ORDINANCE NO. 1108"11
AN ORDINANCE AMENDING THE FUTURE LAND USE MAP
OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI
COMPREHENSIVE NEIGHBORHOOD PLAN 1989-2000,
FOR THE PROPERTY LOCATED AT APPROXIMATELY
3301 SOUTHWEST 22ND TERRACE, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN), BY
CHANGING THE DESIGNATION OF THE SUBJECT
PROPERTY FROM DUPLEX RESIDENTIAL TO
RESTRICTED COMMERCIAL; MAKING FINDINGS;
INSTRUCTING THE CITY CLERK TO TRANSMIT A COPY
OF THIS ORDINANCE TO AFFECTED AGENCIES;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 5, 1990, Item No. 4, following an advertised public
hearing, adopted Resolution No. PAB 58-90, by a 8 to 1 vote,
RECOMMENDING APPROVAL of an amendment to the Future Land Use Map
of Ordinance No. 10544, as amended, the Miami Comprehensive
Neighborhood Plan 1989-2000, as hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Future Land Use Map of Ordinance No. 10544,
as amended, the Miami Comprehensive Neighborhood Plan 1989-2000,
is hereby amended by changing the designation, from Duplex
Residential to Restricted Commercial, for property located at
approximately 3301 Southwest 22nd Terrace, Miami, Florida, and
more particularly described as Lots 28, 29 and the west 15 feet
of Lot 30, less 1 foot of the southern portion of lots 28, 29 and
30, Block 4, AMENDED PLAT OF MIAMI SUBURBAN ACRES, according to
the plat thereof, as recorded in Plat Book 4 of Page 73 of the
Public Records of Dade County, Florida.
Section 2. It is hereby found that this Comprehensive Plan
designation change:
a. Is necessary due to changed or changing
conditions;
b. Involves a residential land use of 5 acres or less
and a density of 5 units per acre or less or
involves other land use categories, singularly or
in combination with residential use, of 3 acres or
less and does not, in combination with other
changes during the last year, produce a cumulative
effect of having changed more than 30 acres;
C. The property which is the subject of this
amendment has not been the specific subject of a
Comprehensive Plan change within the last year;
and
d. The herein amendment does not involve the same
owner's property within 200 feet of property
provided a Comprehensive Plan change within the
last 12 months.
Section 3. The City Clerk is hereby directed to transmit a
copy of this Ordinance immediately upon approval of first reading
to Thomas Pelham, Secretary, Florida Department of Community
Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100,
for 90 day review and comment.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective forty-five
(45) days after final reading and adoption thereof.

The City Of Miami, on April 25, 1991, adopted Ordinance 10871 amending the

amendment was a small scale development activity and, according to Chapter
163-3187, was initially submitted without regard to statutory limits on the

Plan 1989-2000, Future Land Use Plan Map, by
changing the land use designation of the subject
property from Duplex Residential to Restricted
Commercial.
REQUEST To change the Future Land Use Plan Map
designation of the subject property from Duplex
Residential to Restricted Commercial.
RECOMMENDATIONS:
PLANNING DEPARTMENT Approval.
BACKGROUND Th4s 0.37 acre site comprises three lots in the
south half of the block between S.W. 22nd
Terrace and 22nd Street (Coral Way) and S.W.
32nd and 34th Avenues facing S.W. 22nd Terrace.
The adopted Miami Comprehensive Neighborhood
Plan (MCNP) - 1989-2000 - Future Land Use Plan
Map, designates the lots of the subject property
facing S.W. 22nd Terrace, Duplex Residential, as
are those lots to the south, east and west. The
lots at the north of the subject property,
facing S.W. 22nd Street (Coral Way) are
designated Restricted Conmercial.

