PROJI=CT THE ACQUISITION OF ENGINEERING
SERVICES FOR OBTAINING A NATIONAL POLLUTANT
DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT
FOR THE CITY OF MIAMI'S STORM SEWER SYSTEM
REQUIRED BY THE UNITED STATES ENVIRONMENTAL
PROTECTION AGENCY; AUTHORIZING THE CITY
MANAGER TO ADVERTISE FOR THE REQUIRED
PROFESSIONAL SERVICES; APPOINTING A
CERTIFICATION COMMITTEE OF NOT LESS THAN
THREE QUALIFIED PROFESSIONALS FROM THE
CITY'S STAFF; AUTHORIZING THE CITY MANAGER
TO APPOINT A FOURTH CERTIFICATION COMMITTEE
MEMBER WHOSE PROFESSIONAL EXPERTISE IS
STORMWATER MANAGEMENT SUBSEQUENT TO RECEIPT
OF THE PROPOSALS AND APPOINTING LUIS A.
PRIETO-PORTAR, DIRECTOR OF PUBLIC WORKS, AS
CHAIRMAN OF THE COMPETITIVE SELECTION
COMMITTEE, ALL IN ACCORDANCE WITH FLORIDA
STATUTES SECTION 287.055, AND CITY OF MIAMI
ORDINANCE NO. 9572, ADOPTED FEBRUARY 10,
1983, WHICH ORDINANCE ESTABLISHED PROCEDURES
FOR CONTRACTING FOR SUCH PROFESSIONAL
SERVICES AND ALSO ESTABLISHED NEGOTIATION
REQUIREMENTS WITH REGARD TO THE FURNISHING
OF SUCH SERVICES; FUNDS FOR SAID SERVICES TO
BE ALLOCATED FROM STORM SEWER GENERAL
OBLIGATION BOND FUNDS IN AN AMOUNT NOT TO
EXCEED FOUR HUNDRED THOUSAND DOLLARS.
WHEREAS, The City of Miami owns and maintains stormwater
management facilities on City streets and other public places;
and
WHEREAS, on October 31, 1990 the United States
Environmental Protection Agency (EPA) approved Its final Rule on
Stormwater Discharges for municipal and Industrial storm sewer
systems; and
WHEREAS, the new EPA Rule requires many municipalities
Including the City of Miami to obtain National Pollutant
Discharge Elimination System (NPDES) permits for storm sewer
systems; and
WHEREAS, the three major objectives of the NPDES permit
program are to reduce stormwater pollutant discharges, to
eliminate non-stormwater discharges to the municipal storm sewer

system, and to apply best available technology and best
management practices to control stormwater pollution; and

WHEREAS, the NpbES permit program w I I I aIso require the
development and Implemehtatlon of a mahagement program for the
control of stormwater pollution to the maximum extent
practicable; and
WHEREAS, the EPA Rule established a compliance schedule and
a two-part application process requiring municipalities to
complete the Part 1 application by November 1991 and the Part 2
application by November 1992; and
WHEREAS, It Is In the best Interest of the City to engage a
professional engineering firm with sufficient expertise to meet
the aforesaid EPA requirements and deadlines for obtaining the
NPDES permit for the City's storm sewer system; and
WHEREAS, the City Manager recommends that the acquisition
of the aforesaid professional engineering services in response
to EPA requirements be designated a Category "B" Project in
accordance with the provisions of Ordinance No. 9572, adopted
February_ 10, 1983, which now appears. In codified form as City
Code Section-18-52.3; and
WHEREAS, City Code Section 18-52.3 also requires thei
establishment of a Certification Committee of not less than

three professionals qualified In the field of endeavor or
j practice involved In the project, to revl.ew the qualifications;

responding to the City's Request for Professional Services; and
WHEREAS, In order to enhance the expertise of the
Certification Committee It Is desirable to appoint an
approprlatel,y.qualIfIed professional as the fourth:CertIfIcat Ion
Committee Member, subsequent to the receipt of the Proposals, to

WHEREAS, funds for the aforesaid professional services are
available from Storm Sewer general Obligation Bond Funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA.
Section 1. The recitals and findings contained In the
Preamble to this Resolution are hereby adopted by reference
thereto and Incorporated herein as If fully set forth In this
Section.
Section 2. The acquisition of engineering services, for
obtaining a National Pollutant Discharge Elimination System
(NPDES) Permit for the City's storm sewer system required by the
United States Environmental Protection Agency Is hereby
designated a Category "B" Project In accordance with the
provisions of the City of Miami Code Section 18-52.3, which
established procedures for contracting for certain professional
services and also established competitive negotiation
requirements with regard to the furnishing of such services.
Section 3 The City Manager Is hereby authorized to
advertise for the aforementioned professional services, and to
Issue a Request for Proposals for Professional Services document
to
related the procurement of such services, in accordance with

the Cite- Code with funds for said services to be allocated

Storm Sewer General Obligation Bond Funds In an amount not to
exceed four hundred thousand dollars.
Section 4. A Certification Committee Is hereby appointed
consisting of the following City staff: Daniel Brenner,

Engineer, James Kay, Engineer, and Clark Turner, Planner.

Section 5. The City Manager is hereby authorized
subsequent to receipt of the responses to the City's Request for
Proposals for Professional Services document, to appoint a.

expertise is related to stormwater management with no vested

of the firms or Individuals being considered during thb

It Is respectfully recommended that the City Commission adopt the
attached Resolution to Initiate the process for acquiring
engineering services for obtaining the National Pollutant Discharge
Elimination System (NPDES) permit for the City's storm sewer system.
BACKGROUND:
The Department'of Public Works, In a continuing effort to serve all
residents of the City of Miami, is recommending the adoption of the
attached Resolution Initiating the process for acquiring
professional engineering services In response to recent Federal EPA
legislation.
On October 31, 1990, the United States Environmental Protection
Agency (EPA) approved Its final Rule on Stormwater Discharges for
municipal and industrial storm sewer systems. The Rule requires
large municipalities Including the City of Miami to obtain National
Pollutant Discharge Elimination System (NPDES) permits for storm
sewer systems.
The three maJor obJectives of the NPDES permit program are to reduce
stormwater pollutant discharges, to eliminate non-stormwater
discharges to the municipal storm sewer system, and to apply best
available technology and best management practices to control
stormwater pollution. The EPA Rule established a two-part
application process and a compliance schedule. The Part 1
application deadline Is November, 1991 with Part 2 due one year
rater.

The NPDES permitting process will InVolve extensive' water quality
data collection and monitoring and extenslve laboratory analysis to
Identify poilutants In the City's entire storm sewer system. It Is
In the best Interest of the City to engage a professional
engineering fJrm with sufficient expertise to meet the SPA
requirements and deadlines for obtaining the NPDES permit for the
City's storm sewer system.
The attached resolution designates as a Category "B" project the
acquisition of the required engineering services, authorizes the
City Manager to advertise for said services, appoints a
Certification Committee and.a Selection Committee Chairman, all in
accordance with Florida Statutory and City Code requirements.. Funds
r for the entire NPDES Project Including the cost of the engineering
consultant are to be allocated from Storm Sewer General Obligation
Bond Funds In an amount not to exceed $400,000.
