HomeMy WebLinkAboutR-91-0319"i ►-91-306 3/28/91 RESOLUTION NO. _ 9 A RESOLUTION RECONSIDERING RESOLUTION NO. 91- 78 ENTITLED "A RESOLUTION DENYING THE APPEAL AND AFFIRMING THE ACTION OF THE ZONING BOARD IN MODIFYING AS PER SECTION 3006 OF ZONING ORDINANCE 9500, AS AMENDED, THE DECISION OF THE ZONING ADMINISTRATOR RENDERED IN HIS LETTER DATED AUGUST 1, 1990, REGARDING LANDSCAPE REQUIREMENTS FOR THE LIVE OAR CONVALESCENT HOME FOR THE PROPERTY LOCATED AT 2500 NORTHWEST 22 AVENUE, MIAMI, FLORIDA, ALSO DESCRIBED AS ALL OF TRACT A AND TRACT B LESS SOUTH 170', ZIPES SUBDIVISION, AS RECORDED IN PLAT BOOK 78 AT PAGE 54, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, BY ACCEPTING THE LANDSCAPE PLAN INITIALLED BY JOSEPH A. GENUARDI AND BEARING THE DESIGNATION "NAGYMIHALY PROPERTIES PLAN OF SASAKI ASSOCIATES, INC., OF NOVEMBER 1, 199011, (THE "PLAN") SUBJECT TO THE MODIFICATION OF SAID PLAN TO SHOW A CONCRETE MASONRY WALL ON THE PROPERTY LINE IN LIEU OF THE ALUMINUM FENCE", SAID RESOLUTION NO. 91- 78 HAVING BEEN ADOPTED JANUARY 24, 1991. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The action of the City Commission taken January 24, 1991 in its adoption of Resolution No. 91-78 entitled "A Resolution denying the appeal and affirming the action of the Zoning Board in modifying as per Section 3006 of Zoning Ordinance s 'x 9500, as amended, the decision of the Zoning Administrator rendered in his letter dated August 1, 1990, regarding landscape requirements for the live oak convalescent home for the property located at 2500 Northwest 22 Avenue, Miami, Florida, also described as all of Tract A and Tract B Less South 170', ZIPES SUBDIVISION, as recorded in Plat Book 78 at Page 54, of the Public Records of Dade County, Florida, by accepting the landscape plan initialled by Joseph A. Genuardi and bearing the designation "Nagymihaly Properties Plan of Sasaki Associates, Inc., of November 1, 1990", (the "Plan") subject to the modification of said plan to show a concrete masonry wall on the CITY COMMSION NlMING OF G property line in lieu of the aluminum fence", is hereby :. �f reconsidered.' April 17, 1989 Zoning Administrator sends letter (decision) pertaining to uses on the subject property. August 1, 1990 Zoning Administrator sends letter (decision) to Metropolitan bade County Department of Development and Facilities Management setting out landscape mitigation requirements for 13 oak trees that had been ,transplated per approved plans. - September 18, 1990 On appeal from Veronica Nagymihaly and family, abutting property owners to the south, the Heritage Conservation Board, by Resolution HCB-90-29, modified the decision of the Zoning Administrator of August 1, 1990, approving a landscape plan dated September 18, 1990, by applying additional HCB conditions pertaining to additional oak trees and a wall extension. October 15, 1990 On appeal, the Zoning Board by Resolution ZB-92-90 denied the appeal and upheld the Zoning Administrator's decision of April 17, 1989. On appeal, the Zoning Board by Resolution ZB-93-90 upheld the appeal and denied the decision of the Zoning Administrator dated August 1, 1990. November 8, 1990 On appeal, the City Commission by Resolution 90-910 modified the decision of the Heritage Conservation Board (Resolution HCB-90-29) which had previously - modified the Zoning Administrator's decision of August 1, 1990 by applying additional Commission conditions pertaining to an aluminum fence, wall extension and additional oak trees. January 24, 1991 On appeal, by Resolution 91-75, the City Commission denied the appeal and affirmed the decision of the Zoning Board (Resolution ZB-92-90) in upholding the Zoning Administrator's decision of April 17, 1989 pertaining to construction and uses. On appeal, by Resolution 91-77, the City Commission modified the decision of the Heritage Conservation Board (Resolution HCB 90-29) which had -modifed the Zoning Administrator's decision dated August 1, 1990; said Commission modifications included accepting the November 11 1990 plan signed by the Zoning Administrator at the public hearing and applying additional Commission conditions pertaining to oak trees and a wail extension but eliminating the aluminum fence in Resolution 90-910. On appeal, by Resolution 91-78, the City Commission denied the appeal and affirmed the decision of the Zoning Board (Resolution ZB -93-90) modifying the Zoning Administrator's decision of August 1, 1990, but modified by the Commission by accepting the November 1, 1990. February 14, 1991 Plan approved by Zoning Administrator for permit; bond posted by Metro Dade County; completion of work estimated at 180 days and a partial CO issued for kitchen area only; no patients to be admitted to new wing. March 28, 1991 Mrs. Veronica Nagymihaly makes a personal appearance before City Commission and requests further consideration; Commission schedules possible - reconsideration for April 25, 1991.
