BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby officially accepts the attached City Clerk's Certification and Declaration of the results of the Special Municipal Election held on November 3, 1992, in which a charter amendment increasing the Off -Street Parking Board from five (5) to seven (7) members, of which one additional member is to be a City Commissioner who will serve ex officio, without compensation, as a voting chairperson and the seventh member is to be appointed by the City Commission, was disapproved by the electorate. Section 2. This Resolution shall become effective immediately upon its adoption. PUBLIC LOGIC AND ACCURACY TEST CERTIFICATION OF THE PRECINCT AND ABSENTEE BALLOT COUNTS 1. On October 30, 1992 commencing -at approximately 9:30 A.M. the Dade County Supervisor of Elections had the tabulating equipment based in the Elections Department at the Metro -Dade Center tested to ascertain that the equipment would correctly count the precinct and absentee ballot votes cast for all candidates and questions including those for the municipalities of Florida City, Key Biscayne, Miami, Miami Beach, North Bay Village, North Miami, and Opa-locka. 2. Test results were compared with the predetermined totals for each candidate and issue and, pursuant to the requirements established in Section 101.5612, Florida Statutes, the performance and results of all required tests were- observed and the correctness of the program, precinct header cards and test ballots, as well as any replacement. of said materials required by said tests, were verified. 3`. At the completion of this public logic and accuracy test, the verified logic and accuracy report, HUB console loge -program microdisk (seal 8519), and test ballots with precinct header cards, were placed in the custody of the Supervisor of Elections under seal number 8319. 1 92— 767 II. LOGIC AND ACCURACY TEST CERTIFICATION OF THE PRE- AND POST - PRECINCT AND ABSENTEE BALLOT COUNT 4. On November 3, 1992, commencing at approximately 3:00 P.M., the Dade County Supervisor of Elections had the tabulating equipment based in the Elections Department at the Metro Dade Center tested to ascertain that the equipment would correctly count the precinct and absentee ballot votes cast for all candidates and questions including those for the municipalities of Florida City, Key Biscayne, Miami, Miami Beach, North Bay Village, North Miami, and Opa-locks. Seal number 8319 used to secure the testing materials and seal 8519, used to seal the program microdisk, were broken in the presence of Dade County and City of Miami representatives and the contents were used following the procedures of paragraph (2), above, to complete this pre -count logic and accuracy test. 5. At the completion of this pre -count logic and accuracy test, all precinct ballots cast were counted. Except as otherwise specifically set forth and declared in this Certification, in our presence and sight, no ballot card was removed from or added to any ballot card container, ballot card tray or other segregation of ballots, and no ballot card was in any manner altered or tampered with by any person, and no person touched any ballot card container, ballot card tray or ballot card except the person authorized to do so pursuant to Section 101.5614, Florida Statutes. 6. At the completion of the precinct and absentee ballot count, the automatic tabulating equipment was again tested to ascertain that the equipment correctly counted the precinct and absentee votes cast for all candidates and questions including those for the municipalities of Florida City, Key Biscayne, Miami, Miami Beach, North Bay Village, North Miami, and Opa-locks. 7. At the completion of this post -count logic and accuracy test, all voted ballots with their precinct header cards and duplicated and spoiled ballots were stored in card cabinets under seal numbers A8049, B8173, C8179, D80810 E82319 F8222, G8102, H81089 I8132, J80129 K80809 L81289 M8011, N8036, 08467, R8672. In a cabinet under seal number 0008090, were stored the verified logic b accuracy report, HUB console log, program microdisk (seal 0008371), and the test ballots with precinct header cards.
