A RESOLUTION APPROVING THE PURCHASE OF DIVE
SUITS SUITABLE FOR DIVING IN HAZARDOUS
MATERIALS, AND ALLOCATING FUNDS THEREFOR, IN
AN AMOUNT NOT TO EXCEED $16,000, FROM THE LAW
ENFORCEMENT TRUST FUND, SUCH COSTS HAVING
BEEN APPROVED BY THE CHIEF OF POLICE AND
BEING SUBJECT TO APPLICABLE CITY CODE
PROCUREMENT PROVISIONS.
WHEREAS, Florida State Statute 932.704(3)(a), as amended,
authorizes the expenditure of forfeiture proceeds for law
enforcement purposes not considered normal operating expenses;
and
WHEREAS, the Miami Police Department Dive Team is asked to
dive in increasingly polluted coastal waters as well as the Miami
River; and
WHEREAS, diving in these waters can cause illness and
disease resulting in a loss of personnel as well as an expense to
the City; and
WHEREAS, state-of-the-art dive suits and masks can minimize
the risk of danger to the diver; and
WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the proposed expenditure
complies with Florida State Statute 932.704, as amended; and
WHEREAS, funds to cover the purchase are available in the
City of Miami Law Enforcement Trust Fund, Project No. 690001,
Index Code 029002-247;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The purchase of dive suits suitable for diving
in hazardous materials, is hereby approved with funds therefor,
in an amount not to exceed $16,000, being hereby allocated from
the Law Enforcement Trust Fund, Project No. 690001, Index Code
029002-247, such costs having been approved by the Chief of
Police, and being subject to compliance with applicable City Code
procurement provisions.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully requested that a Resolution authorizing the
purchase of dive suits suitable for diving in hazardous
materials, at a cost not to exceed $16,000, and allocating funds
therefor from the Law Enforcement Trust Fund, be approved.
The Miami Police Department Dive Team is increasingly being
placed in a position of having to refuse to dive for evidence,
cars or other items, in the interest of officer safety. This is
due to the rising level of pollution in the coastal waters as
well as the Miami River. The risk can, however, be minimized by
wearing state-of-the-art dive suits and masks. This equipment
reduces injury to the diver as well as costs to the City
resulting from the loss of a diver.
It is, therefore, recommended that a Resolution authorizing the
purchase of dive suits and masks, at a total cost not to exceed
$16,000, and allocating funding therefor from the Law Enforcement
Trust Fund, Project No. 690001, Index Code 029002-247, be
approved.
