ORDINANCE NO. 10829
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
CHANGING THE ZONING CLASSIFICATION FROM R-1
WITH SD-12 OVERLAY FOR LOT 25 LESS WEST 5'
AND LESS NORTH 201; LOTS 26-33 LESS NORTH
20'; R -3 WITH SD-12 OVERLAY FOR LOT 34, LESS
NORTH 20' AND C-1 FOR LOTS 1-23 AND LOT 24
LESS WEST 5' AND LOTS 35-37 AND LOT 38 LESS
NORTH 20', ALSO DESCRIBED AS ALL OF BLOCK 3,
TRAJUNE PARK AS RECORDED IN PLAT BOOK 14, AT
PAGE 12, OF THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, ALL TO C-2, AND BY MAKING
ALL THE NECESSARY CHANGES ON PAGE NO. 32 OF
SAID ZONING ATLAS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
May 21, 1990 Item No. 3, following an advertised hearing, adopted
Resolution No. ZB 47-90, by a nine to zero (9-0) vote,
RECOMMENDING APPROVAL of a change of zoning classification, as
hereinafter set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by changing the zoning classification from R-1
with SD-12 overlay for Lot 25 less West 5' and North 20'; Lots
26-33 less North 20'; R-3 with SD-12 overlay for Lot 34, less
North 20' and C-1 for Lots 1 -23 and Lot 24 less West 5' and Lots
35-37 and Lot 38 less North 20' also described as all of Block 3,
TRAJUNE PARK, as recorded in Plat Book 14, at Page 12, of the
Public Records of Dade County, Florida, all to C-2.

Section 2. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) is not contrary to the established land use pattern;
(c) will not create an isolated district unrelated to
adjacent and nearby districts;
(d) is not out of scale with the needs of the neighborhood
or the City;
(e) will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) is necessary due to changed or changing conditions;
(g) will not adversely influence living conditions in the
neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to adjacent
area;
(k) will not adversely affect property values in the
adjacent area;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 32 of the Zoning Atlas, made a part of
Ordinance No. 11000 as amended, by reference and description of
said Ordinance, is hereby amended to reflect the changes made
necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.

Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

RECOMMENDATIONS
PLANNING DEPARTMENT APPROVAL. The proposed change is contrary to
the Future Land Use Element of the Miami
Comprehensive Neighborhood Plan 1989-2000 (MCNP)
designation of Single Family Residential and

Restricted Commercial. 'There is a companion
item being presented to the Planning Advisory
Board, requesting a change in the land use
designation of the subject property to General
Commercial, which is being recommended for
approval by the Planning Department. Under the
new Zoning Ordinance 11000, the SD-12, Buffer
Overlay District would allow additional parking
for the principal use, with conditions that
prevent the negative impact in the area/ The
present zoning change request from RS-212, RG-
2/4, and CR-3/7 to CG-1/7 under Ordinance 9500
is acceptable. The subject property comprises a
portion of an established and growing automobile
dealership, since the early 50's, which now
requires an expansion of the facility to
accommodate continued business growth. The
requested CG-1/7 zoning district will allow new
and used vehicles sales. The applicant is
leaving a twenty foot (20') buffer to the north
of those lots facing NW 7th Street, and a f ive
foot W ) buffer to the west of those lots
facing NW 43rd Avenue that will prevent the non-
restricted commercial expansion. The proposed
change to CG-1/7 would be consistent with the
existing and future land use patterns in the
area and would not pose a negative impact on the
surrounding area.

RE: APPLICATION FOR AMENDMENT TO ZONING ATLAS.
9. The application encompasses four separate zoning classifications
on the property described as Block 3 of TRAJEUNE PARK SUBDIVISION,
which, of course, creates a collage zoning and a lack of
cohesiveness for any intended use. As the primary utilization of
this property commencing with the purchase of the dealership from
Thiel Chevrolet back in the early 19501s by Anthony R. Abraham, has
been automobile new car dealership and related businesses, it would
seem reasonable and feasible that classifications of zoning be
uniform to allow its continued use and the highest utilization of
the properties contained within the application. The abutting
residential uses, although most are utilized for parking under
variances granted by the City at one time or another, are totally
uncompatible with the dealership related use fronting LeJeune Road
and S.W. Sth Street. Those neighbors exposed to the dealership
during the courses of the ownership of Mr. Abraham from his
original purchase in 1953, and subsequent sales to Dumas Milner and
Jim Gilmore, and re -purchase of same, are fully aware that he takes
great personal pride in maintaining the premises to its highest
standard of display and compatibility to the neighborhood. The
purpose of this application is to unify the zoning to allow GC-1
use, at at the same time protecting the integrity of the
neighborhood by not rezoning the 20 foot buffer fronting on S.W.
7th Street, thereby protecting the neighborhood by not allowing any
development on that area, nor any right of ingress or egress to
S.W. 7th Street. This dealership has developed from a small city
dealership in 1953 to a major dealership, which at one time was the
number 1 Chevrolet dealership in the world. The demands of
Chevrolet Division of General•Motars to continue the updating and
beautification of the dealership require major expenditures which
would be unpractical unless the property could be developed to its
highest and best use, which can only be obtained by the re-
classification of the zoning in the manner requested.
10. Since the ownership of the properties has now been
consolidated, changing and unifying the existing zoning uses from
RS 2/2, RG 2/4, CR 2/7 and CR 3/7, to one unified zoning of CG 1/7,
would bring the entire parcel into conformance with the existing
long standing dealership enterprise, since approximately 1950, and
at the same time bring a stabilizing cohesiveness to the immediate
area, benefiting not only the applicant, but also the City and the
immediate neighbors. The unification of zoning would allow a more
beneficial and competent use of the property by the existing
enterprise, allowing its planned development that would further
enhance, not only the dealership purposes, but the surrounding
residential neighbors. The changing neighborhood character as
evidenced in the Official Zoning Atlas, Page No. 32, further
identifies the extensive expanded classifications of this entire
area.

*It is impractical and illogical to continue the uses permitted
since the entire block, for the first time, is assembled under a
single ownership and it makes good sense at this time to identify
the entire sight with a land use designation which allows the
automobile dealership use which has existed on this sight for
approximately the past forty years. Because of the contradiction
in the zoning for the use of this dealership and the restriction
as to its continued growth within the confines and description -'`of
the properties defined on this Application, it appears obvious that
it should be unified under a single classification for the use that
has been ongoing for the stated period.

property fronting on the rear of the dealership property to the
neighborhood residences located on S.W. 7th Street, east of 42nd
Avenue. The applicant's history in -taking every effort to co -exist
with his good neighbors is documented. Given the opportunity to
continue the use of the properties which are the subject matter of
this Application, the neighborhood can rest assured that Mr.
Abraham will do everything within his power to compliment, not only
the dealership, but its surrounding neighborhood.
