WHEREAS, the Miami lanning Advisory Board, at its meeting
of October 3, 1990, Item o. 1, following an advertised public
hearing, adopted Resolution No. PAB 67-90, by a 6 to 3 vote,
RECOMMENDING APPROVAL of an ndment to the Future Land Use Map
of Ordinance No. 10544, as nded, the Miami Comprehensive
Neighborhood Plan 1989-2000, as he einafter set forth; and
WHEREAS, notwithstanding the r\THE
on of the Planning
Department, the City Commission, al consideration of
this matter, deems it advisable anst interest of the
general welfare of the City of Miamhabitants to grant
this Comprehensive Plan change as het forth;
NOW, THEREFORE, BE IT ORDAINEDISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Future Land Use Map of
No. 10544,
as amended, the Miami Comprehensive Neighborhood an 1989-2000,
is hereby amended by changing the designation, om Medium
Density Multifamily Residential to General Comme cial, for
property located at approximately 3729, 3735 and 3749 orthwest
24th Avenue, Miami, Florida, more particularly described s Lots
28, 29 and 30, Block 11, GARDEN CITY, according to the plat
thereof, as recorded in Plat Book 5 at Page 73 of the Public
Records of Dade County, Florida.

Section 2. It is hereby found that this Comprehensive Plan
designation changes
a. is necessary due to changed or changing
conditions;
b. involves a residential land use of 5 acres or less
and a density of 5 units per acre or less or
involves other land use categories, singularly or
in combination with residential use, of 3 acres or
less and does not, in combination with other
changes during the last year, produce a cumulative
effect of having changed more than 30 acres;
C. is one which involves property that has not been
the specific subject of a Comprehensive Plan
change within the last year; and
d. is one which does not involve the same owner's
property within 200 feet of property that has been
the subject of a Comprehensive Plan change within
the last year.
Section 3. The City Clerk is hereby directed to transmit a
copy of this Ordinance immediately upon approval of first reading
to Bill Sadowski, Secretary, Florida Department of Community
Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100,
for 90 day review and comment.
Section 4. All ordinances or Darts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective forty-five
(45) days after
final

and adoption thereof.

REQUEST To change the land use designation of the
subject property from Moderate Density
Residential to General Commercial.
BACKGROUND The subject property lies to the north of the
N. W. 36th Street Liberal Commercial strip,
and is now designated as multifamily
residential (Moderate Density) use.
It is important to maintain the designation of
the residential district because it provides
for housing in a very accessible area.
Changing the designation would create a
commercial intrusion.
There is a surplus of areas in the City with
the appropriate land use designation for the
activities proposed.
ANALYSIS The proposed change does not further the intent
of the Miami Comprehensive Neighborhood Plan
Sept. 1985, as amended. There is no need or
justification for the proposed change.
RECOMMENDATION
PLANNING DEPARTMENT Denial.
PLANNING ADVISORY BOARD At its meeting of November 2, 1988, the Planning
Advisory Board adopted Resolution PAB 88-881, by a
5 to 3 vote, recommending approval of the above.
Two replies in favor were received by mail.
CITY COMMISSION
Three proponents and two opponents were present

1. INTRODUCTION
On December 6, 1990, in conjunction with the continuation of Items PZ-1
and 2, the Commission requested a study of the area. The Planning and
Zoning Division of the Planning, Building and Zoning Department has now
updated the original Land Use and Zoning study initiated by the Department
in February 1989 as directed by Motion 89-92, January 26, 1989. The stud
area is bounded by N.W. 36th Street and the City limits (N.W. 38th Street
from N.W 22nd to 27th Avenues.
2. EXISTING CONDITIONS
2.1 Existing Land Use
Commercial land uses are in a "u" shape, occupying the area between
N.W. 24th and 27th Avenues from 36th to 38th Streets, the area along
the north side of 36th Street from 22nd to 24th Avenues, and the west
side of 22nd Avenue from 36th to 38th Streets (see Existing Land Use
Map). These commercial land uses include used automobile and truck
sales lots, a crane storage yard, a utility company site,
contractor's storage yards, restaurants, food related stores, and
vacant lots. Commercial land use vacancies have increased by 84,400
sq. ft. since 1989.
Residential land uses occupy the interior of the study area, being
the area from the commercially zoned district located along N.W. 36th
Street to N.W. 38 Street between 22 Court (both sides) to the east
side of N.W. 24th Avenue. Residential uses comprise single-family
houses, duplexes and multi -family residential uses. (See Existing
Land Use Map)
2.2 future Land Use Plan Mao
The generalized Future Land Use Plan Map (Miami Comprehensive
Neighborhood Plan 1989-2000) designates General Commercial use for
the area between N.W. 24 and 27th Avenues and also along N.W. 36
Street and N.W. 22nd Avenue. It designates the existing residential
area as Medium Density Multi -family Residential. (See Future Land
Use Plan map).

