A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
OF THE MEMBERS OF THE CITY COMMISSION WAIVING
FORMAL COMPETITIVE BID AND SELECTION
PROCEDURES FOR THE ACQUISITION OF SUCH
SERVICES, EQUIPMENT, GOODS AND/OR MATERIALS
AS MAY BE REQUIRED FOR THE DEVELOPMENT OF THE
CITY OF MIAMI YOUTH CENTER PROJECT LOCATED AT
CURTIS PARK; RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDING THAT A
VALID PUBLIC EMERGENCY EXISTS JUSTIFYING SUCH
WAIVER FOR SAID PROJECT; AUTHORIZING THE CITY
MANAGER TO UTILIZE CITY FORCES IN THE
CONSTRUCTION OF SAID PROJECT; AUTHORIZING THE
CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE
AND RESPONSIBLE BIDS) FOR NECESSARY
IMPROVEMENTS, SERVICES, EQUIPMENT, GOODS
AN/OR MATERIALS FOR SAID PROJECT; AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY
AGREEMENT(S), IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, FOR PROFESSIONAL DESIGN
SERVICES IF REQUIRED FOR SAID PROJECT;
ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO
EXCEED $3,100,000 FROM THE CAPITAL
IMPROVEMENT PROJECT OF THE SAME NAME, PROJECT
NO. 331353; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE SUCCESSFUL BIDDER(S).
WHEREAS, the 1991 Capital Improvement Ordinance No. 10782,
adopted September 27, 1990, appropriated $3,100,000 for the
redevelopment and expansion of recreational facilities at Curtis
Park; and
WHEREAS, the community in the area of said park has
demonstrated a critical need for positive leisure activities and
recreational opportunities; and
WHEREAS, the City Manager has made a written finding that
the redevelopment of Curtis Park constitutes a valid public
emergency which requires the immediate procurement of the
required services, material, goods and/or equipment .to protect

the health,,. -,safety and welfare of residents and' , fora; , the
convenience of the City; and
WHEREAS, the nature of said valid public emergency is based
on the community's need for.adequate recreational facil ties_'In
this,depressed area.of the.City; and

MRIAS, the preliminary master Plan has been developed for
this project with input from the community, whose additional
ceandations Will be sought through public meetings in the
bark; and
. WHBPSAS+ the preliminary Master Plan includes a new

community Center building, a new track and football field
facility, playing court renovations, parking areas, walkways,
irrigation, landscaping and site lighting; and
WHEREAS, the City Code provides for the emergency
procurement of required goods and services in connection with

public works projects and improvements, including professional
design services; and
WHEREAS, the City Manager recommends that City forces be
utilized to participate in the construction of said project, and
that informal bid procedures be utilized, if required, to procure
needed services, equipment, goods and/or materials for

WHEREAS, after receipt of informal bids, contracts .for said

services, equipment, goods and/or materials will be. awarded to
the.--Jowest responsive and- responsible bidder(s) by< the.. City

Section 2. The City Manager's finding that a valid
public emergency exists justifying the waiver of formal
competitive sealed hid and competitive selection procedures for
thedevelopment of the City of Miami Youth Center Project, is
heraby_,ratiiied, approved and confirmed. s=
Section 3. By an affirmative vote of 4/5ths of the T
jaambers of the City Commission, formal competitive sealed bid },
procedures for the procurement of services, equipment, goods
and/or materials for the construction of improvements for the
City of Miami Youth Center Project are hereby waived./
Section 4. If required, the City Manager is hereby
authorized to utilize City forces to participate in the

construction of said project and to execute the necessaryx
agreament(s)/, in.a form acceptable to the City Attorney, for
professional -design services if required for said Project, and if.
approved by the City Commission with funds for the entire Project-
hereby allocated in an amount not to exceed $3,100,000 from the
City of Miami Youth Center Project, Capital Improvement Project
-No. 331353.

located at Gerry Curtis Park. This site was selected based upon_>

community meetings and the support and recommendations of the
Miami Sports and Exhibition Authority.''

'There is a critical need for a City wide regional facility that
will provide adequate leisure activities and recreational
:opportunities. By, hastening the pace of lengthy procurement and,
other administrative • processes, we belieue we can more ,.
appropriately address these needs. a_
On this basis, the City Manager has made a written finding
(attach-ed) that . the City of Miami Youth Center Project
eohstit'utes`an`emergency situation requiring particular action to
Prot eet.°the health, safety and welfare of residents and the
convenience of the City. It is further recommended that
emergency procurement processes be implemented in accordance with
Sections 18-52.3, 1$-52.5 and 18-52.6 of the City Code.
By adoption' of the attached, the City•Manager would be authorized
to utilite City forces for construction purposes and to also seek -
informal, bids for the needed construction, materials, furnishings
and equipment, and to award contracts and issue purchase orders
— to the lowest responsive and responsible bidder(s). If _
