HomeMy WebLinkAboutR-91-03900 A RESOLUTION, WITH ATTACHMENT# APPROVING A MODIFICATION OF THE REQUIREMENTS OF- THE WATERFRONT CHARTER AMBNOMENT, AS SET FORTH IN SECTION 3(mm) OF THE CHARTER OF THE CITY OF MIAMIt FLORIDA, AS AMENDED, TO PERMIT THE CONSTRUCTION OF A TWO STORY RESTAURANT ADDITION TO AN EXISTING TWO STORY BUILDING (ALSO TO BE USED FOR RESTAURANT PURPOSES) ON PROPERTY LOCATED AT 109 SOUTHWEST SOUTH RIVER DRIVE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN); WITH A PROPOSED SETBACK OF 20'-4" (25'- 10" REQUIRED) AND AGGREGATE SIDE YARDS OF 17'-0" (22'-2" REQUIRED), SAID MODIFICATION BEING SUBJECT TO CERTAIN STATED CONDITIONS. 1 I WHEREAS, Section 3, Paragraph (ii) of Subsection (mm), of the Charter of the City of Miami, Florida, as amended, requires a set- back from the Miami River equivalent to 25% of the lot depth and aggregate side yards equivalent to 25% of the lot width, except as may be modified by the City Commission as set forth in Paragraph (ii'i) of said Subsection (mm) of Charter Section 3; and WHEREAS, by Resolution HC-86-14, the Heritage Conservation Board has recommended, and by Ordinance No. 10213, the City. Odlo ENCLOSURES: Agenda item PZ-8 City City Manager Commission Meeting of May 28, 1991 RECOMMENDATION: It is respectfully recommended that the City Commission approve a modification to the Waterfront Charter Amendment, as set forth in Section 3 (mm)(ii) and (iii) of the Charter of the City of Miami by approving: a) a proposed setback of 20'-4 (25'-10" required) and proposed aggregate side yards of 17'-0" (22' 2" required), to permit the construction of a two story restaurant addition to an existing two story building, also to be utilized for restaurant purposes, — located at 109 S.W. South River Drive overlooking the Miami River, as part of. the Miami River Inn. BACKGROUND: By Resolution HC-86-14, September rd had 8 ecord Ordinance mmended, and the City Commission 1987, the Heritage Conservation Board had adopted, an HC-2 Heritage Conservation Overlay District for the subject lot and the half -block to the west across S.W. South River "Drive. By Resolutions HC-86-15 HC-86-19, HC-86-21, HC-87-10, HC-87-15, the Heritage Conservation Board granted Certificates of Appropriateness for rehabilitation of five structures on the half -block which were subsequently remodeled as the- of Inn - a bed-and-breadfast hospitality lodging. (See attachment South River Drive Historic District). The applicants now propose to construct a two-story addition to an existing` two-story building, at the 109 S.W. South River Drive location which will be remodeled.and utilized for restaurant purposes, overlooking the Miami River. �y Resolution HCB-91-11 the Heritage- Conservation Board has approved a Certificate of Appropriateness for the proposed project, further recommending the granting of a variance and the modification to the Waterfront Charter.
