IN THE AM3UNT OF $140,754.00 AS THE LowEST RESPONSIBLE AND RESPONSIVE BID FOR NECESSARY MATERIALS, CONSTRUCTION AND SERVICES TO CC HP'LETE SAID PROTECT; ALLOCATING FUNDS THEREFOR IN AN AM KJNT OF $140,754.00 Td COVER THE CONTRACT COST AND $27,822.95 TO COVER THE ESTIMATED EXPENSES INCURRED BY THE CITY, FOR A TOTAL OF $168,576.95; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY DOCUMENTS, IN A FORM ACCEPMABLE TO THE CITY ATTORNEY, WITH THE SUCCESSFUL BIDDER. WHEREAS, the City Manager has made a written finding that the completion of Fire Stations No. 1, No. 4 and No. 5 constituted a valid public emergency which required the .immediate procurarnnt of construction, services and materials to protect the health, safety and welfare of the community and for the convenience of the City; and WHEREAS, the nature of said emergency was based on the ccm unity's need for uninterrupted fire and rescue service in a timely manner; and WHEREAS, the inccnplete construction restricted the ability of the Fire, Rescue and Inspection Services Department to provide safety and protection; WHEREAS, the incamplete construction affected the health, safety and welfare of City employees working within Fire Stations No. 1, No. 4 and No. 5; WHEREAS, bids were received in the Public Works Department on an informal basis fran three (3) bidders for Modifications to Fire Station No. 1 and for completion of unfinished work for Fire Stations No. 4 and No. 5; and WHEREAS, the Director of the Department of Public Works reccmyended and the City Manager accepted the bid received from MET CONSTRUCTION, INC., as the lowest responsible and responsive bid received on an informal basis; and CITY COMMISSI0h MEE- TTIM OF F E B 14 1991 9 REaObUTtOK N0. 1-- 149 1 *MT%so the Capital iit ore it hVropriations Ordinance (ordinance No. 10782), adapted on September 27, 1990, has made monies available for the proposed amount of the Contract, project expense and incidentals under Project No. 313018 of said Ordinance; and WWM, Sections 18-52.5 and 18-52.6 of the City Code make provision for the emergency procurement of required goods and services for public works projects and impronrements; NC t THEREFORE, BE IT RESOLVED BY THE CCWnSSION OF THE CITY OF MI14M I Flaum: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's finding that a valid public emergency exists justifying the waiver of formal campetitive sealed bid procedures for the completion of modifications to City of Miami Fire Stations Nos. 1, 4 and 5, is hereby ratified, approved, and confirmed and by an affirmative vote of 4/5ths of the members of the City cmni.ssion, following a duly advertised public hearing, formal competitive sealed bid procedures for the completion of such modifications are hereby waived and the City Manager's acceptance of the October 31, 1990, bid of MET CaNSICN, INC,, in the proposed amount of $140,754.00, for the project entitled "modifications to Fire Stations No. 1, No. 4 and No. 5", based on lump stun and unit prices, is hereby accepted at the price stated therein is hereby, ratified, approved and confirmed. Section 3. The total amount of $168,576.95 is hereby allocated from Capital Improvement Appropriations Ordinance No. 10782, Project No. 313018, to cover $140,754.00 for the cost of said contract and $27,822.95 to cover the estimated expenses incurred by the City. Section 4. By an affirmative vote of 4/5ths of the members of the City Ccanission, the City Manager's action in executing a contractl/ on behalf of the City of Miami with MET CON;SZRLICTICN, IC., for Modifications to Fire Stations No. 1, No. 4 and No. 5 is hereby ratified, approved and confirred. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code Provisions. Project No. 313018, in the amount of $140,754.00 to cover the contract cost; and $27,822.95 to cover the estimated expenses incurred by the City; and further ratifying, approving and confirming the City Manager's action of executing a contract with said firm. BACKGROUND The Department of Public WorKs and the Fire Department have -determined that- an emergency exists due to the original Contractor's failure to complete the _ construction Modifications for Fire Stations No. 4 and No. 5. In addition to Intrepid Three Company failing to finish the contract worK on Fire Stations No. 4 and No. 5 they were awarded the contract for Modifications to Fire Station No. 1 wh,i,ch `was rescinded by Commission Action in October, 1990. The unfinished construction at Fire Stations No. 4 and No. 5 has left Fire Department personnel without adequate living quarters and impaired the Fire Department's service to the public from these stations. The Department of Public WorKs obtained bids from three General Contractors for the completion of work on Fire Stations No. 4 and No. 5 and the contract work for Fire Station No. 1. D d l o ENCLOSURES: City Manager Based on information supplied to me by the Director of the Department of Public Works and the Director of the Department of Fire Rescue and Inspection Services, I have found that there exists an emergency need to accept the low bid. obtained on . an informal 'basis to complete the construction of .Fire Stations No. 4 and No. 5 and perform the contract worK on Fire Station No. 1. The reason for the emergency need is as follows:" The original contractor has failed to complete the work started on Fire Stations No. 4 and No. S. -The original contractor has failed to start the worK on Fire Station No. 1. The original contract was for 60 working days. The original contractor has exceeded four months without compieting the required improvements. The incompleteness of the worK has greatly impaired the Fire Department's operations and services to the public. D ector of Public Works ENc►osuREs Intrepid Three Company, a ,minority contractor, has failed to — complete the 'construction on Public Works Contract B-2974-As The work basically consists of making modifications to Fire Stations No. 4 and 5. The contractor finished approximately sixty (60) percent of the work before abandoning the job. Because of the incompleteness of the work, Fire personnel have been displaced and the Fire Department's operations and services interrupted. Public Works tried to work with .the contractor to provide ample time and adjustments to the work sequencing to enable them to finishe We were not successful. In addition to Fire Stations Nos. 4 and 5, Intrepid was awarded Modifications to Fire Station No. 1. This work was never started and the contract has since been rescinded by Commission Action in October, 1990. Public Works has obtained bids from three General Contractors for the completion of the work on Stations Nos. 4 and 5 along with the Modification to station No. 1. The bidders.are: D.L. Kirby, Inc. (Black Firm), Pino-Fonticiella and Associates (Hispanic Firm), and MET Construction, Inc. (Anglo Firm). MET Construction was the lowest bidder: $75,000 guaranteed maximum amount on a time and materials basis, to complete Fire Stations 4 and 5, and $65,754.00 for the Modification to Fire Station No. 1. Based on the fact that Fire Stations Nos. 4 and 5 have been under construction with Fire personnel living quarters incomplete and _ further that the Commission is desirous of adding an additional Rescue Unit at Fire station 4 we request your approval to award a contract to MET Construction for the above scope of work and amount.
