AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "EMERGENCY SHELTER GRANT (FY'91)11, AND APPROPRIATING FUNDS FOR OPERATION OF SAME IN THE AMOUNT OF $287,000 FROM THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (USHUD) 1991 EMERGENCY SHELTER GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the U.S. Department of Housing and Urban Development (USHUD) notified the City of Miami that it is eligible to receive an FY'91 Emergency Shelter Grant in the amount of $287,000 from the Stewart B. McKinney Homeless Assistance Act to provide programs for the homeless; and WHEREAS, the City Commission adopted Resolution No. 91-163 on February 28, 1991, which authorized the City Manager to submit a grant application in the amount of $287,000 to the U.S. Department of Housing and Urban Development for the 1991 Emergency Grant; and WHEREAS, Resolution No. 91-163 further authorized the City Manager to accept the grant and execute the necessary acceptance documents with USHUD; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: EMERGENCY SHELTER GRANT (FY191) RESOURCES: U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT $287,000 APPROPRIATION: FY191 EMERGENCY SHELTER GRANT $287,000 Y F 10856 Section 3. The herein authorization shall remain valid and outstanding even if the anticipated grant toward is modified. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. REFERENCES City Manage ENCLOSURES: Agenda Item February 28, 1991 RECOMMENDATION It is respectfully recommended. that the City Commission approve the attached ordinance and resolution appropriating 1991 Emergency Shelter Grant funds and authorizing the City Manager to submit an application to the U.S. Department of Housing and Urban Development (USHUD) requesting funds in the amount of $287,000 for the proposed Emergency Shelter Grant Program during FY' 91 and, upon approval of said grant by USHUD, to accept the same and execute the necessary implementing contracts and agreements; further allocating the aforementioned amount for the herein named activities providing services to the homeless and authorizing the City Manager to enter into agreements with appropriate agencies in a form acceptable to the City Attorney. BACKGROUND The Department of Community Development has prepared the appropriate legislation for a public hearing on the FY'91 Emergency Shelter Grant program scheduled for February 28, 1991. USHUD notified the City of Miami on January 22, 1991 that it is entitled to receive an Emergency Shelter Grant of $287,000 as a result of the Stewart B. McKinney Homeless Assistance Act adopted by Congress to provide services to the nation's homeless population. The grant requires a one-to-one match which may be .hough either cash or in kind services. This is the City's sixth emergency shelter grant and is based on the same formula used to award Community Development Block Grant Funds to eligible jurisdictions. The FY'90 grant of $292,000 is directed to the operation of the Beckham Hall Shelter ($242,000) for homeless males and Better Way ($50,000), a shelter for recovering homeless substance abusers. The City's application for this grant must be submitted to USHUD by March 7, 1991 and it is anticipated that USHUD approval will be received within 30 days. Failure to meet the deadline may result in the reallocation of the City's entitlement to other jurisdictions. 10856 7-t • Honorable Mayor and Members -.2 - o£ the City Commission The emergency shelter grant may be used only for one or more of the following eligible activities related to emergency shelter for the homeless: 1. Renovation, major rehabilitation, or conversion of buildings for use as emergency shelters for the homeless. 2. Provision of essential services (which may include employment, health, substance abuse, education or food) if, i. the service is a new service or there is a quantifiable increase -in the level of service from the prior 12 month period; and ii. not more than 30% of the total grant may be used for these services. 3. Payment of maintenance, operation (including rent, excluding staff), insurance, utilities and furnishings. 4. The development and implementation of homeless prevention activities (not more than 30% of the total grant may be used for these services). For the first time, the program allows up to 5% of the total grant to be used for administration. The City has received several recent funding requests which conform to the guidelines of the emergency shelter grant from agencies serving the homeless. Staff has met with these organizations to advise them of grant requirements, solicit Requests for Funding Proposals (which are due February 14, 1991) and inform these organizations of the February 28, 1991 Public Hearing. Projects approved by the City Commission will be .....included in the City's application package to USHUD. Adoption of the proposed legislation appropriates FY191 Emergency Shelter Grant funds, authorizes the City Manager to submit an application to the U.S. Department of Housing and Urban Development (USHUD) requesting funds in the amount of $287,000 and, upon approval of said grant by USHUD, to accept the same and execute the necessary implementing contracts and agreements and further allocates the aforementioned amount to non profit agencies providing services to the homeless and enter into agreements with approved agencies. 10856 MIAMI REVIEW Published Daily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
