HomeMy WebLinkAboutR-91-0004J-91-53 1/3/91 RESOLUTION N0. 9 1 _- 04 A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE AGREEMENT DATED SEPTEMBER 15, 1989, IN SUBSTANTIALLY THE ATTACHED FORM, WITH ANDRES DUANY AND ELIZABETH PLATER-ZYBERK, ARCHITECTS, INC., A CORPORATION, BY INCREASING THE CONTRACT IN AN AMOUNT NOT TO EXCEED $30,000 FOR COMPLETION OF THE DESIGN DEVELOPMENT AND CONSTRUCTION DOCUMENT PHASES IN CONNECTION WITH THE DEVELOPMENT OF A THIRTY (30) UNIT SINGLE FAMILY RESIDENTIAL SALES HOUSING DEVELOPMENT FOR MODERATE INCOME FAMILIES ON THE CITY -OWNED ST. HUGH OAKS ACADEMY PROPERTY LOCATED IN THE COCONUT GROVE NEIGHBORHOOD; FURTHER AUTHORIZING AND ALLOCATING COMPENSATION IN THE AFOREMENTIONED AMOUNT FROM CAPITAL IMPROVEMENT PROJECT NO. 321034, "SCATTERED SITE AFFORDABLE HOUSING DEVELOPMENT PROGRAM", TO FUND THE COST OF PROVIDING SAID SERVICES TO THE CITY. WHEREAS, there exists in the City of Miami, a severe shortage of housing within the affordability range of families and individuals of low and moderate income; and WHEREAS, on November 3, 1988, through Resolution No. 88-1042, the City Commission approved the development of a thirty (30) unit single family residential sales housing development on the City -owned St. Hugh Oaks property for moderate income families; and WHEREAS, the City Commission, by Resolution No. 89-165, on February 9, 1989, approved the selection of Andres Duany & Elizabeth Plater-Zyberk, Architects, Inc. as the most qualified firm to provide, along with the designated sub -consultants, professional architectural, landscape architectural engineering services, professional planning and design services to the City for the above mentioned housing development and authorized the City Manager to negotiate an Agreement with the said firm; and WHEREAS, the City Manager executed an Agreement with Andres Duany & Elizabeth Plater-Zyberk, Architects, Inc., on September 15, 1989, for the provision of architectural and engineering services in connection with the proposed St. Hugh Oaks Affordable Housing Project; and WHEREAS, in order to move the design of the proposed project forward, it is necessary that the City increase the contract amount with the architectural firm for additional cost incurred due to changes in the scope of services requested by the City under the existing Agreement, dated September 15, 1989; and WHEREAS, the cost of providing the additional services under the aforementioned Agreement for the project is estimated not to exceed $30,000 in order to complete the design development and construction document phases for the St. Hugh Oaks Affordable Housing Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to execute an amendment to the Agreement"I dated September 15, 1989, in substantially the attached form, with Andres Duany and Elizabeth Plater-Zyberk Architects, Inc., a corporation, in an amount not to exceed $30,000 to defray the cost of providing additional services to the City in connection with the proposed St. Hugh Oaks Affordable Housing Project. Section 3. Funds in the amount of $30,000 are hereby allocated from Capital Improvement Project No. 321034, "Scattered Site Affordable Housing Development Program", to increase the contract amount with the said architectural firm. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 91- 04 -2- Section 4. RECITAL WIREREAS, there exists in the City of Miami, a severe shortage of housing within the affordability range of families and individuals of low and moderate income; and WER"AB, in an effort to expand the availability and affordability of housing for moderate income families and individuale in the CITY OF MIAMI, in September of 19861 the City ' ofMiamiCommission authorized the acquisition of a three (3) acre parcel of land located in the Coconut Grove neighborhood ,known as the St. Hugh Oaks Academy property; and WHEREAS# in October of 1986, the City of Miami Commission, through Resolution No. 86-840, approved the implementation of a City -sponsored Scattered Site Affordable Homeownership bevelopment Program for the purpose of facilitating the ' production of sales housing in the City within the 'affordability range of qualified low and moderate income purchasers; and WHEREAS, in October of 1986, the City of Miami Commission, through ordinance No. 10165, also authorized the issuance of special Obligation Bonds in the amount of $4,290,000 for the purpose of providing financing for the construction of owner - occupied residential dwelling units within the affordability range of qualified low and moderate income purchasers; and WHEREAS# the City of Miami serving as developer, intends to develop a thirty (30) unit single family residential sales housing development on the City -owned St. Hugh Oaks Academy propertyl and -TAN.— 2-91 WED 17 AGENDA OFFIG, P . 09 - WHEREAS, by Resolution No. 88-1042, passed and adopted on November 3, 1989, the City Commission approved the designation as a Category "8" Project, the planning and design of a thirty (30) lullik single family residential sales housing development for moderate income families on the City -owned St. Hugh Oaks Academy property, appointed at the time Jerry Gereaux, Director, Housing Conservation and Development Aapnnv. aia Ohnirman of rho Competitive selection Committee and established a Certification Committee of not less than three professionals, qualified in the field of endeavor or practices involved, to review the qualifications, performance data and related information provided by those responding to the City's Request for Proposal Services In accordance with Ordinance No. 8965; and NEEREAs, the City, through public advertisement and direct mailing, solicited expressions of interest from qualified consultantsr and WHEREAS, the Competitive Selection Committee, along with the Certification Committee, evaluated the qualifications of those firms who responded to the City's Request for Proposals, and selected the firms most qualified to provide professional architectural, landscape architectural, and engineering services for this project, all in accordance with the Competitive Negotiations Act as defined in Florida Statutes, Chapter 287 and i.n City of Miami Code, Chapter 18-52.2 for the acquisition of professional and technical services required: and WHRREAS, the City Commission, by Resolution No. 89-165, dated February 9, 1989, approved the selection of Andres Duany and Elizabeth Plater-2yberk Architects, Inc. as the most qualified firm to provide, along with the designated sub - consultants, professional architectural, landscape architectural and engineering services for the development of a thirty (30) unit single family residential