HomeMy WebLinkAboutR-91-0291r J-91-272 4/3/91 RESOLUTION NO. 91 - 291 A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS DUE TO A SOLE SOURCE OF PROCUREMENT AND APPROVING THE ACQUISITION OF MAINTENANCE OF SOFTWARE RELATED SERVICES FROM DIGITAL EQUIPMENT CORPORATION (DEC) AT AN ESTIMATED ANNUAL COST OF 6,348.00 AND ENVIRONMENTAL SYSTEMS RESEARCH INSTITUTE (ESRI) AT AN ESTIMATED ANNUAL COST OF $9,300.00 FOR A TOTAL ESTIMATED ANNUAL AMOUNT OF $15,648.00 ON A CONTRACT BASIS FOR A PERIOD OF FIVE YEARS RENEWABLE ANNUALLY FOR THE DEPARTMENT OF PLANNING, BUILDING AND ZONING; ALLOCATING FUNDS THEREFOR FROM THE 1990-91 OPERATING BUDGET ACCOUNT NO. 290201-670; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS SERVICE AND THEREAFTER TO RENEW THIS CONTRACT ANNUALLY SUBJECT TO THE AVAILABILITY OF FUNDS. WHEREAS, on April 13, 1989, the City Commission adopted Resolution No. 89-362 accepting the complementary proposals of Environmental Systems Research Institute (ESRI) and Digital Equipment Corporation (DEC) for the hardware and software services 'necessary to establish a basic geographic information I ystem,-this 'included software and hardware maintenance for only one year; and WHEREAS, the City's GIS is presently being used by the Departmentsof Police, Fire Rescue and Inspection Services, Planning, Building and Zoning, GSA/Solid Waste, Development, Housing for crime analysis, 'fire and emergency response modeling, code enforcement tracking, census- date analysis, solid waste routing'and"housing estimates; and WHEREAS, in order to maintain operation of the City's GIS; -it is necessary to "continue receivina these softwArc3 ragat�r1 distribution services from these two vendors, as these types of services are proprietary respective firms; and and can only be obtained from the WHEREAS, funds for this service are available in the 1990-91 Operating Budget, Account Code No. 290201-670; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirement for competitive formal sealed bids be waived and the procurement from Environmental Systems Research Institute and Digital Equipment Corporation, be approved for period of five years,,renewable annually; a NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. -Section 2. By a 4/5ths affirmative vote of the members of the City Commission following a properly advertised public hearing, the requirement for competitive sealed bids is hereby waived and the Department of Planning, Building and Zoning Department request for the continuation of software -related services from Environmental Systems Research Institute (ESRI) at an estimated annual amount of $9,300.00 and Digital Equipment Corporation (DEC) at an estimated annual amount of $6,348.00 for a total estimated annual cost of $15,648.00 is hereby approved, With funds therefor hereby allocated from the 1990-91 Operating Budget, Account Code No. 290201-670. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order F; for this service for one year and thereafter to renew this contract annually upon the same terms and conditions for a period of four years subject to the availability of funds. Software and hardware maintenance services were included for one year only. In order to continue to operate the GIS, it is necessary that authorization be provided to continue the acceptance of software - related service, in the form of ESRI annual software support fees for maintenance and update services and DEC media and document distribution services, from these two vendors for a five (5) year period subject to the availability of funds. This type of software -related service is proprietary and can be obtained only from the respective firms. The provision of hardware -related services however,' can, and will be, handled through competitive bids. The estimated annual cost for DEC software -related service is approximately $6,408.00. The estimated annual cost for the ESRI services is approximately $9,Oo0.00 for a total estimated amount of`'$15,408.00 Funds for these services are available in the current year Police Operating Budget Account Code No. 290201-670.
