HomeMy WebLinkAboutO-10836J-91-76 1/2/91 ORDINANCE NO. 10834 AN EMERGENCY ORDINANCE AMENDING SECTION ONE OF ORDINANCE NO. 10782, ADOPTED SEPTEMBER 27, 1990, AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE, BY ESTABLISHING THE NEW CAPITAL IMPROVEMENT PROJECT ENTITLED "NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PROJECT", PROJECT NO. 352277, IN THE AMOUNT OF $400,000 FROM STORM SEWER GENERAL OBLIGATION BOND FUNDS; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No. 10782 on September 27, 1990, to establish appropriations for capital Improvements, continue previously approved capital Improvement projects, and establish new capital Improvement projects to begin during fiscal year 1990-91; and WHEREAS, the United States Environmental Protection Agency (EPA) adopted Its final rule on stormwater discharges on October 31, 1990 requiring municipalities to obtain a National Pollutant Discharge Elimination System (NPDES) permit for municipal storm sewer systems; and WHEREAS, the aforesaid EPA rule established a two part application process and compliance schedule with Part 1 application deadline being November, 1991 and Part 2 application deadline being November, 1992; and WHEREAS, the NPDES permitting process will involve extensive water quality data collection and monitoring which will require the acquisition of the services of engineering and laboratory consultants at the earliest possible date to meet the established EPA deadlines; and WHEREAS, the estimated cost of meeting all requirements of the EPA's NPDES permitting program Is $400,000 with monles available from Storm Sewer General Obligation Bond Funds to cover said program costs and expenses; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 10782, as amended, adopted September 27, 1990�Is hereby amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for Implementation of all municipal capital Improvements of the City of Miami, Including new capital Improvement projects scheduled to begin during fiscal year 1990-1991. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriatlons of prior fund appropriations. The source of revenues to support the herein appropriations Is hereby identified by fund and project with the project appropriations with revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: TOTAL APPROPRIATIONS ($ X000) VII. Ali ordinances, or parts of ordinances Insofar as they are Inconsistent or In conflict with provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance Is declared Invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance Is hereby declared to be an emergency measure on the grounds of urgent public need for preservation of peace, health, safety, and property of the City Of Miami and upon the further grounds of the necessity to mak e the required and necessary payments to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days Is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 6.
