RESOLUTION N0. 1
A RESOLUTION APPROVING, IN PRINCIPLE, THE
CONCEPTUAL MASTER PLAN FOR THE PROPOSED
RENOVATION OF PEACOCK PARK AS PREPARED BY THE
PARKS AND RECREATION DEPARTMENT AND PRESENTED
BY THE COCONUT GROVE CHAMBER OF COMMERCE;
FURTHER ALLOCATING AN AMOUNT NOT TO EXCEED
$15,000 FROM THE COCONUT GROVE SPECIAL EVENTS
DISTRICT FUND IN SUPPORT OF SAID PROJECT.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The conceptual master plan
for the proposed
renovation of Peacock Park, as prepared
by the Parks and
Recreation Department and presented by the Coconut Grove Chamber
of Commerce is hereby approved in principle.
Section 2. An amount not to exceed
$15,000 is hereby
allocated from the Coconut Grove Special Events District Fund in
support of said Project.
Section 3. This Resolution shall
become effective
immediately upon its adoption.

As Executive Director of the Coconut Grove Chamber of
Commerce, I am requesting the opportunity to appear before the
City Commission on Thursday, April filth.
I will be presenting to the City Commission a proposed
renovation project for Peacock Park, sponsored by the Coconut
Grove Chamber of Commerce, The Coconut Grove Jaycees and The
Coconut Grove Association. Our advisors to this project were
the City of Miami Parks and Recreation Department.

After several meetings to discuss neighborhood complaints,
a special committee of homeowners, residents association,
merchants and concerned citizens was created and they are
the existing noise
requesting from the City a modification to
the needs of the
ordinance that will take into consideration

Dear Mayor Suarez:
Complaints about the loud music coming from some of the establishments in the Grove have been have been received
by the police and the Chamber with increasing frequency. On Thursday, March 14 the Chamber called a meeting of
all Grove merchants who play music audible from the street. At the request of the police, several residential
representatives were in attendance, as well as representatives from your office and the City attorney's office. The
problem of the loudness of the music in the Grove commercial district was the opening topic and can be summarized
as follows:
The Problem:
Music is played by Grove establishments to draw attention to their establishment as we)) as entertainment for
customers already at the establishment. The attention getting motive is surely the source of most residents
complaints. it would seem that the corrective measure necessary to reduce complaints is simply to turn the
music down. However, voluntary compliance depends upon all establishments adhering to guidelines. If a few
establishments exceed these standards they exert unfair competition on the rest. Soon noise wars could be
expected to resume with each establishment vying for their share of the Groves stroliIng customers.
The Solution:
The solution sounds simple. The police should provide uniform enforcement to a standard. Currently the only
enforceable standard Is the it pm noise curfew which all agreed is not an acceptable solution.
There was a genuine interest by all parties to develop acceptable solutions. The merchants recognize the
Importance of constant supervision of the noise level of the bands in their employ. The residents recognize the
Importance of music to the economic well being of the food and beverage establishments in Coconut Grove and share
a common interest not to cause action that could devastate the visibility of the Grove's commercial center.
A small committee to summarize the ideas discussed in the meeting and develop some suggested courses of action.

Naron, ExeoutiVe'Director of the Chamber, Bob Green of Grove Calloway's, Sky Smith representing South Grove
residents," William Schob representing Yacht Harbor residents and Ted Stahl concerned citizen, Advising the
committee ere Police Major Ivan Fernandez, Assistant Chief City Attorney Joel Maxwel, and Jaun Garcia from your
office. -Following are the recommendations of the committee.
i. --The first step wiil be self regulation based upon the realization that continued complaints will bring police
citations to ail offending establishments. The Police will assist in developing this recognition among the
merchants by immediately beginning to bring excessively loud music to the attention of offending merchants
and if necessary issuing citations. Follow-up meetings between merchants and residents will be held every
few weeks to assess results and review specific incidents.
Because Of the positive attitude of all those present at the meeting today I believe there is real hope that this
action can resolve the, present situation for the time being.
2, There is widespread recognition among both merchants and residents that the Grove's Commercial District has
rapidly developed into a night time attraction for locals and tourists alike. On the weekends, food and beverage
sales are at a high about the time the present noise ordinance would require the music to be shut down. A
modification to the existing ordinance needs to be made that will take into consideration the needs of the
merchants as well as the sensitivities of the nearby residents, Below are some of the points that must be
considered in the modified ordinance.
A. The ordinance needs to provide for a later "quiet hour" than i l pm, especially on the weekends.
B, Street side cafes should be allowed music sources within parameters to be established.
C. Definitive noise levels should be included in the ordinance that provide for clearly enforceable decibel
levels for normal business hours as well as "quiet hours".
3. It was the feeling of the committee that a study should be conducted by experts in such matters to assist in
establishing acceptable enforceable noise levels. However, after the meeting Ted Stahl brought to our attention
that decibel limitations do exist as part of a recently reworked noise ordinance. Subsequent discussion with
Waiter Loman of Public Works, one of the authors, indicated that the work done was a simplification of the
previous ordinance, The revision Involved reduction of the decibel level in residential areas and increasing the
decibel level in commercial areas.
A key difference in the new ordinance is that the frequencies measured cover only one measurement band which
will make the ordinance more easily enforcible. The concern here is that the standards that have been
established behind a desk are workable and acceptable to all parties in Coconut Grove, We suggest that this
ordinance be tested under actual conditions here in the Grove Commercial District to see if it Is practical. This
committee should then review the test results. If needed, possibly minor modifications to this ordinance will
suffice.
If a further study Is needed, it should also address the issue of methods of baffling and deflecting the noise so as
to reduce annoyance to residents.
The Chamber will continue to play an ongoing role in this process. The committee would like to assure you that we
are ready to assist in achieving a satisfactory resolution to the music/noise problem in the Grove.
