AN 0 INANCE AMENDING THE ZONING ATLAS OF ORDIN CE NO. 11000, AS AMENDED, THE ZONING ORDIN E OF THE CITY OF MIAMI, FLORIDA, BY CHANGIN THE ZONING CLASSIFICATION FROM R-3 MULTIFAM Y MEDIUM -DENSITY RESIDENTIAL TO C-2 LIBERAL MMERCIAL FOR THE PROPERTY LOCATED AT APPROXI TELY 3729-49 NORTHWEST 24 AVENUE, MIAMI, FLO DA, ALSO DESCRIBED A5 LOTS 28, 29 AND 30, BLO 11, GARDEN CITY, AS RECORDED IN PLAT BOOK AT PAGE 73, OF THE PUBLIC RECORDS OF ADE COUNTY, FLORIDA, AND BY MAKING ALL TH NECESSARY CHANGES ON PAGE N0. 19 OF SAID ONING ATLAS; CONTAINING A REPEALER PROVI5 ON AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Z ning Board, at its meeting of November 5, 1990, Item No. 4, following an advertised hearing, adopted Resolution No. ZB 98-9 , by a six to zero (6-0) vote, RECOMMENDING DENIAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, a ter careful consideration of this matter, and notwithstandin the Zoning Board's recommendation of denial, deems it a isable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zon ng classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE CO ISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas contained in Ordinance No. 11000, as amended, the Zoning Ordinance of the ity of Miami, Florida, is hereby amended by changing the zoning c ssification from R-3 multifamily medium -density residentia liberal commercial for the property located at approximatel 3729-49 Northwest 24 Avenue, Miami, Florida, also described as ots 28, 29 and 30, Block 11, GARDEN CITY, as recorded in Plat Boo 5 at Page 73, of the Public Records of Dade County, Florida. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (c) will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) is necessary due to changed or changing conditions; (g) will not adversely influence living conditions in the neighborhood; (h) will not create or excessively increase traffic congestion or otherwise affect public safety; (i) will not create a drainage problem; (j) will not seriously reduce light and air to adjacent area; (k) will not adversely affect property values in the adjacent area; (1) will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; and (m) will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 19 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, is hereby amended to reflect the changes made necessary by these amendments. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. REQUEST Change of Zoning Classification in the Official Zoning Atlas of zoning ordinance 11000, as amended, form R-3 Multi -Family Medium -Density Residential to C-2 Liberal Commercial. RECOMMENDATIONS PLANNING DEPARTMENT DENIAL. The area north of NW 36th Street e�tween NW 22nd Avenue and NW 24th Avenue, is a multifamily district with good accessibility. It is defined by SR-112 and the liberal commercial district fronting on NW 36th Street, which form logical boundaries. The environment of this residential area should be enhanced rather than diminished by commercial intrusion. Any change in zoning classification to commercial will contribute to a reduction of residentially designated areas within the City, impacting the housing stock. (See Chronology attached) PUBLIC WORKS No comment. DADE COUNTY TRAFFIC No comments. AND TRANSPORTATION ZONING BOARD At its meeting of November 7, 1988, the Zoning Board adopted Resolution ZB 141-880 by a 6 to 3 vote, recommending denial of the above to the City Commission. 91 w 85 i Three proponents and two opponents were present at the meeting. Two replies in favor were received by mail. CITY COMMISSION At its meeting of January 26, 1989, the City Commission continued the above to its meeting of March 23, 1989. ----------------------------------------------------------------------- ZONING BOARD At its meeting of November 5, 1990, the Zoning Board adopted Resolution ZB 98-90, by a 6 to 0 vote, recommending denial of the above. One reply AGAINST and two replies in FAVOR were received by mail. CITY COMMISSION At its meeting of December 6, 1990, the City Commission continued action on the above.
