REQUEST Change of Zoning in the Official Zoning Atla, of Ordinance 11000, the Zoning Ordinance of the City of Miami, from R-2 Two Family Residential to C-1 Restricted Commercial. RECOMMENDATIONS PLANNING DEPARTMENT APPROVAL. The proposed change is contrary to the Future Land Use Element of the Miami Comprehensive Neighborhood Plan 1989-2000 (MCNP) designation of Residential Duplex. There is a companion item being presented to the Planning Advisory Board which is being recommended for approval. The requested change would be consistent with existing land use patterns in the area. The applicant is proffering a one foot W) strip along the south property lines of lots 28, 29, and the west 15' of Lot 30, and therefore, this would prevent more intense commercial uses, and consequently, additional traffic to intrude into the existing approved by the City of Miami Commission granted rezoning of residential property facing SW 22nd Terrace, under similar development conditions, specifically at 2951-2999, 3401-3417 3427-3523, 3591, and 3621-3631 SW 22nd Terrace. PUBLIC WORKS No comment. 10872 ZONING BOARD CITY COMMISSION At its meeting of September 10 1990 the Zoning Board's motion to recommend approval and its motion to recommend denial of the above request both failed by a 3 to 3 tie vote, thereby constituting a technical re- commendation'of denial. Three OPPONENTS were present at the meeting; Five PROPONENTS were present at the meeting. Three replies in OPPOSITION were received by mail; One reply in F VOR s received by mail. At its meeting of October 25, 1991, the City Commission passed the above on First Reading.. 10872 7 ANALYSIS Yam. 114 N1A X The proposed change is in harmony with the adopted Miami.Comprehensive Neighborhood Plan 1989-2000, and does not require a plan amendment. X The proposed change is in harmony with the established land use pattern. X The proposed change is related to adjacent and nearby districts. X The change suggested is within scale with the needs of the neighborhood or the City. X The proposed change maintains the same or similar population density pattern and thereby the load on public facilities such as schools, utilities, streets, etc. is the same. X Existing district boundaries are illogically drawn in relation to existing conditions on the property proposed for change. X There are changes or changing conditions that make the passage of the proposed change necessary. X The proposed change positively influences living conditions in the neighborhood. X The proposed change has the same or similar impact on traffic and does not affect public safety as the existing classification. X The proposed change has the same or similar impact on drainage as the existing classification. X The proposed change has the same or similar impact on light and air to adjacent areas as the existing classification. X The proposed change has the same or similar impact on property values in the adjacent areas as the existing classification. X The proposed change will contribute to the improvement or development of adjacent property in accord with existing regulations. X The proposed change conveys the same treatment to the individual owner as to the owner within the same classification and the immediate area; and furthers the protection of the public welfare. X There are substantial reasons why the use of the property is unfairly limited under existing zoning. X It is difficult to find other adequate sites in the surrounding area for the proposed use in districts already permitting such use. 10872 U N w am as• ' `' ' fo! a • am a>r Sas V $01 0 aA : 299 P ° e• •• ISO 1•a . aS.W. a• all ISO a•I -9 1tN H• If• u •• •• u u 72 . fT 201 » •e • I t a • f 0 1 10 eI• am aw tff ~ !• • I•• tN 10a E I I;= aM aas r ' 7 N st tts It 1•T IM a• I• N 1♦ 1• M Is II fal •• aaa aaa p 2!O•• 2M•2 iaT Qv tM t V31 • .a r •• M 4 o ••a c 7Tol as:ate + al tea .• 12 ~ ,hIL•Iss u•. isIN •. •. DIRECT NO: (305) 579-0683 In connection with the Application for Amendment to the Zoning Atlas and Application to Amend the Miami Comprehensive Plan, being filed today, I wish to advise you that the proposed change being sought is in harmony with the neighborhood and the established land use patterns. The property is adjacent to commercially zoned property and S.W. 22nd Terrace has other commercially zoned property that is being utilized with the frontage on Coral Way. This proposed change would have a positive impact on the property values in adjacent areas, and to limit the use of the subject property when other properties along 22nd Terrace are zoned commercially, would be a deprivation of property rights for this owner. 10872 //I W Ms. Gloria Fox August 6, 1990 Page 2 We have also enclosed a copy of a Declaration of Restrictive Covenants which McDonald's Corporation is proffering to execute with its Zoning Atlas amendment application.
