ORDINANCE NO. 10864
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10782, AS AMENDED, THE CAPITAL
IMPROVEMENT APPROPRIATIONS ORDINANCE, BY
INCREASING THE TOTAL APPROPRIATION TO THE
CAPITAL PROJECT ENTITLED "SOUTHEAST
OVERTOWN/PARK WEST PHASE II", PROJECT
NO. 322057, BY $36,002; SAID AMOUNT TO BE
AVAILABLE FROM THE UNITED STATES DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT SECTION 108
LOAN PROCEEDS; RESULTING IN A TOTAL PROJECT
APPROPRIATION OF $2,755,702; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, Section 1 of the Capital Improvement
Appropriations Ordinance No. 10782, as amended, adopted
September 27, 1990, appropriated $2,719,700 for Project
No. 322057, the Southeast Overtown/Park West Phase II; and
WHEREAS, the Department of Development has initiated the
acquisition of property located within the Southeast
Overtown/Park West Redevelopment Project; and
WHEREAS, the City contracted for an independent appraisal of
said property that was prepared by Ralph Ross Real Estate Co.,
Inc. with the resulting appraised value being $32,729; and
WHEREAS, after negotiations, the Seller has agreed to an
offer of $36,002; and
WHEREAS, funds for the acquisition of property will be
derived from Section 108 Loan Proceeds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance 10782, as amended,
adopted September 27, 1990, is hereby amended in the following

"Section 1. The herein appropriations are
hereby made for implementation of all municipal
capital improvements of the City of Miami, including
new capital improvement projects scheduled to begin
during fiscal year 1990-91. The herein appropriations
which are hereby designated by reference to
descriptive project and title number also include
appropriations of previously approved scheduled
projects as well as re -appropriations of prior fund
appropriations. The source of revenues to support the
herein appropriations is hereby identified by fund and
project with the project appropriations and revenues
therefore being set forth for seven program areas
(I-VII) based upon use or functional category within
said areas, as follows:

Section 2. All ordinances or parts of ordinances,
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the

remaining provisions are now in effect and remain unchanged.

figures are rounded to the nearest hundred dollars.

preservation of peace, health, safety and property of the City of
Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debt, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of municipal affairs.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become
immediately upon its adoption.
