A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS
OF THE MEMBERS OF THE CITY COMMISSION WAIVING
FORMAL COMPETITIVE BID AND SELECTION
PROCEDURES FOR THE ACQUISITION OF SUCH
SERVICES, EQUIPMENT, GOODS AND/OR MATERIALS
AS MAY BE REQUIRED FOR THE REDEVELOPMENT
PORTION OF THE ROBERTO CLEMENTE PARK
REHABILITATION PROJECT; RATIFYING, APPROVING
AND CONFIRMING THE CITY MANAGER'S FINDING
THAT A VALID PUBLIC EMERGENCY EXISTS
JUSTIFYING SUCH WAIVER FOR SAID PROJECT;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
LOWEST RESPONSIVE AND RESPONSIBLE BIDS) FOR
NECESSARY IMPROVEMENTS, SERVICES, EQUIPMENT,
GOODS AND/OR MATERIALS FOR SAID PROJECT;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY AGREEMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR PROFESSIONAL DESIGN
SERVICES IF REQUIRED FOR SAID PROJECT;
ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO
EXCEED $1,100,000 FROM THE CAPITAL
IMPROVEMENT PROJECT OF THE SAME NAME, PROJECT
NO. 331056; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE AND/OR ISSUE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE SUCCESSFUL BIDDER(S).
WHEREAS, the 1991 Capital Improvement Ordinance No 10782,
adopted September 27, 1990, appropriated $1,900,000 for the
acquisition of land and for the redevelopment and expansion of
recreational facilities at Roberto Clemente Park; and
WHEREAS, the land acquisition portion of this Capital
Improvement Project No. 331056, entitled "Roberto Clemente Park
Rehabilitation", is nearly complete with the exception of one
property; and
WHEREAS, the community in the area of said park has
demonstrated a critical need for positive leisure activities and
recreational opportunities; and
WHEREAS, the City Manager has made a written finding that
the redevelopment of Roberto Clemente Park constitutes a valid
public emergency which requires the immediate procurement of the
required services, material, goods and/or equipment to protect
the health, safety and welfare of residents and for the
convenience of the City; and

WHEREAS, the nature of said valid public emergency is based
on the community's need for adequate recreational facilities in
this depressed area of the City; and
WHEREAS, a preliminary Master Plan has been developed for
this Project with input from the community, whose additional
recommendations will be sought through public meetings in the
Park; and
WHEREAS, the preliminary Master Plan includes expansion of
the existing recreation building, the relocation and enlargement
of the softball field, a new combination soccer -football field, a
new playground, playing court renovations, a new picnic area with
shelters, walkways, irrigation, landscaping and site lighting;
and
WHEREAS, the City Code provides for the emergency
procurement of required goods and services in connection with
public works and improvements, including professional design
services; and
WHEREAS, the City Manager recommends that City forces be
utilized to participate in the construction of said project, and
that informal bid procedures be utilized, if required, to procure
needed services, equipment, goods and/or materials for
construction of said project; and
WHEREAS, after receipt of informal bids, contracts for said
services, equipment, goods and/or materials will be awarded to
the lowest responsive and responsible bidder(s) by the City
Manager; and
WHEREAS, if sufficient City forces are unavailable to
complete the design of the project in a timely manner, the City
Manager proposes to hire the services of professional design
consultants within the fields of architecture, engineering and
landscape architecture as may be required, according to the
emergency procedures prescribed in Sections 18-52.3 and 18-52.6
of the City Code; and
WHEREAS, the herein Resolution has been the subject of a
properly advertised public hearing before the City Commission;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby incorporated by reference
thereto and adopted as if fully set forth in this Section.
Section 2. The City Manager's finding that a valid public
emergency exists justifying the waiver of formal competitive
sealed bid and competitive selection procedures for the
redevelopment portion of the Roberto Clemente Park Rehabilitation
Project is hereby ratified, approved and confirmed.
Section 3. By an affirmative vote of 4/5ths of the members
of the City Commission, formal competitive sealed bid procedures
for the procurement of services, equipment, goods and/or
materials for the construction of improvements for the Roberto
Clemente Park Rehabilitation Project are hereby waived.
Section 4. If required, the City Manager is hereby
authorized to utilize City forces to participate in the
construction of said project and to accept the lowest responsive
and responsible bid(s) for necessary services, equipment, goods
and/or materials for said Project, and to execute the necessary
agreement(s)l/, in a form acceptable to the City Attorney, for
professional design services if required for said Project, with
funds therefor hereby allocated in an amount not to exceed
$1,100,000 from the Roberto Clemente Park Rehabilitation Project,
Capital Improvement Project No. 331056.
Section 5. The City Manager is hereby authorized to
execute and/or issue the necessary documents, in a form
acceptable to the City Attorney, with the successful bidder(s)
for said items for said Project.
Section 6. This Resolution shall become effective
immediately upon its adoption.
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution which waives formal competitive sealed bid
and competitive selection procedures for the redevelopment
portion of the "Roberto Clemente Park Rehabilitation Project"
based on the City Manager's written finding that a valid public
emergency exists justifying such waiver. The resolution also
authorizes the City Manager to accept the lowest responsive and
responsible bids utilizing informal bid processes for the
necessary goods and services (construction, materials,
furnishings and equipment), to hire design professionals if
necessary, and allocates funds in the amount of $1,100,000 from
the Capital Improvement Project (No. 331056) of the same name.
BACKGROUND:
The Department of Parks and Recreation has prepared the attached
legislation. In January of 1988, the City Commission
appropriated funds for the redevelopment and expansion of
Clemente Park in the Wynwood area, based on a series of community
_ meetings and recommendations from the City's Park Advisory Board.
The project called for the acquisition of land, initially twelve
lots, to the north of the Park, and for the construction and
renovation of comprehensive recreational facilities.
The land acquisition portion of the Project is now complete with
the exception of one property. The property owner refuses to
sell at fair market value. A preliminary Master Plan has been
developed for the expanded site. This plan, based on earlier
community input, includes expansion of the existing recreation
building, the relocation and enlargement of the baseball field, a
new combination soccer -football field, a new playground, playing
court renovations, a new picnic area with shelters, walkways,
irrigation, landscaping and site lighting.

