ORDINANCE N0. 10870
AN ORDINANCE AMENDING SECTION 80-2 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY PROVIDING FOR ENLARGED BOUNDARIES
OF THE PROTECTED OR RESTRICTED ANCHORAGE
AREAS WITHIN THE DINNER KEY MARINA YACHT AREA
BASIN AND THE BAYFRONT PROHIBITIVE ANCHORAGE
AREA, WITH THE NAME OF THE LATTER AREA BEING
CHANGED TO "MIAMARINA BAYFRONT PROHIBITED
ANCHORAGE AREA"; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the last amendment to the Code of the City of
Miami, Florida, as amended, affecting Code Section 50-2, was
adopted in 1987; and
WHEREAS, the City Commission adopted Ordinance No. 10055, on
November 26, 1985, establishing City wide regulations and
restrictions on mooring or docking to public or private property,
known as "The Mooring Code"; and
WHEREAS, the Dinner Key and Bayfront prohibited anchorage
areas are a part of the general area described and included in
the provisions of said Mooring Code; and
WHEREAS, the Dinner Key Marina Yacht Basin and Bayfront
prohibitive anchorage areas are larger than as stated in the
Mooring Code;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 50-2 of the Code of the City of Miami,
Florida, as amended, is hereby amended in the following
particulars:
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material.

"Sec. 60-2. Obstructing channels; unlawful anchoring,
mooring or docking; unlawful use of
navigational aids.
It shall be unlawful for any vessel within the city to
obstruct any established channel of the city; or to tie
up to or to discharge persons upon any navigational aid
within the city; or to anchor within the limits of any
established channel of the city; or, except in an
emergency or with the approval of the city dtzpartn=

Seotion 2. All ordinances or parts of ordinances insofar as
they are inoonsistent or in oonfliot with the provisions of this
Ordinanoe are hereby repealed.
Seotion 3. If any seotion, part of seotion, paragraph,
olause, phrase, or word in this ordinanoe is deolared invalid,
the remaining provisions of this ordinanoe shall not be affeoted.
Seotion 4. This Ordinanoe shall beoome effective thirty
(30) days after final reading and adoption thereof.

The provisions on Ordinance No. 10870 require that copies of the
sketches on both of the City's restrictive or prohibitive
anchorage areas be available for inspection by the public at both
of the marina facilities and also in the office of the City
Clerk.
I am enclosing copies of these two sketches identified as 33-112
and 40-55A, for Dinner Key and Miamarina respectively, for your
perusal. Additional copies can be obtained from the central
files at the Public Works Department under the miscellaneous
category.
Also, at this time, a copy is being placed at each marina
facility.
Should you require additional information, please advise.

Dear Mr. Mayor and Commissioners:
The purpose of this letter is to take the place of a
personal appearance, while stating our opposition on the record
to the proposed Anchorage Boundary Ordnance.
It is our position that the proposed anchorage boundary
is an illegal exercise, or attempt at exercise, of jurisdiction
over these waters. It is our position that any anchorage must be
created through the federal DOT application process.
At the time this matter was last scheduled for reading,
at our request and by agreement, the City Manager asked for a
delay so that we could meet with the appropriate parties to
discuss our objections to this ordnance. At that meeting, our
primary inquiry was:
WHAT IS THE PURPOSE OF THIS PROPOSED ANCHORAGE BOUNDARY?
There were four individuals from the various
departments present, plus Mr. Kurtz as the attorney. None could
or would tell us what the purpose of this ordnance is. The only
individual who offered any suggestion of the purpose was Mr. Al
Rodriguez. He stated that the purpose was to "manage" the
anchorage. When asked to explain what he intended by that
phrase, he could offer no further detailed response.
It is a fundamental precept of the establishment of
law, rule or regulation, that its purpose be made clear. It is
fundamental that this Commission know and the Public has a right
to know, what its government intends to do with any proposed

rule. This concept is so fundamental that any attempt at
enactment of this ordnance is in our opinion fatally flawed.
So that you can each be made aware of the areas we
covered, I will outline them here:
1. Regulation over navigation: Not available to the City since
extensive federal inland and international rules of the road.
2. Regulation over pollution: Again, extensive and far more
stringent federal regulation in this area already exists.
3. Marine sanitation devices: Same as number 2 above.
While the passage of this ordnance might not itself
cause a "ripened" issue, any attempt at specific enforcement
surely would. In the absence (which appears to be total) of any
bona fide purpose, we ask that this Commission refuse to enact
the proposed anchorage boundary as an ordnance of the City of
Miami.

It is respectfully recommended that the City Commission adopt the
attached Ordinance redefining the Anchorage areas at Dinner Key
and Miamarina. This action is necessary to
proceed

In order to address this matter and attempt to resolve the
situation we must, after passage of this 'ordinanoe, proceed to
obtain regulatory and environmental permits for a "Designated
Anchorage" area at Dinner Key. For this process it is necessary
to have a clearly defined area upon which the mooring or
anchoring activities can take place in an orderly and efficient
fashion.
In addition to the situation at Dinner Key, the Miamarina-
Hayfront waters now present virtually unrestricted opportunities
for hazardous anchoring by boat owners who may be shrimping or
concert listening in an unmarked and undefined area. In this case
the proposed extension of the prohibitive area will allow for
it's use but will make it available for looking or mooring only
upon approval by the Dockmaster at the facilities. Visiting
yacht captains will have to contact the Dockmaster to obtain an
assigned and secure location for their vessels, preferably at the
Marina.
To summarize, the need for this Ordinance follows a basic
requirement for approval by the other regg-latory agencies

place must be provided by the local government, in this case by
City Ordinance".
