HomeMy WebLinkAboutR-91-0164,J-91 PO4 2/28/91 RESOLUTION NO. 91 164 A RESOLUTION AUTHORIZING THE CONVEYANCE TO DADE COUNTY OF PROPERTY LOCATED AT APPROXIMATELY 350 NORTHWEST 5TH STREET, MIAMI) FLORIDA, AND MORE PARTICULARLY DESCRIBED AS LOTS 11 THROUGH 15 INCLUSIVE IN BLOCK 67-N OF A.L. KNOWLTON'S MAP OF MIAMI� ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK B AT PAGE 41 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, LESS THE SOUTH 10.00 FEET OF SAID LOTS 11 THROUGH 159 AND LOT 16 IN SAID BLOCK 67-N, LESS THAT PORTION THEREOF ACQUIRED BY THE STATE ROAD DEPARTMENT OF FLORIDA, BY A CITY DEED, WITH A REVERTER CLAUSE IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, on December 20, 1979, the City of Miami and Dade County entered into a Land Exchange Agreement wherein the County conveyed to the City property described as Lots 11 through 15 inclusive in Block 67-N of A.L. KNOWLTON'S MAP OF MIAMI, according to the plat thereof recorded in Plat Book B at Page.41 of the Public Records of Dade County, Florida, less the South 10.00 feet of said Lots 11 through 15, and Lot 16 in said Block 67-N, less that portion thereof acquired by the State Road Department of Florida, said property being referred to as Exhibit J of the Land Exchange Agreement; and WHEREAS, the land was conveyed to the City for the purpose of surface parking; and WHEREAS, does not need the property at this time for surface parking; and WHEREAS, the County has received a request from the YWCA to lease this site for the purpose of developing a 20,000 square foot facility which will accommodate a day care center and teen 11 center; and AI 1/�F� G` 44rr snow Jp WHEREAS, the City is in full support of the YWCA's endeavors It appears to be Compatible with the Southeast Overtown/Park West Redevelopment area; and WHEREAS, in the event that within two years from the date of conveyance of the property the County does not lease the property to the YWCA or the YWCA does not pull a building permit the property will automatically revert back to the City; and WHEREAS, this type of development appears to be compatible with the Park WestlOvertown Development area; 3 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recital and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this - Section. E Section 2. Conveyance of title to Dade County, Florida, title of the property located at approximately 350 Northwest 5th A Street, Miami, Florida, and more particularly described as Lots 11 through 15 inclusive in Block 67-N of A.L. KNOWLTON'S MAP OF MIAMI, according to the plat thereof recorded in Plat Book B at Page 41 of the Public Records of Dade County, Florida, less the South 10.00 feet of said Lots 11 through 15, and Lot 16 in ' said Block 67-N9 less that portion thereof acquired by the State 1 Road Department of Florida, is hereby authorized by the City i> Manager's execution of a City Deed with a reverter clause providing that in the event that within two years from the date of the conveyance of the property to the County, the County does. not lease the property to the YWCA or the YWCA does not pull a'' building permit the property will automatically revert back to ik the City. 4' Section 3. ENCLOSURES: { j RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution, conveying the property referred, to as Exhibit J of the Land Exchange Agreement entered:, into on December 20, .1979, between the City and the -County, back;; to the - County by a.City..deed in a form acceptable to the City -Attorney. BACKGROUND The Department of -Development, Property and Lease Management- 3 Division, received<,a request.from Dade. ,County for the City to ` convey certain.property back to the County. As part of the 1979 City/County Land Swap, the County conveyed to the;City,a site for the purpose - of -surface. parking. The deed contains,:a reverter clause stipulating that,,the site --was to revert; to the.:County if the site was not .put to, such use. The County .has,, received a request from. the YWCA,, to lease; _ this site for the:.,purpose pose of { developing a: day .care and teen _center. The County is now requesting that the site be conveyed back to the County so that it may enter into a lease agreement with the YWCA.: Because this site is no longer needed by the .City for its intended use and since this type of development appears to be '.' compatible with the Park West/Overtown Development area, it is ' - recommended that the sub .. _ j act property be conveyed back to the -, County by way of an executed City deed.
