RESOLUTION NO. 91 _ 107
A RESOLUTION, WITH ATTACHMENT, AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH THE
DISTRICT BOARD OF TRUSTEES OF MIAMI-DADS
COMMUNITY COLLEGE (MEDICAL CENTER CAMPUS),
FOR THE PROVISION OF EMT AND PARAMEDIC
CLINICAL EXPERIENCE FOR EMPLOYEES OF THE CITY
OF MIAMI FIRE, RESCUE AND INSPECTION SERVICES
DEPARTMENT, FROM THE DATE OF EXECUTION OF THE
AGREEMENT THROUGH AUGUST 15, 1991, AND FOR
SUCCESSIVE YEARS THEREAFTER, UNLESS OTHERWISE
DIRECTED BY THE CITY COMMISSION.
WHEREAS, the City and Miami -Dade Community College desire
that the public interest be served by ensuring a continuing source
of competent health care professionals; and
WHEREAS, Miami -Dade Community College desires that employees
of the Department of Fire, Rescue and Inspections Services be

enrolled in programs related to Emergency Medical Services and
Respiratory Therapy Technology, and that this EMT and Paramedic
clinical experience be obtained at Miami -Dade Community College;
and
WHEREAS, Miami -Dade Community College is offering to provide
the necessary facilities for said clinical experience in
recognition of the need to train allied health personnel;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:;'
Section 1. The City Manager is hereby authorized to execute

an Agreement, in substantially the attached form, with the Board
of Trustees of Miami -Dade Community College (Medical Center

Campus), for the provision of EMT and Paramedic Clinical
experience for employees of the City of Miami Fire, Rescue and
Inspection Services Department, from the date of execution of the
agreement through August 15, 1991, and from year to year
thereafter, unless otherwise directed by the City Commission.

THIS AGREEMENT entered into this day of
19 by and between the DISTRICT 90ARD OF TRUSTEES OF MIAMI-DADE COMMUNITY'
COLLEGE, hereinafter referred to as the COLLEGE, and
hereinafter referred to as the AGENCY.
WHEREAS the AGENCY and the COLLEGE desire that the public interest be served

The cost of meals at same is to be paid by faculty members and
students.

Access to AGENCY library facilities, if available, as consistent
with needs of the AGENCY staff members.

Emergency Out -Patient treatment) in case of accident or illness,
to students while in the AGENCY for clinical experience and
without cost to the student, providing the AGENCY has emergency
out -patient facilities. The AGENCY is not responsible for charges
made by a private physician for services rendered to the student -
in said AGENCY.
2. PROVISIONS
FOR INSTRUCTION AND SUPERVISION OF STUDENTS
a.
The COLLEGE shall acquaint the students with the rules and
regulations of the AGENCY and shall hold said students responsi-
ble for complying with all rules and regulations applicable. This
does not preclude the AGENCY from providing further orientation.
The AGENCY will provide a current set of rules and regulations for
the COLLEGE at least sixty (60) days prior to the beginning of
each fall term.
b.
The AGENCY reserves the right to refuse its facilities and

services to any student or faculty member who does not meet the
professional or other requirements or the AGENCY or any
appropriate authority controlling and directing said AGENCY.
C.
The AGENCY agrees to provide facilities and clinical experience to
students as long as operationally feasible. If operational'
considerations limit the number of students which can receive the

clinica.1 experience, the AGENCY shall providing
the clinical experience to its own employees:
d. The AGENCY complies with Title VI of the Civil Rights Act of 1964,
Title IX of the Education Amendments of 1972 and Section 504 of
the Rehabilitation Act of 1973, and related regulations, and
assures that it does not and will not discriminate against any
employee or applicant for employment or registration in the course
of study because of race, color, creed, sex, national origin, or
handicap.
S. The instructional schedule for the clinical experience of the
students shall be planned jointly by the supervisor of the
particular program of the COLLEGE and the designated representa-
tive(s) of the AGENCY. . The instructional schedule as mutually
agreed upon by both parties to this AGREEMENT shall, whenever
possible, be submitted to the respective AGENCY and COLLEGE
authorities at least sixty (60) days prior to the beginning of
such schedule.

to the respective course description and/or syllabus, coop -
orating therein with the faculty member assigned by the
COLLEGE to supervise said course;
(2) periodic evaluation of the progress of the students as
required by the COLLEGE;
(3) providing to the above mentioned program supervisor, on an
appropriately periodic basis, the proposed schedule for
clinical instruction for the ensuing instructional period;
and
(4) being available for scheduled and unscheduled conferences at
reasonable times with the students and/or faculty supervisor.
h. The COLLEGE program supervisor will make regular visits to the
AGENCY in order to coordinate the progress of the course of
instruction and to determine its effectiveness.
i. ,The COLLEGE on its part agrees further:
(1) to go through the proper channels at the AGENCY in planning
clinical experience;
(2) to arrange meetings with the appropriate clinical staff of
the AGENCY to whom the students are directly responsible in
order to review and evaluate the progress of the clinical
instruction as needed;
(3) to provide methods for student evaluation and to be respon-
sible for the final grades of the students;

(4) to inform the clinical instruction staff of the AGENCY as to ;
the extent of the academic preparation of the students, for
the purpose of assignment of the students to the appropriate
entry level of clinical experience; and

3. tNii MNMCATION ANn_._INSURANC .
a. The COLLEGE agrees to indemnify and hold harmless the AGENCY from
any and all claims, liabilities and causes of action arising out
of negligence, error, omission, or intentional acts of assigned
students, agents, officers, servants, or employees of the COLLEGE,
The COLLEGE shall pay all claims and losses of any nature
whatsoever in connection therewith and shall defend all suits, in
the name of the AGENCY when applicable, and shall pay all costs
and judgments which may issue thereon; it being understood,
however, that the COLLEGE does not indemnify the AGENCY for its
own negligence, errors or omissions, or those of its agents,
officers, servants or employees.
b. The COLLEGE agrees to maintain, during the term of this AGREE-
MENT, professional liability insurance with a single limit of
,liability of no less than one million dollars ($1,000,000). A
certificate of insurance or other acceptable documentation in
evidence of compliance with this paragraph shall be filed with the

RECOMMENDATIONs
It is respectfully recommended that a Resolution be passed '
accepting the contract with Miami Dade Community College Medical
Center Campus and the City of Miami, Fire Rescue and Inspection
Services Department.
BACKGROUND:
The City of Miami Fire Rescue and Inspection Services Rescue
Division has maintained a contract with Miami Dade Community
College Medical Center Campus which provides the clinical
experience for EMT and Paramedic students, since July 20, 1981.
Miami Dade Community College Medical Center Campus is -the primary
source of EMT's and Paramedics for the Department and clinical
experience is a necessary component of the class curriculum. The
maintenance of this contract is necessary to maintain an adequate
number of EMT's and Paramedics in the Department and in turn
comply with State regulations.
The new contract is essentially the same as the -contract that has
been in place since 1981, with the following exceptions:
1. Item 2-C provides the Department a degree of operational
control by giving preference to the City's employee's'when
providing clinical experience.
2. The Agreement for Services provides compensation to the City
when City employees engage in a Preceptor Program for
Paramedics.
