J-91-393 5/21/91 RESOLUTION NO. 9 �` 396 A RESOLUTION, WITH ATTACHMENT(S), CONDITIONALLY APPROVING A MAJOR USE SPECIAL PERMIT PURSUANT TO ARTICLE 17, ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, FOR THE FEDERAL LAW ENFORCEMENT BUILDING PROJECT, PROPOSED BY THE CITY OF MIAMI DEPARTMENT OF DEVELOPMENT AND HOUSING CONSERVATION, TO BE LEASED BY THE U. S. GENERAL SERVICES ADMINISTRATION AND TO BE LOCATED AT APPROXIMATELY 53--73 NORTHEAST 4TH STREET AND 400-446 NORTHEAST 1ST AVENUE (MORE PARTICULARLY DESCRIBED HEREIN), AND TO BE COMPRISED OF NOT MORE THAN 280,000 SQUARE FEET OF GROSS FLOOR AREA IN A BUILDING OF 12 STORIES ABOVE GROUND LEVEL; INCLUDING A PARKING GARAGE COMPRISED OF 67 SECURED PARKING SPACES AND 3 LOADING BERTHS ON GROUND LEVEL AND ONE PARKING LEVEL UNDERGROUND; INCORPORATING GRANTS OF VARIANCE FROM THE ZONING BOARD AND RECOMMENDATIONS OF OTHER BOARDS; ESTABLISHING AN EXPIRATION DATE; MAKING FINDINGS; DIRECTING THE CITY CLERK TO SEND THE RESOLUTION TO THE DEVELOPER AND PROVIDING THAT THE MAJOR USE SPECIAL PERMIT SHALL BE BINDING ON THE APPLICANT AND SUCCESSORS IN INTEREST; PROVIDING FOR RELIANCE ON THE APPLICATION AND PROVIDING AN EFFECTIVE DATE. I i WHEREAS, the City of Miami Department of Development and Housing Conservation has filed a Major Use Special Permit application for the Federal Law Enforcement Building Project, dated March 22, 1991, pursuant to Articles 4 and 17 of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended; and WHEREAS, the preliminary plans for the Federal Law Enforcement Building Project have been reviewed by the Large Scale Development Committee and the Urban Development Review Board on May 2, 1991, and the Project has been found to be efficient, convenient and accessible; and WHEREAS, the Miami Zoning Board, at its meeting of May 6, 1991, following an advertised public hearing, adopted Resolution No. ZB 19-91 by a vote of nine to zero (9 to 0), APPROVING grants of variance for 213 of 280 required parking spaces, 4 of 4 required truck loading bays, and 3.75 feet of 3.75 feet required side street setback; and ATTACHMENTS CONTAINED I sr,, - of May 15, 1991t following an advertised public hearing, adopted Resolution No. PAR 31-91 by a vote of eight to one (8 to 1) RECOMMEND= APPROVAL of the attached Major Use Special Permit for the federal Law Enforcement Building Project; and W99REAS, the development of the Federal Law Enforcement Building project requires the issuance of a Major Use Special Permit pursuant to Article 17 of Ordinance No 11000, the Zoning Ordinance of the City of Miami, Florida, as amended; and WHEREAS, the City Commission, during a public hearing, has considered the Application for Major Use Special Permit; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of. Miami to issue a Major Use Special Permit as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: - Section 1. The recitals and findings contained in the Preamble to this Resolution arehereby-adopted by. reference thereto and incorporated herein as if fully set forth in this Section. Section 2. ' A Major Use Special 'Permit,, attached hereto as Exhibit "A" and made a part hereof, is hereby approved with conditions per Article 17 of Zoning 'Ordinance 11000-, wfor the Federal Law Enforcement Building Project (hereinafter referred to as the "Project") to be developed by the City of Miami Department of Development and Housing'`Conservation -("Applicant/Permittee") . The Project is in conformity with the adopted j Miami Comprehensive Neighborhood Plan 1989-2000, as amended. b. The Project is in accord with the district zoning classification of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. C. Pursuant to Section 1305 of the Zoning Ordinance of the City of Miami, Florida, the specific site plan aspects of the Project, i.e., ingress :and egress, off-street parking and loading, refuse and service, areas, signs and lighting, utilities, drainage, preservation of natural- features and control. of potentially, adverse effects generally, have. been considered and shall be further - :considered: -administratively during the process of; issuing a building permit and _a certificate of occupancy. d. The Project is expected to cost,$35 