ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10782/ AS AMENDED, THE CAPITAL
IMPROVEMENT APPROPRIATIONS ORDINANCE, BY
INCREASING THE TOTAL APPROPRIATION TO THE
CAPITAL PROJECT ENTITLED "SOUTHEAST
OVERTOWN/PARK WEST 7TH AND 9TH STREET MALLS",
PROJECT NO. 341176 BY $200,000; SAID AMOUNT
TO BE AVAILABLE FROM THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
SECTION 108 LOAN PROCEEDS, RESULTING IN A
TOTAL APPROPRIATION OF $2,281,000; CONTAINING
A REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, Section 1 of the Capital Improvement
Appropriations Ordinance No. 10782, as amended, adopted;.—
September 27, 1990, appropriates $2,081,000 for Project No.
341176, the Southeast Overtown/Park West 7th and 9th Street
Malls; and
WHEREAS, the initial budget for the first phase of the Mall
development provided for the construction of one block of the 7th
Street Mall and one block of the 9th Street Mall; and
WHEREAS, the cost effectiveness of constructing additional
blocks of the mall project at the same time makes it desirable to
build a second block of the 7th Street Mall as a part of the
inital construction phase; and
WHEREAS, construction bids were recieved on February 14,
1991 for the 7th and 9th Street Malls that will permit the City
to contract for the construction of a second block of the 7th
Street Mall with an increased appropriation of $200,000 to the
project budget;
NOW,THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance 10782, as amended,
adopted September 27, 1990, is hereby amended in the following
particulars:I

implementation of all municipal capital improvements of the
City of Miami, including new capital improvement projects
scheduled to begin during Fiscal ;dear 1990-91. The herein
appropriations which are hereby designated by refereince to
descriptive project and title number also include
appropriations of previously approved scheduled projects as
well as re -appropriations of prior fund appropriations.
The source of revenues to support the herein appropriations
is hereby identified by fund and project with the project
appropriations and revenues therefore being set forth for
seven program areas (I-VII) based upon use or functional
category within said areas, as follows:

SECTION 2. All ordinances or parts of ordinances, insofar
as they are inconsistent with the provisions of this Ordinance,
are hereby repealed.
SECTION 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety and property of the City of

Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debt, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of municipal affairs.
SECTION 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.
SECTION 6. This Ordinance shall take effect immediately
upon its passage.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance amending Section 1 of the Ordinance
No. 10782, adopted September 27, 1990, as amended, the Capital
Improvement Appropriations Ordinance, by increasing the
appropriation for the project entitled "Southeast Overtown/Park
West 7th and 9th Street Malls" Project No. 341176 by $200,000.
This additional amount is. to be appropriated from the United
States Department of Housing and Urban Development Section 10'8
Loan and is to be used for construction of one additional block
of the mall projects.
BACKGROUND:
The Department of Development has analyzed the need for this
action.
This $200,000 increase in the Capital Improvements Program is
needed to fund construction of one additional block of the 7th
Street Mall that will enable the -City to complete the full 7th
Street Mall from I-95 to the Overtown Transit Station in the
initial phase of mall construction. There will be a cost savings
to the project to construct both blocks of the 7th Street Mall
under the same construction contract rather than delaying the
second block and bidding/constructing it separately at a later
date.
The original budget anticipated constructing only one block of
the 7th Street mall and one block of the 9th Street mall.
However, both blocks of the 7th Street Mall were included in the
December 17th, 1990 construction bid package thus enabling the
City to _include construction of the second 7th Street block in
the mall construction contract recommmended for approval on the
March 14th, 1991 Commission agenda, provided the additional funds
are appropriated as recommended.