The recent experience of the community in this area of the City
demonstrates o critical need for adequate leisure activities and
recreational 'opportun.itiew. By hastening the pace of lengthy
procurement and other administrative processes, we feel we can
more appropriately address these needs.
On this basis, the City Manager has made a written finding
(attached) that the Roberto Clemente Park Rehabilitation Project
constitutes an emergency situation requiring particular action to
protect the health, safety and welfare of residents and the
convenience of the City. it is further recommended that
emergency procurement, processes be implemented in accordance with
Sections 18-52.31 18-52.5 and 18-52.6 of the City Code.
By adoption of the attached, the City Manager would be authorized
to seek informal bids for the needed constructions materials,
furnishings qnd equipment, and to award contracts and issue
purchase orders to the lowest responsive and responsible

This memorandum serves as the written finding of a valid public
emergency for the redevelopment portion of the Roberto Clemente
Park Rehabilitation Project. This finding is based upon the
following:
* Roberto Clemente Park, located in an economically depressed
area of the Wynwood Community Target area, is. a valuable
recreational resource of the City for the benefit of its
citizens and visitors, but requires substantial renovation
and expanded facilities to meet the recreational needs of the
surrounding community.
* The City has allocated a total of $1,900,000 for the
rehabilitation of this Park within its Capital Improvement
Program, and the improvement project consists of land
acquisition and redevelopment.
* The time-consuming land acquisition portion of the project is
now completed and a preliminary Master Plan has been prepared
for the renovation and expansion of recreational facilities.
* The recent experience of the community in this area of the
City demonstrates a critical and immediate need for adequate
leisure activities and recreational opportunities.
* By hastening the pace of lengthy procurement and other
administrative processes, these needs can more appropriately
be addressed.
* Adherence to normal procurement procedures for this project
would impose a significant hardship on the City and area
residents, deleterious to the health, safety and welfare of
its citizens and to the convenience of municipal affairs.

Such conditions indicate the need for extraordinary measures to
protect the health, safety and welfare of the community and the
convenience of the City. In order to initiate and complete
improvements in a timely manner, formal competitive sealed bid
procedures shall be waived for the procurement of goods and
services required for this project, pursuant to Sections 18-52.5
and .6 of the City Code. Informal bids shall be obtained for
construction services, materials, furnishings, and/or equipment
and shall be awarded by the City Manager to the lowest responsive
and responsible bidder.