million,,:.. -to employ a full time equivalent of approximately 343:;. workers'during construction, and to result in:800 permanent jobs. Section 4. The city Commission further finds that; (1) the Project will have a: -,favorable impact:. r the economy of the City; - t r: (2) the Projectwill .efficiently., uee ;_public: transportation facilities; i 3' i k i v"l x ,y _ (3) the proposed parking for the project is efficient, convenient and accessible; i } (4) the project will efficiently use necessary public facilities- (5) the Project will not negatively impact the environment and natural resources of the City; <r (6) the Project will not adversely affect living: conditions in the neighborhood; (7) the Project will not adversely affect public safety; (8) the public welfare will be served by the Project; and (9) any potentially adverse effects of the Project relating to fire protection and life j s safety, solid waste, environmental and historic conservation, trees, minority participation and employment, and minority contractor/subcontractor participation will be mitigated through compliance with the conditions of this Major Use Special Permit. z, Section 5. The Major Use Special Permit, as approved a.. 4 herein and upon execution thereof, shall be binding upon the Applicant/Permittee and its successors or assigns. Section 6. The Application for Major Use Special Permit which was submitted by the Applicant on March 22, 1991, and which is on file with the Planning, Building and Zoning Department of. the City of Miami, Florida, shall be relied upon for. administrative interpretations and is made a part hereof by. FEDERAL LAN ENFORCEMENT BUILDING PROJECT MAJOR USE SPECIAL PERMIT Let it be known that pursuant to Articles 4 and 17 of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended, the Commission of the City of Miami, Florida, has considered in a public hearing, the issuance of a Major Use Special Permit for the Federal Law Enforcement Building development ("Project"). The Project will be located at approximately 53-73 Northeast 4th Street and 400-446 Northeast 1st Avenue, Miami, Florida, more particularly described as: Lots 1 and 2 of Block 73 less the North 36 feet thereof and less the East 10 feet of Lot 1; Lot 3 less beginning Northwest corner of Lot 3, South 29.50 feet, East 50.36 feet, North 36 feet, South 49.95 feet to Point of Beginning; Lot 17; Lot 18; Lot 19 and Lot 20 MIAMI NORTH A.L. After due consideration of the recommendations of the Planning Advisory Board and after due consideration of the consistency;`.of this proposed developmentwith the Miami 'Comprehensive Neighborhood; Plan, the City Commission hereby approves.; the Application for a Major, Use Special Permit: for -the Project with the condition that said Project be developed and constructed substantially in conformance with the plans submitted with the Application by the Applicant, the City of Miami Department:;af Development and -Housing -Conservation ("Applicant/Permitted .� EINUINQS QF FACT r r The Project conforms to the requirements of the applicable' zoni.n'g � district, as contained in Ordinance No. 11000, the Zoning K i; zoning variances, i.e. variances for 213 of 290 required parking spaces, 4 of 4 required truck .loading bays, and for 3475 feet of 3.75 feet required aide street setback, were approved by the Zoning Roard on May 6, 1991. No special exceptions are contemplated for execution of the Project. The comprehensive plan future -land use designation allows the proposed use. 'the Project has been reviewed by the Miami Large Scale Development Committee Meeting and the Urban Development Review Board; the recommendations of the Urban Development Review Board pertaining to tree species and additional benches have been forwarded to the project architects for their consideration. The Project shall be constructed substantially in accordance with plans and design schematics on file dated March 22, 1991, and prepared by Rodriguez and Quiroga, Architects Chartered, said schematics to include the above -referred grants of variance from the Zoning Board. The Project, as defined above, meets requirements for issuance of this Major Use Special Permit Development Order.