sales housing development for moderate income families on the City -owned tat. Design Development _ phase, subsection 3, delete and amend to read an follows: 3) Based on its findings and expertise, the CONSULTANT shall prepare a site plan. The site plan will show the most advantageous geographical configuration, in order to maximize the use of the existing property, in obtaining single family lots of no less than three thousand (3,000) square feet approximately thirty (30) single family homes. I The CONSULTANT will also provide the CITY with a Cost Estimate for the development of the configuration listed above and approved by the PROJECT MANAGER. In Subsection Stage I, Subsection a, Design Development Phase, Subsection 4 delete and amend to read as follows: 4) The CONSULTANT, based on the input provided by the CITY and the Neighborhood Organizations, shall prepare documents consisting of drawings including plans, sections and elevations for the design of two models of single family homes of more than one thousand five hundred (1,500) square feet, preferably two (2) stories with 3-bedroom and a minimum of 2-baths. The master bedrooms on these homes must have their own bathrooms, the structure must be C.S.S. and all floor slabs must be of reinforced concrete. ire b The CONSULTANT should in the design of the units employ all cost containment techniques available in order to maintain the construction within the City's .project budget for the development of the project. ENCLOSURES: City Commission Agenda Item - January 10, 1991 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing the City Manager to amend the Professional Service Agreement between the City of Miami and Andres Duany and Elizabeth Plater-Zyberk, Architects, Inc., dated September 15, 1989, in connection with the provision of professional planning and design services to the City for the development of a thirty (30) unit single family residential housing project on the City -owned St. Hugh Oaks parcel in the Coconut Grove neighborhood. The attached resolution further allocates funds not to exceed $30,000 from Capital Improvement Program Project No. 321034, "Scattered Site Affordable Housing Development Program," to increase the compensation of providing additional services to the City in connection with the aforementioned housing project. BACKGROUND: The Department of Development and Housing Conservation recommends ratification of the attached resolution, authorizing the City Manager to amend the Professional Service Agreement between the City and Andres Duany and Elizabeth Plater-Zyberk, Architects, Inc., dated September 15,' 1989, in connection with the provision of professional planning and design services to the City for the development of a thirty (30) unit moderate income housing project on the City -owned St. Hugh Oaks property. The attached resolution further allocates funds not to exceed $30,000 from Capital Improvement Program Project No. 321034, "Scattered Site Affordable Housing Development Program," to increase the compensation for providing additional services to the City in connection with the aforementioned housing project. At the November 3, 1988 City Commission meeting, through -Resolution No. 88-1042, the City Commission designated as a Category "B" Project, the planning and design of a thirty (30) unit single family detached residential sales housing development for moderate income families on the three (3) acre City -owned St. Hugh Oaks property. 91-- 04 . E E Resolution to Amend Professional Service Agreement Andres Duany & Elizabeth Plater-Zyberk, Architects Page - 2 - The said resolution further directed the Administration to proceed in the preparation of a Request for Proposals for the purpose of retaining professional architectural, land architectural and engineering services for the development of the aforementioned moderate income housing project. On February 9, 1989, through Resolution No. 89-165, the City Commission authorized the City Manager to undertake negotiations with the top three (3) ranked architectural firms selected by the Competitive Selection Committee and to return wi.th a negotiated Agreement for City Commission ratification' and approval. Subsequently, in July of 1989, through Resolution No. 89-617, the City Commission authorized the City Manager to execute the negotiated Agreement between the City and Andres Duany and Elizabeth Plater-Zyberk, Architects, Inc., and established compensation for said services in the amount of $95,000. The City's original housing proposal for development of the St. Hugh Oaks parcel called for the construction of thirty (30) new single family homes, to be constructed on lots consisting of approximately 3,000 square feet. Over the past year, the planning, design and construction document phases of the proposed project has been virtually at a standstill due to the inability of the Department of Development and Housing Conservation to effectuate the replat of the 3 acre parcel into thirty (30) buildable lots consisting of less than 5,000 square feet. At the February 7, 1990 City Commission meeting, a status report on the proposed housing project was presented to the City Commission, along with the possible options to develop the site. As a result, the City Administration was instructed to work in conjunction with the architect and the Coconut Grove residents in finding 'a solution which would ensure the development of the proposed thirty (30) homes. After several meetings with the residents of the Coconut Grove neighborhood, a consensus was reached to develop the project as a condominium, however, each unit would be individually located and free standing. This modification in the housing proposal planned for developing the St. Hugh Oaks parcel has also resulted in a corresponding change in the scope of services to be provided to the. City by the architectural firm of Andres Duany and Elizabeth Plater-Zyberk, Architects, Inc., as per the Professional Service Agreement between the City and the said firm, dated September 15, 1989; 91- 04 Resolution to Amend Professional Service Agreement Andres Duany & Elizabeth Plater-Zyberk, Architects Page - 3 - In order to move the design development and construction document phases of this housing project forward, it is necessary that the City amend its current contract with the said architectural firm, in addition to increasing the existing contract in an amount not to exceed $30,000 to compensate the aforementioned architectural firms for additional professional services not previously negotiated in the original Agreement. City Commission ratification of the attached resolution is recommended. 91- 04