The Residential Duplex land use category permits
two units residential structures (attached or
detached). Supporting services such as schools,
churches, day care, ACLFs or similar uses are
also permissible subject to planning director
approval in suitable locations.
The Restricted Commercial category permits
commercial activities that generally serve the
daily retailing and service needs of the public,
and are restricted to areas directly served by
arterial or collector roadways, or directly
accessible via Metrorail.
This application qualifies as a "small scale
amendment per Ch. 163.3187 (1)(C)3, F.S. 1987.
If approved on first reading by the Commission,
it could be immediately sent to the Florida
Department of Community Affairs for their
review.
ANALYSIS Both sides of S.W. 22nd Terrace are designated
"Residential Duplex" according to the MCNP. This
category permits duplex residential uses, along
with supporting uses, as opposed to the
requested commercial use to serve the abutting
commercial use on Coral Way.
The City Commission has established their policy
on parcels on the north side of S.W. 22nd
Terrace in this area when access is possible
from Coral Way. The subject lots have been
previously granted conditional use approval for
off -site parking to serve the commercial use on
Coral Way. Additionally, in this same area there
are three instance or rezoning from residential
to commercial classification by the Commission
in the past few years. In the interest of
equity, the petition for plan amendment thould
be considered favorably.
PLANNING ADVISORY BOARD At its meeting of September 5, 19909
the Planning Advisory Board adopted
Resolution PAB 58-90 by a vote of
M 8-1, recommending approval of the
above.
One PROPONENT was present at the
meeting.
Four replies AGAINST and two replies
in FAVOR were received by mail.
CITY COMMISSION At its meeting of October 25, 1991, the
City Commission passed the above on First
Reading.

RECOMMENDATION
The Planning Department recommends approval of the proposed comprehensive plan
amendment requesting the land use designation change from "Residential --
Duplex" to "Restricted --Commercial".
DISCUSSION
The subject 0.37 acre parcel at approximately 3301 S.W. 22nd Terrace,
comprises three lots on the south half of the block bounded by 22nd Terrace
and 22nd Street (Coral Way) and between S.W. 32nd and 33rd Avenues, in the
Coconut Grove/Shenanndoah Planning District, one block south of the Coral Gate
neighborhood.
MCNP Land Use Policy 1.6.1., establishes future land use categories according
to the Future Land Use Plan Map and the "Interpretation of the Future Land Use
Plan Map". The subject property is currently designated "Residential --
Duplex". Areas of the same designation are located to the east, west and
south of the subject property, while to the north are areas of "Commercial --
Restricted" land use.
The "Residential -- Duplex" land use category permits two -unit residential
structures (attached or detached). Supporting services such as schools,
churches, day care, parks, ACLFs or similar uses are also permissible subject
to planning director approval in suitable locations. Retail and/or office
uses would require a change in land use designation.
"Commercial -- Restricted" land uses accommodate commercial activities that
generally serve the daily retailing and service needs of the public. Other
permissible land uses within this category include motels, hotels, transitory
residential facilities, offices, medical facilities, and sport, exhibition or
entertainment facilities.
A change of land use designation to "Commercial -- Restricted" would support
MCNP Land Use Goal 1, requiring land use patterns to promote and facilitate
economic development and the growth of job opportunities in the City. The
change would, also, be consistent with Land Use Objective 1.3. which requires
the City to encourage commercial development within existing commercial areas
as long as the capacities of existing public facilities that serve- the
development would not degrade the LOS below the minimum standards adopted in
the MCNP Capital Improvement Element (CIE). Both sides of the segment of Coral
Way between S.W. 32nd Avenue and S.W. 37th Avenue are currently designated
"Commercial --Restricted".
Currently, the adopted Future Land Use Map shows three instances in which the
"Commercial --Restricted" land use is located along the north side of S.W. 22nd
Terrace. Two are in the block adjacent to the west, the other is in the next
block. A clear precedent, therefore, exist for the requested land use change
since similar land use pattern are present in the area.
In addition, Land Use Policy 1.1.1. requires development or redevelopment,
that results in an increase in density or intensity of land use, to be
contingent upon the availability of public facilities and services that meet
or exceed the minimum LOS standards adopted in the Capital Improvement Element
(CIE) (CIE Policy 1.2.3.). The attached Concurrency Management Analysis
pertaining to concurrency demonstrates that no level of services would be
reduced below minimum levels.

