ORDINANCE NO. 10860
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION OF THE
BLOCK BOUNDED BY NORTHEAST 50TH TERRACE AND
NORTHEAST 51ST STREET BETWEEN NORTHEAST MIAMI
PLACE AND NORTHEAST IST COURT, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN), FROM
R-1 SINGLE FAMILY RESIDENTIAL TO G/I
GOVERNMENT AND INSTITUTIONAL; BY MAKING
FINDINGS; AND BY MAKING ALL NECESSARY CHANGES
ON PAGE NUMBER 16 OF SAID ZONING ATLAS;
CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board at its meeting of
February 20, 1991, Item No. 1, following an advertised public
hearing,. adopted Resolution No. PAB 12-91, by a 6 to 2 vote,
RECOMMENDING APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the Zoning Atlas as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section I. The Zoning Atlas of Ordinance No. 11000, the
Zoning Ordinance of the City of Miami, Florida, as amended, is
hereby amended by changing the zoning classification from R-1
Single Family Residential to G/I Government and Institutional,
for the block bounded by Northeast 50th Terrace and Northeast
51st Street between Northeast Miami Place and Northeast 1st
Court, Miami, Florida, more particularly described as Lots 1-16,
Block 5, ALTA VISTA CORRECTED, according to the plat thereof, as
recorded in Plat Book 6 at Page 4 of the Public Records of Dade
County, Florida.

Section
Z. It is hereby found that this zoning
classification
change:
a.
is in conformity with the adopted Miami
Comprehensive Neighborhood Plan;
b.
is in harmony with the established land use
pattern;
C.
is related to adjacent and nearby districts;
d.
is not out of scale with the needs of the
neighborhood or the City;
e.
is necessary due to changed or changing
conditions;
f.
positively influences living conditions in the
neighborhood;
g.
has the same or similar impact on traffic and does
not affect public safety to a greater extent than
the existing classification;
h.
has the same or similar impact on property values
in the adjacent areas as the existing
classification;
i.
will contribute to the improvement or development
of adjacent property in accord with existing
regulations;
J.
conveys the same treatment to the individual owner
as to owners within the same classification and
the immediate area and furthers the protection of
the public welfare;
k.
is based on the use of the property being unfairly
limited under existing zoning; and
1.
is warranted due to the difficulty in finding
other adequate sites in the surrounding area for
the proposed use in districts already permitting
such use.
Section 3. Page No. 16 of the Zoning Atlas, made a part of
Ordinance
No. 11000 by reference and description in Article 3,
Section 300
thereof, is hereby amended to reflect the changes
made necessary by this amendment.

Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective forty-five
(45) days after final reading and adoption thereof.

Consideration of mending the zoning atlas of
Ordinance 11000, the Zoning Ordinance of the
City of Miami, by changing the zoning
classification of the subject property from R-1
SINGLE FAMILY RESIDENTIAL to G/I GOVERNMENT AND
INSTITUTIONAL.
REQUEST To rezone a block recently purchased by the
Miami Jewish Home to G/I Government and
Institutional.
PLANNING RECOMMENDATION Approval.
BACKGROUND 1. On January 25, 1990, in conjunction with
hearings on adoption of Zoning Ordinance 11000,
the Commission passed Motion 90-83, as follows:
"A Motion changing the zoning classification
for all the Jewish Home and Hospital for the
Aged property located generally in the area
of NE 2nd Avenue and 52 Street from CG-2/7 to
(G/I Governmental and Institutional); further
instructing the Planning Department to
conduct a study of the area and bring back a
recommendation at the time of second reading
of the Zoning Ordinance."
The zoning of the Jewish Home property, at that
time, was then brought into conformity with the
Comprehensive Plan.
2. A change in plan designation and accompanying
change of zoning classification for three other
areas of the Jewish Home was approved on 1st
reading on July 26, 1990, and forwarded to the
Florida Department of Community Affairs and is
now scheduled for second reading on February 28,
1991.

3. This planning designation of this particular
block was part of a series of Comprehensive Plan
changes adopted (on 2nd reading) January 24,
1991. It is now in order to commence rezoning
to bring the block into conformity with the
plan.
This rezoning follows a Department of Planning,
Building and Zoning proposal to designate major
institutions as "Major Public Facilities,
Transportation and Utilities" and changing their
zoning classification to G/I Government and
Institutional.
The block is presently largely cleared; all
except two of the approximately 14 single family
houses remain.
At its feet mg of February 6, 1991, the Planning
Advisory Board adopted Resolution PAB 10-91, by
a 9-0 vote, approving the above.
At its meeting of February 28, 1991, the
City Commission passed the above on First
Reading.
