A RESOLUTION APPROVING, IN PRINCIPLE, THAT
PROCESS INVOLVING REPLATTING WHICH WOULD
ALLOW A SECURITY BRIDGE TO BE CONSTRUCTED
CONNECTING THE METROPOLITAN DETENTION CENTER
r AND THE FEDERAL COURT HOUSE, 301 NORTH MIAMI
AVENUE, MIAMI, FLORIDA.

WHEREAS, on March 14, 1991, in a personal appearance before
the City Commission, Mina Mazaheri, Attorney Advisor,
representing the Federal Bureau of Prisons, requested permission
from the City Commission to build a security bridge over
Northeast 4th Street to connect the Metropolitan Detention Center
and Federal Courthouse at 301 North Miami Avenue, Miami, Florida;
and
WHEREAS, the Administration explained one process to allow
building the security bridge is by vacating and abandoning this
one block segment of Northeast 4th Street between North Miami
Avenue and Northeast 1st Avenue, by replatting this street
segment, by conveying a pedestrian and utility easement over the
vacated street to the City the federal government, and by
improving the street as a pedestrian promenade; and
WHEREAS, in the alternative, the Federal Bureau of Prisons has expressed a preference for only purchasing air rights for the
security bridge from the City without improving the Northeast 4th
Street right-of-way as a pedestrian promenade; _
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

improVemonts of N.M. 4th Street. GSA agrees with Chief Judge
Kibg's letter to Mr. Cesar Odio, dated January 11, 1991, proposing
a partial closure of N.M. 4th Street, and we agree with Mr. Odio's
response to Judge King proposing appropriate street improvements,

RECOMMENDATION
It is recommended that the City Commission adopt a resolution of intent,
approving, in principle, a process allowing a security bridge to be
constructed across N.E.. 4th Street, connecting the Metropolitan Detention
Center and Federal Courthouse.
BACKGROUND
The Federal Bureau of Prisons (FBOP) has announced its intention of
constructing a Metropolitan Detention Center on the east side of N. Miami
Avenue between N.E. 4th Street and N.E. 5th Street. Although opposed to the
i location of such a facility in Downtown Miami, the City Commission did agree
that this site was the most appropriate location.
The FBOP requires a) that N.E. 4th Street be periodically and intermittently
closed to allow detainees to be securely transferred from the Metropolitan
Correctional Center in South Dade to the Metropolitan Detention Center and b)
an overhead pedestrian security bridge connecting the Metropolitan Detention
Center to the Federal Courthouse for secure transfer of detainees between the
two buildings.
The Chief Judge of the Federal District Court has expressed a strong desire
for a pedestrian mall on N.E. 4th Street (see attached exchange of
correspondence).
_ Assuming that the closing of this one -block segment of N.E. 4th Street and its
conversion to a pedestrian mall or promenade is a mutually agreed objective,
then one alternative is for the City to vacate and abandon N.E. 4th Street.

our suggestion for a partial closure of N.E. Fourth Street
between N.E. First Avenue and North Miami Avenue.
This morning I have spoken to Mr. Thomas "Ed" Davis and Mr.
Thomas Maguire, both of GSA, Atlanta office, regarding your
letter. They, or members of their department, will be in
touch with Mr. Bailey and Ms. Weintraub to follow up in
implementing this closure.
This court, and the federal officials involved from General
Services Administration and the Administrative Office in
Washington, D.C., are grateful to you, the Mayor and
members of the City Commission for the splendid cooperation
you have extended to us regarding the Federal Law
Enforcement Building.
When dealing with the federal bureaucracy, it sometimes
takes. years to accomplish what the leadership the City of
Miami accomplished in moving forward with this building.

Thank you for your letter of January.ii, 1991 in which a partial
closure of N.E. 4th Street between N.E. lst Avenue and NoLLh
Miami.Avenue was proposed. I agree Lhat the closure of this
portion of N.S. 4th Street$ running between what will ultimately
be a, Federal complex of buildings, to vehicular traffic: except
authorized vehicles is an excellent idea. A partial closure,
along with appropriate street improvements, would prove to be
both a unifying element to a variety of Federal facilities
fronting the street and would additionally coincide with City of
Miami goals to extend the pedestrian mall from Miami Dade
CunuilunlLy College weistward.

Since N.E. 4th Street is a local City street, the City of Miami
will prepare design -guidelines to be implemented for a partial
,street closure. Street improvements could include such items as
decorative pavers, landscaping, lighting, and street furniture.
It would be the City's intent to construct that portion of a
pedestrian mall adjacent to the Federal Law Enforcement Building
-to coincide with the construction of the Law Enforcement
Building. We are presently in the design phase with construction
anticipated to begin in July 1991. The City would then furnish
the approved design specifications for the street to the Bureau
of Prisons with the hope that they would be incorporated into
their plans for the Metropolitan holding facility.
As the City progresses with this suggested approach to accomplish
a partial street closure of N.E. 4th Street, including
improvements to maintain -a pleasant public space while meeting
the access and security requirements of the Federal facilities
we would be pleased to furnish you or the appropriate persbn(s)
with plans as they are developed for comments.

As you know+ the Bureau of Prisons is commencing conctiruction Of
A 22- story metropolitan holding facility on the western half of the
block facing North Miami. Avenuo between 4th and 5th streets.
Tito City of Miami ie building, for lease to General Servicaft
Administration, a 12-atory Law Enforcement Building on the eastervi
half of the same block. This building, an you undoubtedly know,
will house the offices of the United States Attorney, the Court of
Appeals for the Eleventh Circuit, the Bankruptcy Court of. the
Southern District, and four U.S. District Judge courtrooms and chambers for for our court.
Judge Kenneth Ryskamp suggeuted to me yesterday that it. may be well
to consider a partial" closure of the street that rune through this
two square block of federal buildings. our prevent complex
includes the entire block between Miami Avenue and lot Avenue and
3rd and 4th Streets. The suggestion contemplated that the street
would be closed in a similar manner to the closure of 4th Street
as It runs between the various buildings of the downtown Community
-L College. ThLo street has been closed to all vehicular traffic but

oamPus on 4th Street between N.B. lest and 2nd Avenue.

if this suggestion is feasible, it should be implemented in the
norar future( since they are getting ready to design the federal
holding facility for the 1,100 inmates. The design of that
building may be changed slightly if It were come to Pape that the
street was closed.
We have had a number of security problems over the yoarn and with
tho oundtruction of these two massive buildings, with all of the
security problems inherent with operating a prison and another
c:outt-d building, it seems desirable to be able to block off the
street and put the responsibility for maintaining security in the
area upon the federal government, What I have in mind ie perhaps
having the federal protective security force that maintains
security in our present one -block complex be responsible for
maintainingq in the two -block complex with the entrance and exit
being at Ml.ami Avenue to authorized vehicular traffic.
I request that you have someone got in touch with the architects
and designers of the Metropolitan holding facility and with GSA to
explore the feasibility of this project. 1 will ask those federal
agoncieu to contact your office for Lhe same purpose.