The Department has completed its review of the proposed
comprehensive plan amendment (DCA No. 91-S2) for the City of
Miami which was submitted on November 13, 1990. Copies of the
proposed amendment have been distributed to appropriate state,
regional and local agencies for their review and their comments
are enclosed.
The Department has reviewed the proposed amendments for
consistency with Rule 9J-5, Florida Administrative Code, Chap-
ter, 163, Part II, Florida Statutes, and the adopted City of
Miami Comprehensive Plan. The Department raises no objections
to the proposed amendment, and this letter serves as our
Objections, Recommendations and Comments Report.
This letter and the enclosed external agency comments are
being issued pursuant to Rule 9J-11.010, Florida Administrative
Code. Upon receipt of this letter, the City of Miami has 60
days in which -to adopt, adopt with changes, or determine that
• the City of Miami will not adopt the proposed amendments. The
process for adoption of local comprehensive plan amendments is
outlined in s.163.3184, Florida Statutes, and Rule 9J-11.011,
Florida Administrative Code.

Within five working days of the date of adoption, the City

OBJECTIONS: The concurrency management analysis for this
amendment does not include an analysis of the existing or
projected level of service (LOS) for SR 972/Coral Way (SW 22nd
Street). The LOS' analysis referenced in the application uses a
methodology which is not consistent with the FDOT Level of
Service Standards and Guidelines Manual, or the 1985 Highway
Capacity Manual, from which it is derived.
RECOMMENDATIONS: Data and analysis regarding the existing and
projected LOS of SR 972/Coral Way should be provided. The level
of service analysis should be performed using a methodology which
is consistent with the FDOT Level of Service Standards and

OBJECTIONS: The level of service standard used in the concurrency
management analysis is not compatible with, nor has it been
coordinated with, the standards contained in the FDOT Level of
Service Standards and Guidelines Manual. No justification
provided as to why it is not feasible to be compatible with the'
FDOT level of service standards. There is no explanation of how
deviation from FDOT standards will achieve other important State
goals. No local government actions are identified that, combined
with deviation from the standard, would further such other
important State goals and policies.
RECOMMENDATIONS: The City should revise the concurrency
management analysis by using a level of service standard which is
consistent with the FDOT Level of Service Standards and
Guidelines Manual, or the 1985 Highway Capacity Manual,or
provide a justification as to why it is not easi a to be
compatible with the FDOT level of service standards.

This Department has reviewed the referenced City of Miami Comprehensive
Neighborhood Plan amendment which you transmitted to us under separate
cover memorandum dated December 18, 1990. We reviewed the proposed
amendment primarily to identify points of consistency or inconsistency
with the provisions of Dade County's Comprehensive Development Master
Plan (CDMP). The following comments are offered for your consideration.
Amendment No. 90-14
This amendment, located on the north side of SW 22 Terrace between SW
32 and SW 33 Avenues, requests a change of land use designation on the
City's Future Land Use map from "Duplex Residential" to "Restricted
Commercial" for a .37 acre parcel. The "Restricted Commercial" designa-
tion permits commercial activities that generally serve the daily
retailing and service needs of the public. Permissible uses include
motels, hotels, transitory residential facilities, offices, medical
facilities, and sport, exhibition or entertainment facilities. Wirhin
the surrounding area, the lots north of the subject amendment area
facing Si; 22 Street (Coral Way) are currently designated on the City's
Future Land Use map as "Restricted Commercial10. There are other
instances where the southern parts of the block facing SW 22 Terrace
have also been designated "Restricted -Commercial". According to the
information contained in the analysis of the amendment, the lots
comprising this amendment have been previously granted conditional use
approval for off -site parking to serve the commercial use on SW 22
Street.
The Metro -Dade County CDMF Land Use Plan map designates the entire block
between SW 24 Street and SW 22 Terrace within this area of the amendment
as "Business and Office" which is consistent with the requested land use
change. This Department concludes that Amendment No. 90-14 is not
inconsistent with the policies of the County's CDMP.
