RESOLUTION NO. 9 2_ 705
A RESOLUTION RELATED TO THE TENTH ANNUAL
TASTE OF THE GROVE TO BE CONDUCTED BY THE
TASTE OF THE GROVE COMMITTEE, ON
JANUARY 16-17, 1993; AUTHORIZING THE CLOSURE
OF DESIGNATED STREETS TO THROUGH VEHICULAR
TRAFFIC SUBJECT TO THE ISSUANCE OF PERMITS BY
THE DEPARTMENTS OF POLICE AND FIRE, RESCUE
AND INSPECTION SERVICES; AUTHORIZING A TWO-
DAY PERMIT TO SELL BEER AND WINE IN
CONNECTION WITH SAID EVENT SUBJECT TO THE
ISSUANCE OF ALL PERMITS REQUIRED BY LAW;
ESTABLISHING AN AREA PROHIBITED TO NON -
FESTIVAL RETAIL PEDDLERS DURING THE PERIOD OF
SAID EVENT; CONDITIONING ALL APPROVALS AND
AUTHORIZATIONS HEREIN UPON THE ORGANIZERS
PAYING FOR ALL THE NECESSARY COSTS OF CITY
SERVICES AND APPLICABLE FEES ASSOCIATED WITH
SAID EVENT AND OBTAINING INSURANCE TO PROTECT
THE CITY IN THE AMOUNT PRESCRIBED BY THE CITY
MANAGER OR HIS DESIGNEE.
WHEREAS, the Taste of the Grove Committee will conduct the
Tenth Annual Taste of the Grove on January 16-17, 1993; and
WHEREAS, certain streets shall be closed to through
vehicular traffic during specified dates and hours to insure the
safety of the participants and pedestrians attending this event;
and
WHEREAS, the Taste of the Grove Committee has requested
permission to sell beer and wine for a two-day period in
connection with the Taste of the Grove Festival on Saturday,
January 16, 1993 and Sunday, January 17, 1993; and

WHEREAS, the Taste of the Grove Committee has requested that
retail peddlers be restricted within the specified area of the
event for a specific period of time during the festival; and
WHEREAS, the restriction imposed by Ordinance No. 10764 as
r to the limitation of the number of events in the Coconut Grove
Special Events District does not apply to the Taste of the Grove
Festival, since this event has been held previously in the
Coconut Grove area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. In the interest of safety during the Taste of
the Grove Festival, to be conducted by the Taste of the Grove
Committee, the following streets are hereby closed to through
vehicular traffic from 12:00 midnight Friday, January 15 through
12:00 midnight Sunday, January 17, 1993:
McFarlane Road from South Bayshore Drive to Main Highway.
South Bayshore Drive from McFarlane Road to Mary Street.
Included in the herein closure are all streets, avenues,
alleys, ways and thoroughfares which intersect the
enumerated areas delineated in this Section.
Section 2. Such closing of streets is subject to State
approval and the issuance of permits by the Departments of Police
and Fire, Rescue and Inspection Services. Said permit from the
Department of Police is to be issued upon the full approval of
the Chief of Police after giving all due consideration to the
safety and traffic needs of residents, businesses and religious

institutions in the area for entering and crossing through said
arterials and upon the favorable exercise of the City Manager's
judgement predicated upon all factors set forth herein.

Section 3. Upon the issuance of a temporary permit by the
Florida Department of Business Regulation, Division of Alcoholic
Beverages and Tobacco, to sell beer and wine, and pursuant to
City Code 54-12.1, the request of the organizers to sell beer and
wine for a two-day period in connection with the Taste of the
Grove Festival on January 16-17, 1993, is hereby granted subject
to the issuance of all permits required by law.
Section 4. Pursuant to Section 39-13 of the City Code, all
retail peddlers' occupational licenses issued under the
provisions of Chapter 31 of the City Code, as amended, will not
be applicable or valid on January 16-17, 1993, during the hours
described in Section 1 hereof and in the area of the public
right-of-way included within and adjoining the streets and
avenues described in Section 1 hereof, for two blocks in all
directions.
Section 5. The herein approvals and authorizations are
hereby conditioned upon the organizers paying for all necessary
costs of City services and applicable fees associated with said
event and obtaining insurance to protect the City in the amount
as prescribed by the City Manager or his designee.
Section 6. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the necessary street closures
establishing a pedestrian mall, the restriction of non -festival
retail peddlers and a two-day permit to sell beer and wine in
connection with the Tenth Annual Taste of the Grove to be conducted

by the Taste of the Grove Committee on Saturday and Sunday, January
16-17, 1993. The street closures are subject to the issuance of
all permits required by law and compliance with such conditions and
limitations as prescribed by the City of Miami. These
authorizations are conditioned upon the organizers paying for any
costs of City services and subject to the organizers obtaining
insurance to protect the City in the amount as prescribed by the
City Manager or his designee. r

BACKGROUND:
The Department of Community Development has prepared the
appropriate legislation in connection with the Tenth Annual Taste
of the Grove to be conducted on January 16-17, 1993. The Taste of
the Grove Committee has met with the Special Events Committee to
discuss the event.
The limitations on the number of events in the Coconut Grove
Special Events District do not apply in this case, since the
aforementioned event has been held in the Grove in the past.
