RESOLUTION NO.
A RESOLUTION CONFIRMING THE ACTION OF THE
CITY COMMISSION ON FEBRUARY Ar 1991,
APPROVING IN PRINCIPLE,
THE PROCESS FOR
RETAINING THE HISTORIC CHAILLE BLOCK ARCADES,
401-445 NORTH MIAMI AVENUE,
MIAMIr FLORIDA.
WHEREAS, by Ordinance No. 10530
adopted December 15f 19881
the City Commission applied the HC-1
zoning overlay district to
the Chaille Block, located at 401-445
North Miami Avenue, Miami,
Florida; and
WHEREAS? by Ordinance No. 10481,
adopted September 27, 1988,
the City Commission applied the HC-1
zoning overlay district to
the Federal Courthouse, located at
300 Northeast 1st Avenue,
Miami, Florida- and
WHEREAS, the Final Environmental
Impact Statement (August,
1990) determined that the construction of the Metropolitan
Detention Center will have an impact on the historic Chaille
Block and could potentially impact the Federal Courthouse; and
WHEREAS, the City of Miami, the State Historic Preservation
Office; the Advisory Council on Historic Preservation and the
Federal--,. 'Bureau of Prisons have entered into a Memorandum of
Agkeemeent, . dated February 1, 1991, pursuant to Resolution
No. 91-44, adopted January 10, 1991, which agreement commits the
agencies to cooperate in preserving the historic Chaille Block
while constructing,the Metropolitan Detention Center; and
WHEREAS - 'during discussion of Item 17 at the February 14,

1991 City Commission Meeting regarding the purchase of land for
the L dw- Enforcement. Building from the City of Miami by the
federal .'government, ernment, the City Administration explained that to

have to be vacated and roplatted whereupon a pedestrian easement
over the sidewalk, would then be granted by the federal
government; and
_ WHEREAS, the Commission tentatively approved with this
process as set forth by the Administration;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
i Section 1. The recitals and findings contained in the
' Preamble to this Resolution are hereby adopted by reference

' thereto and incorporated as if fully set forth in this Section.
Section 2. The action of the City Commission on
" February 14, 1991, approving, in principle, the City
' Administration's process for retaining the historic Chaille Block
Arcades; located at 401-445 North Miami Avenue, Miami, Florida,
is hereby:confirmed.
Section 3. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION
It is recommended that the City Commission adopt a resolution of intent
confirming the Commission's approval, in principle, of a process for retaining
the historic Chaille Block arcades, located at 401-445 N. Miami Avenue.
BACKGROUND
The Federal Bureau of Prisons (FBOP) has announced its intention of
constructing a Metropolitan Detention Center on the east side of N. Miami
Avenue between N.E. 4th Street and N.E. 5th Street. Although opposed to the
location of such a facility in Downtown Miami, the City Commission did agree
that this site was the most appropriate location. The City has worked closely
with the FBOP to assure that the Chaille Block, which has been designated as a
historic district by the City Commission, is preserved in conjunction with the
new development.
One of the most significant features of the Chaille Block is the series of
arcades projecting over the sidewalks. A portion of the arcade encroaches
into the public right-of-way. FBOP has informed us that although it intends
to preserve the Chaille Block, it has no authority to expend Federal funds to
improve -property in the right-of-way (see attached letter). Therefore, FBOP
has requested either fee simple ownership of this.portion of the right-of-way
or air rights.
During discussion .on February 14, 1991, the Commission agreed to a process
whereby the zoned right-of-way of N. Miami Avenue would,be reduced from 60
feet to 50 feet, that the portion of the sidewalk under the arcades would be
vacated and replatted, and a pedestrian easement would be conveyed back to the
City.
A formal resolution is requested in order to reassure the FBOP.

Dear Mayor Suarez:
The purpose of this letter is to seek your assistance with a
problem that has come to our attention regarding the site for the
proposed Metropolitan Detention Center (MDC) in downtown Miami.
As you may know, the Bureau of Prisons (BOP) is reviewing three
sites, one of which contains the historic Chaille Block. This
site currently appears to be the most likely for selection. We
have been informed, however, that projecting arcades of the
buildings in the Chaille Block encroach on the public right-of-
way (side walk) on North Miami Avenue. Since we do not have the
authority to use Peftral funds to improve property in the public
right-of-way, this situation will affect our ability to preserve
and incorporate the most significant characteristic of the
Chaille Block into the design of the MDC. In your letter of
March 9, 1990, you outlined several advantages of this site,

including the need to "...preserve this piece of Miami
,-in conjunction with the new development".
I am writing to ask your assistance and cooperation in making
this 10 foot public right-of-way available to the BOP in a manner
which will allow us to repair and preserve the arcade.
