AN EMERGENCY ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "EASTERN AIRLINES/DISLOCATED WORKER RETRAINING PROGRAM (FY'91) JTPA TITLE III"; APPROPRIATING FUNDS FOR THE OPERATION OF SAID PROGRAM IN THE AMOUNT OF $207,400 FROM THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM GRANT AWARD; AUTHORIZING THE CITY MANAGER TO ACCEPT THE AFOREMENTIONED GRANT AWARD AND TO ENTER INTO THE NECESSARY AGREEMENTS WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM FOR IMPLEMENTATION OF SUCH GRANT AWARD; STIPULATING THAT THE AUTHORIZATION GRANTED HEREIN SHALL REMAIN VALID AND OUTSTANDING EVEN IF THE ANTICIPATED GRANT AWARD IS REDUCED OR INCREASED; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, seven thousand (7,000) airline employees were affected by the January 18, 1991 shutdown of Eastern Airlines; and WHEREAS, workers affected by the shutdown of Eastern Airlines are eligible for retraining opportunities under Title III of the Job Training Partnership Act (JTPA); and WHEREAS, two thousand three hundred sixty-eight (2,368) former Eastern Airlines employees have expressed an interest in participating in the retraining program; and WHEREAS, said funds are available through the South Florida Employment and Training Consortium (SFETC) which has approved an allocation of $207,400 for the Neighborhoods Jobs Program in the Department of Community Development to operate a retraining program for 100 participants; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: EASTERN AIRLINES/DISLOCATED WORKER RETRAINING PROGRAM (FY'91) JTPA TITLE III RESOURCES: GRANT AWARD FROM THE U.S. DEPARTMENT OF LABOR THROUGH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM $207,400 APPROPRIATION: EASTERN AIRLINES/DISLOCATED WORKER RETRAINING PROGRAM (FY'91) JTPA TITLE III $207r400 Section 3. Expenditures under this appropriation are contingent upon funding by the South Florida Employment and Training Consortium and the City Manager's acceptance thereof. Section 4. The City Manager is hereby authorized to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary agreements with the South Florida Employment and Training Consortium for the implementation of such grant award in a form acceptable to the City Attorney. Section 5. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 6. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 7. If any section, part of section, paragraph clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 8. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity for the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. 10880 -2- OMS Section 9. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 10. Odic, City Commission Agenda City Manager ENCLOSURES: May 9, 1991 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached emergency ordinance establishing a new Special Revenue Fund entitled "Eastern Airlines/Dislocated Worker Retraining Program (FY'91) JTPA III" in the amount of $207,400 from the United States Department of Labor through the South Florida Employment and Training Consortium. The ordinance further authorizes the City Manager to accept the grant award and to enter into the necessary agreement with the South Florida Employment and Training Consortium (SFETC) in a form acceptable to the City Attorney. BACKGROUND: The Department of Community Development has been advised by the South Florida Employment and Training Consortium (SFETC) that the Neighborhoods Jobs Program has been awarded an emergency grant in the amount of $207,400 to operate a dislocated worker retraining program under Title III of the Job Training Partnership Act (JTPA). Approximately 7,000 airline employees have been affected by the January 18, 1991 shutdown of Eastern Airlines. With the current instability of the airline industry, funds are available under Title III of the JTPA to provide retraining opportunities for these displaced workers. A total. of 2,368 former Eastern Airlines employees have expressed an interest in participating in the retraining program as of March 15, 1991. The Neighborhoods Jobs Program has been selected as one of seven (7) organizations to operate the aforementioned program. The City's Title III grant includes 100 vouchered classroom training slots. The cost -based contract will. include tuition, books, and supportive services which will be retroactive to February 22, 1991 and will. run through February 21, 1992.