2.3 Zoning
The zoning for the study area in Zoning Ordinance 11000 is, as
follows:
C-1 - Restricted Commercial along
38th Street.
C-2 - General Commercial along N.W,
Avenues and the area between 24th
38th Streets.
R-3 General Residential in the area
and 24th Avenue from N.W. 38 Street
area along of N.W. 36 Street. (See

The residential area located between N.W. 22nd and 24th Avenues is
improving in appearance; there is new residential construction. The area
contains approximately 125 residential units, mostly duplexes, in
relatively fair condition with single-family and multi -family units
scattered throughout. The largest apartment building, a three story
apartment building with 12 apartments, is now under construction on N.W.
24th Avenue between 36th and 38th Streets and two other apartment
buildings have been built recently. There have been numerous single
family and duplex structures renovated (including painting) since 1989.
There are only four vacant residential parcels. In contrast, there has
been no new construction or improvement in appearance in the commercial
area; the structures within the commercial areas have remained in the same
condition since 1989.
4. CONCLUSIONS
4.1 The area of study is nearly fully developed, although the residential
portion could be developed more intensely under present zoning.
4.2 There appears to be a demand for additional housing. A new 15 unit
apartment building has been built recently and another structure with
12 units is now under construction at N.W. 24 Avenue.
4.3 The existing single family residences, duplexes and apartment houses
are in relatively fair condition and show improved maintenance
4.4. The existing commercial areas have been developed on large lots;
however, large lots for redevelopment purposes are not available
within the residential area.
4.5 Commercial vacancies has increased in the study area by 84,400 sq.
ft. since 1989. Presently, there seems no demand for additional
commercial space.
5. ALTERNATIVES
5.1 (No Change) Land use would remain unchanged,
Comprehensive Plan. Present zoning is
designations (See attached Map -Alternative
as approved in the 1989

5.2 (Change to C-2 (Limited). The future land use designation along the
east side of N.W. 24th Avenue would be changed from Medium Density
Multi -family Residential to General Commercial allowing commercial
use and eliminating residential uses on both sides of the street (see
Map 2). This would require a comprehensive plan amendment as well as
a zoning change. (See Map - Alternative 2). This alternative will
jeopardize the future of the large apartment building under
construction in this street, as well as some of the residential
buildings recently renovated in the area. This change to commercial
may increase property taxes that could eventually result in higher
rents for many low income families and individuals living in the
area.
5.3 .(Change to C-2 (Extensive)). The land use designation and zoning of
the entire residential portion would change to General Commercial and
C-2 respectively, again eliminating the residential use. This would
require a comprehensive plan amendment and a zoning change. (See
attached Map - Alternative 3). This action would not only have all
the undesirable effects enumerated above, but also would negatively
impact the existing housing in the area. There is no market demand
for commercial use here.
6. RECOMMENDATION
The Department recommends Alternative 4.1 (No change) for the following
reasons:
a) Additional low -and moderate -income housing is needed in the City; the
existing housing stock needs*to be preserved.
b) A new apartment building is under construction and two new apartment
buildings have recently been built in the residential portion.
c) The residential portion of the neighborhood has improved in
appearance since 1989, several structures have been renovated, and
maintenance has increased.
d) If the residential portion is changed to General Commercial, new
residential uses will be precluded, existing housing will
deteriorate, impacting negatively the area's low -and -moderate income
residents and contributing to an overall decrease in the housing
stock.
e) Changing the residential portion to commercial use may result in
higher taxes for property owners and higher rents for tenants
especially for the low income residents living in the area.
f) Commercial vacancies have increased in this area since 1989 even
though commercial zoning has been requested; there is no demand for
commercial use in the area (other than this individual applicant).
