A RESOLUTION RELATED TO THE 30TH ANNIVERSARY
COCONUT GROVE ARTS FESTIVAL TO BE CONDUCTED
BY THE COCONUT GROVE ASSOCIATION, INC., ON
FEBRUARY 13, 14 AND 15, 1993 IN PEACOCK AND
MEYERS PARKS VICINITY; AUTHORIZING THE
CLOSURE OF DESIGNATED STREETS TO THROUGH
VEHICULAR TRAFFIC; ESTABLISHING A TEMPORARY
PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF
PERMITS BY THE DEPARTMENTS OF POLICE AND
FIRE, RESCUE AND INSPECTION SERVICES; FURTHER
ESTABLISHING AN AREA PROHIBITED TO RETAIL
PEDDLERS DURING THE PERIOD OF SAID EVENT;
AUTHORIZING A THREE-DAY PERMIT FOR THE SALE
OF BEER AND WINE SUBJECT TO THE ISSUANCE OF
ALL PERMITS REQUIRED BY LAW DURING THE EVENT;
CONDITIONED UPON THE ORGANIZERS PAYING FOR
THE NECESSARY COSTS OF CITY SERVICES AND
APPLICABLE FEES ASSOCIATED WITH SAID EVENT
AND UPON THE ORGANIZERS OBTAINING INSURANCE
TO PROTECT THE CITY IN THE AMOUNT AS
PRESCRIBED BY THE CITY MANAGER OR HIS
DESIGNEE.
WHEREAS, the Coconut Grove Association, Inc. will conduct
the 29th Coconut Grove Arts Festival on February 13, 14 and 15,
1993; and
WHEREAS, in order to establish a temporary pedestrian mall
and insure the safety of participants and pedestrians attending
this event, certain streets shall be closed to through vehicular
traffic during specified dates and hours; and
WHEREAS, the Coconut Grove Association, Inc. has requested
authorization for a three-day permit to sell beer and wine in
connection with said event and the restriction of peddlers in the
area of the event; and

WHEREAS, the restriction imposed by Ordinance No. 10764 as
to the limitation of the number of events in the Coconut Grove
Special Events District does not apply to the Coconut Grove Arts
Festival since thia event has been held in the past in the
Coconut Grove area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. In order to effectuate safe passage and
establish a temporary pedestrian mall during the 30th Anniversary
Coconut Grove Arts Festival to be conducted by the Coconut Grove
Association, Inc., the following streets are hereby closed to
through vehicular traffic from 10:00 P.M. on Friday, February 12,
1993 through 9:00 P.M. on Monday, February 15, 1993:
South Bayshore Drive from Charthouse Drive to McFarlane
Road.
Main Highway from Charles Avenue to McFarlane Road.
McFarlane Road from South Bayshore Drive to Grand Avenue.
Grand Avenue from McDonald Street to Mary Street.
Included in the herein closure are all streets,
avenues, alleys, ways and thoroughfares which intersect
the enumerated areas delineated in this Section.
Section 2. Such closing of streets is subject to State
approval and issuance of permits by the Departments of Police and
Fire, Rescue and Inspection Services. Said permit from the
Department of Police is to be issued upon full approval of the
Chief of Police after giving all due consideration to the safety

and traffic needs to residents, businesses and religious
institutions in the area for entering and Crossing through said
arterials and upon the favorable exercise of the City Manager's
judgement predicated upon all factors set forth herein.
Section 3. Pursuant to Section 39-13 of the City Code, all
retail peddlers' occupational licenses issued under the
provisions of Chapter 31 of the City Code, as amended, will not
be valid on February 13, 14 and 15, 1993, during the hours
described in Section 1 hereof and in the area of the public
right-of-way included within and adjoining the streets and
avenues described in Section 1 hereof, for two blocks in all
directions.
Section 4. Upon the issuance of a temporary permit by the
Florida Department of Business Regulation, Division of Alcoholic
Beverages and Tobacco, to sell beer and wine, and pursuant to
City Code 54-12.1, the request of the organizers to sell beer and
wine for a three-day period in connection with the Coconut Grove
Arts Festival on February 13, 14 and 15, 1993, is hereby granted
in compliance with Ordinance No. 9777, further subject to the
issuance of all permits required by law.
Section 5. The herein approvals and authorizations are
hereby conditioned upon the organizers paying for all necessary
costs of City services and applicable fees associated with said
event and obtaining insurance to protect the City in the amount
as prescribed by the City Manager or his designee.

Section 6. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing street closures, the sale of beer
and wine and the restriction of retail peddlers in the area of
Coconut Grove in connection with the 30th Anniversary Coconut Grove
Arts Festival to be conducted by the Coconut Grove Association,
Inc. on February 13, 14 and 15, 1993, subject to the issuance of
permits by the Departments of Police and Fire, Rescue and
Inspection Services. This authorization is further conditioned
upon the organizers paying for any costs of City services and
applicable fees and the requirement that the City will be insured
against any potential liability.
BACKGROUND:
The Department of Community Development has prepared the
appropriate legislation which authorizes the closure of certain
streets, the sale of beer and wine and the restriction of retail
peddlers in the area of Coconut Grove on February 13, 14 and 15,
1993 for the 30th Anniversary Coconut Grove Arts Festival. This is
a three-day visual, performing and culinary arts festival with free
outdoor music performances. Three hundred artists and craftmen
exhibit their work in a juried art show.
The limitations on the number of events in the Coconut Grove
Special Events District do not apply in this case, since the
aforementioned event has been held in the Grove in the past.
