AN EMERGENCY ORDINANCE MAKING APPROPRIATIONS
FROM THE DOWNTOWN DEVELOPMENT DISTRICT AD
VALOREM TAX LEVY AND OTHER MISCELLANEOUS
INCOME FOR THE DOWNTOWN DEVELOPMENT AUTHORITY
OF THE CITY OF MIAMI, FLORIDA, FOR THREE -
SIXTHS (APRIL 1, 1991 TO SEPTEMBER 30, 1991)
OF THE FISCAL YEAR ENDING SEPTEMBER 30, 1991;
AUTHORIZING THE EXECUTIVE DIRECTOR OF THE
DOWNTOWN DEVELOPMENT AUTHORITY TO INVITE OR
ADVERTISE REQUIRED BIDS; PROVIDING BUDGETARY
FLEXIBILITY; PROVIDING THAT THIS ORDINANCE BE
DEEMED SUPPLEMENTAL AND IN ADDITION TO THE
ORDINANCE 'MAKING APPROPRIATIONS FOR THE
FISCAL YEAR ENDING SEPTEMBER 30, 1991, FOR
THE OPERATIONS OF THE CITY OF MIAMI, FLORIDA;
CONTAINING A REPEALER PROVISION, SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Board of Directors of the Downtown Development
Authority of the City of Miami has approved and submitted to the
City Commission a Budget Estimate of the expenditures and
revenues of the Downtown Development Authority for the Fiscal
Year 1990-1991, as prepared by the Executive Director of the
Downtown Development Authority, copies of such estimates having
been made available to the newspapers of the City; and
WHEREAS, this operating budget of the Downtown Development
Authority include changes within said budget which reflect the
expressed intention of the City Commission in regard to concerns
raised by the City Commission at its meeting of September 7,
1990; and
WHEREAS, the City Commission has reviewed the Downtown
Development Authority's Budget Estimate and has approved
appropriations as herein set forth; and
WHEREAS, the City Commission adopted Ordinance NO. 10796, on
September 27, 1990, appropriating one -sixth (1/6) of the Downtown
Development Authority's Fiscal Year 1990-1991 Budget representing
projected operating expenses for the two (2) month period of
October and November, 1990; and

WHEREAS, the City Commission adopted Ordinance NO. 10821, on
December 6, 1990, appropriating two -sixths (2/6) of the Downtown
Development Authority's Fiscal Year 1990-1991 Budget representing
projected operating expenses for the four (4) month period of
December 1990 and January, February, March of 1991; and
WHEREAS, the City Commission now desires to appropriate the
remaining projected budget requirements for the Fiscal Year 1990-
1991;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following appropriations for three -sixths
(3/6) of the Fiscal Year 1990-1991 Budget be, and the same are
hereby made, for the maintenance and for the purpose of financing
the operations and other legal and proper purposes of the
Downtown Development Authority of the City of Miami, Florida, to
wit:

Section 3. Said appropriations are the anticipated
expenditure requirements for the Downtown Development Authority
for the period April 1, 1991, to September 30, 1991, but are not
mandatory should efficient administration of the Downtown
Development Authority or altered economic conditions indicate
that a curtailment in certain expenditures is necessary. The
Executive Director of the Downtown Development Authority, with
approval of the Board of Directors of the Downtown Development
Authority, is specifically authorized to withhold any of these
appropriated funds from encumbrance or expenditure should such
action appear advantageous to the economical and efficient
operation of the Downtown Development Authority.
Section 4. The Executive Director of the Downtown
Development Authority, with the approval of the Board of
Directors of the Downtown Development Authority, is authorized to
make transfers between the detailed accounts comprising any of
the amounts appropriated by Section 2 hereof, in order that
available and required balance in any such account may be used
for other necessary and proper purposes.
Section 5. The Executive Director of the Downtown
Development Authority is hereby authorized to invite or advertise
for bids for the purpose of any material, equipment or services
embraced on the aforementioned appropriations, for which formal
bidding is required, such bids to be returnable as required by
law.
Section 6. This Ordinance shall be deemed supplemental and
in addition to the ordinance making appropriations for the Fiscal
Year ending September 30, 1991, for the operations of the City of
Miami.
Section 7. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 8. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 9. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety and property of the City of
Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debts, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of municipal affairs.
Section 10. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths (4/5) of the members of the City
Commission.
Section 11. This Ordinance shall become effective
immediately upon its adoption.

Recommendation
l It is respectfully. requested that the City Commission adopt an
Emergency Appropriations Ordinance, with Budget Amendment, for
the Downtown Development Authority for' the balance of the Fiscal
Year ending September 30, 1991.

At its September 27, 1990 meeting, the City Commission approved
the DDA Millage and Budget for the Fiscal Year .beginning October
1, 1990 and ending September 30, 1991.
At the same Commission Meeting, the City Commission approved an
Appropriations Ordinance for one -sixth (1/6) of the Fiscal Year
(October 1, 1990 to November 30, 1991).
The City Commission passed an Emergency Ordinance in December for
two -sixths (2/6) of the Fiscal Year; thereby requiring the DDA to
return to the City Commission for approval of an Appropriations
Ordinance for the balance of the Fiscal Year (April 1, 1991 to
September 30, 1991).
At its January 10, 1991 meeting, the City Commission deferred the
DDA Appropriations Ordinance for the balance of the Fiscal Year

ending September 30, 1991.
The attached Emergency Appropriations Ordinance for the balance
of the Fiscal Year ending September 30, 1991 is necessary for the
DDA to continue operations after the April 1, 1991 date. Because
of the required two readings, February and March, the Ordinance
would not go into effect until two weeks after the expiration of
the present Ordinance (30 days after passage).
In order for the DDA to continue operations without interruption
of its present programs, it is respectfully requested that the
City Commission adopt the attached Emergency Appropriations
Ordinance with Budget Amendment for the balance of the Fiscal
Year ending September 30, 1991.

RE: Propsed Changes To Fiscal Year 1991 Budget
As a result of the meeting with Vice -Mayor J. L. Plummer, Jr., it
is recommended that the DDA amend its Fiscal Year 1991 Budget by
adding $55,000 to Capital Projects/Marketing; $40,000 from
anticipated excess revenues from the Fiscal Year 1990 Tax
Collections and $15,000 from the Reserve Fund.
Also, it is recommended that $2,000 be transferred from Office
Supplies to Furniture and Equipment to cover more than estimated
expenditures.
It is recommended that the DDA Board pass Resolution 2/91 to
this effect.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE
CITY OF MIAMI AMENDING THE BUDGET OF THE
DOWNTOWN DEVELOPMENT AUTHORITY FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 1990 AND
ENDING SEPTEMBER 30, 1991.
WHEREAS, the Board of Directors of the Downtown Development
Authority of the City of Miami passed Resolution No. 20/90 on
August 10, 1990 adopting a Budget for the Fiscal Year beginning
October 1, 1990 and ending September 30, 1991; and
WHEREAS, the Board of Directors of the Downtown Development
Authority of the City of Miami passed Resolution No. 22/90 on
September 26, 1990 amending said Budget; and
WHEREAS, the Executive Director of the Downtown Development
Authority presented said Budget to the City of Miami Commission;
and
WHEREAS, the Board of Directors of the Downtown Development
Authority wishes to amend said Budget for the Fiscal Year
beginning October 1, 1990 and ending September 30, 1991.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Board of Directors of the Downtown
Development Authority of the City of Miami amends the Budget for
the Fiscal Year beginning October 1, 1990 and ending September
30, 1991 (See Attachment).
