HomeMy WebLinkAboutO-10934J-91-841 10/31/91 ORDINANCE I30. 10934 AN ELY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "DRUG FREE NEIGHBORHOOD TASK FORCE"; APPROPRIATING FUNDS FOR OPERATION OF SAME IN AN AMOUNT NOT TO EXCEED $42,967; AUTHORIZING THE CITY MANAGER TO ACCEPT $42,967 FROM MMETROPOLITAN DADE COUNTY FROM A UNITED STATES JUSTICE DEPARTMENT GRANT OF $400,000 TO BE ADMINISTERED BY METROPOLITAN DADE COUNTY; FURTBER AUTHORIZING THE CITY MANAGER TO ENTER INTO ANY NECESSARY AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATIPORNEY, FOR THE ACCEPTANCE OF THE $42,967 FOR THE PURCHASE OF EQUIPMENT AND RELATED COSTS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City of Mimi Police Department and Metropolitan Dade County Police Department experience similar problems in continuing to investigate narcotics trafficking; and WHEREAS, there is a need to target specific geographical areas; and WHEREAS, the U.S. Department of Justice, Office of Justice Programs, has approved the award of $400,000 toward a joint Task Force between the City of Miami and Metropolitan Dade County Police Departments to be administered by Metropolitan Dade County; and WHEREAS, equipment purchases and other related expenses totalling $42,967 must be made by the City of Miami Police Department frcan the $400,000; and WHEREAS, any purchases would have to ccxnply with applicable City Code purchasing requirements; AMENDED OY OR51NANCE # 11 o9 qL 'IIu q k� �, r NOW, SORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Special Revenue Rand is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Drug Free Neighborhood Task Force RESOURCES: Metropolitan Dade County $42,967 APPROPRIATIONS: Total Related Costs $11,750 Total Equipment $31,217 Section 2. The City Manager is hereby authorized to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary agreement(s), in a form acceptable to the City Attorney,' for the acceptance of the aforesaid monies for the purchase of equipment and other related costs. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby M:77.1121 Section 4. If any section, part of section, paragraph, clause, phrase, or ward of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four - fifths of the members of the CaYmission. Section 7. Odio City Manager DATE _ 109i FILE -1 V r SUBJECT Ordinance Establishing a Special Revenue Fund REFERENCES: ENCLOSURES: It is respectfully recommended that an Ordinance establishing a Special Revenue Fund entitled: "Drug Free Neighborhood Task Force," accepting monies from Metropolitan Dade County, in the amount of $42,967, and appropriating funds for equipment and other related costs, be adopted. BACKGROUND: The Miami Police Department and Metropolitan Dade County Police Department are experiencing similar problems in combatting narcotics trafficking. Because the jurisdictions of each department borders the other, a joint task force has been developed targeting specific geographic areas. The U.S. Department of Justice, Office of Justice Programs has approved a $400,000 grant to fund the task force. The grant is to be administered by Metropolitan Dade County, however, the City of Miami Police Department is required to expend certain funds, totalling $42,967, toward equipment and related costs. These expenditures include a prisoner transport van, computer equipment leasing, and narcotics information network consultants. No matching funds are required by the City and all purchases will comply with the procurement provisions of the Code of the City of Miami.
