I-�g�0 A RESOLUTION RATIFYING THE AWARD MADE TO KOSTMAYER CONSTRUCTION COMPANY IN THE AMOUNT OF $282,750, TO OPERATE THREE (3) BURN CONTROLLED UNITS AT THE CITY'S VIRGINIA KEY FACILITY FOR A ONE -MONTH PERIOD, TO DISPOSE OF DEBRIS IN THE WAKE OF HURRICANE ANDREW. WHEREAS, on September 10, 1992, the City Commission passed Resolution No. 92-551, waiving formal competitive bids for the acquisition of services, equipment, goods and/or materials as required in the aftermath of Hurricane Andrew; and WHEREAS, said resolution allowed the City Manager to proceed to make necessary purchases without express City Commission approval, where contracts or awards do not exceed $150,000; and WHEREAS, it was determined that the most efficient manner of disposing of the large volumes of tree and vegetative debris generated by Hurricane Andrew was to initiate burn sites; and WHEREAS, after requesting, receiving and awarding an informal bid for this service, the low bidder's services were terminated for unsatisfactory performance; WHEREAS, Kostmayer Construction Company's Virginia Key is in compliance with Metro operation at Dade County CITY COMMISSION MEETING OF D E C 1 0 1992 Resolution No, 92-- 7y8 env.i_.roTillie nta 1 standards and will cost: $700 less pei. unit- than making an award to the second lowest bidder; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF' THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The award to Kostmayer Construction Company, in. to operate three burn controlled units at Virginia Key the amount of $282, 750/ is hereby ratified and approved. for one -month, Section 3. City Manager SU[1EC:T Ratification for the Award of Air -Controlled Burn Units REFERENCES ENCLOSURES It is respectfully recommended that the City Commission adopt the attached resolution ratifying the award to Kostmayer Construction Company (Kostmayer), in the amount of $282,750 for a one -month period, and for any additional period as deemed necessary under the existing price and conditions, to operate three (3) air - controlled burn units to eliminate the large volume of debris collected from City streets after Hurricane Andrew and being stored at City's Virginia Key facility. The Department of General Services Administration and Solid Waste let out informal bids for the above service and ten (10) bids were submitted, under Bid No. HA 005. Subsequently an award was made to the low bidder, the Lowell Dunn Company. However, after setting up operations, the company's performance was deemed unsatisfactory and not in accordance with Dade County's Department of Environmental Regulations (DERM) standards. Therefore, the City terminated Lowell Dunn's services. Kostmayer has been operating two (2) burn units on the same site and is the only firm which is operating in compliance with the County's standards; however, the two units are insufficient to handle the volume of debris burning that still remains at Virginia Key, as well as the debris still being collected from City streets. Since the price originally quoted by Kostmayer in its initial quotation to the City is approximately $700 lower per burn unit than the second lowest bidder under HA 005, it seems appropriate, more cost effective and efficient to expand and continue the t services of Kostmayer Construction Company, under the existing price and conditions. Od REFERENCES City Manage '•'; ENCLOSURES. On August 24, 1992, the City of Miami suffered the wrath of a devastating hurricane, Hurricane Andrew. in order to eliminate immediate threats to the life, health and safety of residents and employees, and eliminate immediate threats to undamaged property, as well as ensure economic recovery to the City and the community, I have made a written finding of a valid public emergency. Based on this finding, formal competitive sealed bid and selection procedures will be waived for the procurement of services, equipment, goods and/or materials that may be required to provide immediate burden relief and disaster assistance for the City and the community for the purpose of providing for the health, safety and welfare of its citizens and employees. In addition, the City's insurance will not cover any loss of business resulting from delays in the normal procurement procedures; therefore, it is necessary to waive formal competitive bid and selection procedures and utilize the informal bid process instead. y2-~ 798 �
