RESOLUTION NO-
A RESOLUTION WAIVING BY A 4/5THS AFFIRMATIVE
VOTE OF THE MEMBERS OF THE CITY COMMISSION
AFTER A DULY ADVERTISED PUBLIC HEARING, THE
PROHIBITION CONTAINED IN CITY CODE
SECTION 2-302 FOR THE PROCUREMENT OF
PROFESSIONAL SERVICES BY ELOY VASQUEZ IN
CONNECTION WITH THE PROMOTION AND
SOLICITATION OF SPONSORS FOR THE "JULY 4TH
WEEKEND EXTRAVAGANZA" BEING HELD BY THE

BAYFRONT PARK MANAGEMENT TRUST AT SAYFRONT
PARK.
WHEREAS, Eloy Vasquez, a former member of the Bayfront Park

Management Trust, resigned from said Trust on May 14, 1990; and
WHEREAS, the City is in need of the services of a person to

promote and solicit corporate sponsors for the 1991 July 4th
Weekend Extravaganza to be held in Bayfront Park; and
WHEREAS, Eloy Vasquez, possesses the unique professional

qualifications to carry out those functions;

NOW,_ THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMIj,FLORIDA:.
Section1. The recitals and findings contained in the
'
Pkeamblie ,,to- this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The waiver set forth in Section 3 hereof is
based upon the recitals and findings contained in Section 1
hereof and upon the following findings:
X:
(a) the services of Eloy Vasquez are unique in
character as they relate to promotion and sponsor

solicitation for festivals and events;

(b) the City of Miami desires said services to be
performed by Eloy Vasquez through a proposed

agreement, the execution of which would be in
t
violation of City Code Section 2-302 were there

not a waiver of the prohibition contained in said
Section 2-302; and
(c) the herein proposed transaction will be in the
beat interest of the City of Miami.
Section 3.
The prohibition contained in Section 2-302 of
the City Code is hereby waived by a 4/5ths affirmative vote of
the members of the City Commission after a duly advertised public
hearing.
Section 4. This Resolution shall become effective
immediately upon its adoption.
