accordance with provisions of the City Code, the Competitive Selection Committee shall report Its findings, together with supporting Information, to the City Manager and shall file a copy of Its findings with the City Clerk. 4 - n E Section 7. Odlo City Manager Ervc.�t-s Proposed Resolution RECOMMENDATION: It Is respectfully recommended that the City Commission adopt the attached Resolution to Initiate the process for acquiring engineering services to perform the removal of underground storage tanks, cleanup and monitoring of City owned underground storage tank sites determined by the Florida Department of Environmental Regulation to be environmentally hazardous. BACKGROUND: The Department of Public Works, In a continuing effort to serve all residents of the City of Miami, is recommending the adoption of the attached Resolution initiating the process for acquiring professional engineering services in response to the Florida Department of Environmental Regulation's requirement to cleanup City owned fuel tank sites that they have determined are hazardous to the environment. The Florida Department of Environmental Regulation has enforced the requirements of the United States Environmental Protection Agency In identifying the environmentally hazardous sites. The three major objectives of the Environmental Protection Agency's program are to stop current fuel pollutant discharges Into the groundwater by requiring the removal of leaking fuel tanks, cleaning the site of contamination and continued monitoring of the site to ensure that all contamination of the groundwater has been halted.
