Bailey ' REFEAEIJCES Assistant City Ma ENCLUSUf1t:i In response t a cent inquiry from Mr. Najman Eisenman of Cojav Overseas Corp., we have analyzed the history of the referenced property. The following serves as a summary of our findings. The triangular .75 acre parcel located at S.W. 2 Street and S.W. No. River Drive on the Miami River has been occupied by the Garcia Brothers Seafood, Inc. (Garcia Bros.), for docking space and the processing and selling of seafood products since before the City acquired the property in late 1975. Garcia Bros. has been on a month -to -month tenancy with the City since July 1, 1975 at $13,200 annual rent plus tax. The most recent available property tax records indicate that they also paid approximately $2,500 in City property taxes. The property has been appraised twice in the past year, once in December, 1989 at $305,000; and again in February, 1990 by a different appraiser at $475,000. Because certain nearby developments are being initiated, this property may ultimately be very lucrative for the City: In any case, it is my understanding that Mr. Eisenman and Cojav Corp., a used tire collection and recycling operation, are interested in obtaining control of this property to dock ships used for overseas exporting of recyclable tires. Obviously, in order to enter into this type of agreement with Cojav, the City must first evict the Garcia Bros. and initiate a competitive Request for Proposals process. While the decision to replace the Garcia Bros. with Cojav may seem very attractive purely from an economic perspective -- supposing, of course that Cojav could pay the City $50,000 in fair market rent -- we must give careful consideration to what type of contractual relationship would apply to the City's relationship with Cojay. In accordance with certain Charter and Code provisions for disposition of City -owned property, either a lease or a sale must be carried out through a competitive process that requires a minimum of three bids to be submitted offering a fair market value return to the City or, if less, the contract would be subject to a vote by the electorate. Cesar H. odic Garcia Brothers Seafood Rage 2 s j In the meantime, we should determine if the advantage of evicting a long-term tenant is warranted by the hope that the City receives the minimum three bids and that a selected new tenant is willing to pay $50,000 fair market rent. A Request for Proposals issued last year produced no proposal submissions. It. should be. mentioned that this department was recently contacted by the adjacent and major property owner in the area, Peter Swartz, who has again expressed interest in this same property as part of a larger development plan.
