HomeMy WebLinkAboutR-92-0733RESOLUTION NO. r► n — ?i Q i A RESOLUTION APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST OF TRANSAMERICA REHAB CORPORATION, IN CONNECTION WITH BID NO. HA 005, TO PROVIDE DEBRIS DISPOSAL BURN UNITS, AS IT HAS BEEN DETERMINED TO BE WITHOUT MERIT. WHEREAS, on October 1, 1992, the City of Miami solicited informal bids to provide debris disposal burn units; and WHEREAS, on October 2, 1992, the City of Miami received ten (10) responses to said bid; and WHEREAS, after review, the City recommended for award The Lowell Dunn Company, as the lowest bidder; and WHEREAS, on June 11, 1992, Transamerica Rehab Corporation, one of the bidders, protested said recommendation for award; and WHEREAS, the Chief Procurement Officer, pursuant to Section 18-56.1 of the City Code, in her role as arbiter, investigated the matter and determined that Transamerica Rehab Corporation's protest was without merit and has rejected the protest; and WHEREAS, the City Manager and the City Attorney concur with and approve the finding of the Chief Procurement Officer and recommend rejection of the protest filed by Transamerica Rehab Corporation; CITY COMMISSION MEETING OF NOV 1 2 1392 Resolution No. 82- f� NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, PLORIDAt Section 1. The recitals 'and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Chief Procurement Officer's decision to reject the protest from Transamerica Rehab Corporation, in connection with Bid No. HA 005, for debris disposal burn units, is hereby approved. Section 3. Odio City Manager ENCLOSURES: RECOMMENDATION it is respectfully recommended that the City Commission adopt the attached resolution approving the Chief Procurement Officer's decision to reject Transamerica Rehab Corporation's protest, in connection with Bid No. HA 005, to provide debris disposal burn units to the City of Miami. BACKGROUND On October 21 1992, ten (10) bidders responded to the City's informal bid for the above noted service. City staff evaluated the bids and determined that the bid that the lowest bid was received from The Lowell Dunn Company. This vendor was recommended for award of contract. Transamerica Rehab Corporation, one of the bidders, protested this recommendation for award. Pursuant to Section 18-56.1 of the City Code, the Chief Procurement Officer investigated the matter and determined that the protest lacked merit, as detailed in the attached letter. Bayshore Drive Coconut Grove, FL 33133 Dear Mr. Infante: As Chief Procurement Officer of the City of Miami, I received your protest dated October 8, 1992, reviewed pertinent documents, talked with employees and researched the issues, pursuant to my duties under Section 18-56.1, City of Miami Code, Resolution of Protest Solicitations and -Awards. The following is submitted in response to your protest letter, regarding Bid No. HA 005 for Debris Disposal Burn Unit(s). You state that the bid submitted by your company, in terms of production and cost, is superior to bids submitted by the two lower bidders. City of Miami staff evaluated the bids and determined that the low bidder, The Lowell Dunn Company, could perform the job as outlined in its bid. In addition, the City's interest is sufficiently protected by the bid's requirement for the furnishing of a performance and payment bond. The onus is therefore on the successful vendor to perform the work required. The burn equipment proposed for use by Allstar Builders Corporation cannot effectively and efficiently perform the required tasks, according to your protest letter. The City will not be requiring the services of Allstar Builders at the present time. Based on the foregoing, I am rejecting your protest. The City Manager and the City Attorney have approved my decision. You will be notified when the protest will be scheduled for the City Commission agenda. Sincerely, Judy S. Smith Enterprises, submitted a cnnt per unit per month amount higher than the other bidders, our production for thirty ( 30 ) day cycle and our cost per ton were far superior in both categories. Smith Enterprises submitted a bid on the above referenced project. In order to assist in further evaluating our Price versus Production the following information should be taken into consideration: Company Cost per Unit Production Cost Name per month per Unit/30 Days per Ton T.R.C. $98,900 26.100 3.79 /Johnny F. Smith All Star $94,950 15.000 T. 6.33 Lowell Dunn $85,680 15.000 T. 5.71 Our burn units will operate for 22 hours per day, because of our environmentally safe and approved cleaning system (hydro system). For your information and further evaluation we attached an environmental information sheet and references from the Department of Environmental Regulation (DER). Our unit the ABC Destructor has a four cylinder, John Deere diesel engine with turbo. The ABC Destruction burns with complete combustion it has the bell air system, making it 35% more efficient than any other comparable machine in the market today. Our unit is located safely 40 feet from the fire or heat path. Our unit can be charged from both sides because there is no obstruction from the air pipe or manifold, as there is no "T" in the way. Additionally, there are other items in the Bids that need to be addressed. The "All -Star" Bid has only a Rubber -Tire backhoe with buckets as available. There is no way that this type of equipment with a Bucket can load debris -into the fire with any degree of consistency and safety. The "Dunn" Bid did not include a bulldozer, which was a minimum requirement of your Specifications.
