A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING THE JACKSON MEMORIAL HOSPITAL PARKING GARAGE MAJOR USE SPECIAL PERMIT, AT APPROXIMATELY NORTHWEST 18TH STREET BETWEEN BOB HOPE DRIVE AND NORTHWEST 8TH AVENUE (MORE PARTICULARLY DESCRIBED HEREIN), PURSUANT TO AN APPLICATION FOR MAJOR USE SPECIAL PERMIT PROPOSED BY THE PUBLIC HEALTH TRUST OF DADE COUNTY; APPROVING SAID MAJOR USE SPECIAL PERMIT AFTER CONSIDERING THE REPORT AND RECOMMENDATIONS OF THE CITY OF MIAMI PLANNING ADVISORY BOARD, SUBJECT TO THE CONDITIONS OF DEVELOPMENT ORDER ATTACHED HERETO AS EXHIBIT "A", THE APPLICATION FOR DEVELOPMENT APPROVAL INCORPORATED HEREIN BY REFERENCE; MAKING FINDINGS OF FACT AND CONCLUSIONS OF LAW; PROVIDING THAT THE DEVELOPMENT ORDER SHALL BE BINDING ON THE -APPLICANT AND SUCCESSORS IN INTEREST; PROVIDING FOR AN EFFECTIVE DATE; DIRECTING THE CITY MANAGER TO TAKE ALL ACTIONS NECESSARY TO FULFILL THE CITY'S OBLIGATIONS UNDER THE DEVELOPMENT ORDER; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, on September 14, 1992, the Public Health Trust submitted a complete Application for Major Use Special Permit for a 1,522-parking space garage pursuant to Article 17 of Zoning Ordinance No. 11000, for that parcel on Northwest 18th Street between Bob Hope Drive and Northwest 8th Avenue, as legally described in the Development Order attached hereto; and ATTACHMENT (S)I CONTAINED CITY COMMISSION MEETING OF OCT 2 2 1992 RswlutWn No. 92- 687 WHEREAS, the Miami Planning Advisory Board, at its meeting held on October 14, 1992, Item No. 1, following an advertised public hearing, adopted Resolution No. PAS 34-92 by a 9 to 0 vote, RECOMMENDING APPROVAL of the Major Use Special Permit Development Order as attached hereto; and WHEREAS, on October 22, 1992, the City Commission conducted an advertised public hearing to consider the Application for Major Use Special Permit determined that all requirements of notice and other legal requirements for the issuance of the proposed Major Use Special Permit Development Order had been complied with; and WHEREAS, the City Commission deems it advisable and in the best interest of the general welfare of the City of Miami to issue a Major Use Special Permit Development Order as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Findings of Fact and Conclusions of Law are made with respect to the Project as described in the Development Order for the Jackson Memorial Hospital Parking Garage, also known as the "Highland Parking Garage," which is attached hereto as Exhibit "A" and made a part hereof by reference, as. more particularly described in Exhibit "A". Section 2. The Major Use Special Permit Development Order for the Jackson Memorial Hospital Parking Garage, (Exhibit "A"), is hereby granted and issued. -2- 92- 687 Section 3. The City Manager is hereby directed to take all actions necessary to fulfill the City's obligations under the terms of the Development Order (Exhibit "A"). Section 4. In the event that any portion or section of this Resolution or the Development Order (Exhibit "A") is determined to be invalid, illegal, or unconstitutional by a court or agency of competent jurisdiction, such decision shall in no manner affect the remaining portions of this Resolution or Development Order (Exhibit "A"), which shall remain in full force and effect. Section 5. The effective date of this development order shall be thirty (30) days from date of adoption hereof; provided, however, that if the development order is appealed, the development order will take effect on the day .after all appeals have been withdrawn or resolved. Section 6. This Resolution shall become effective immediately upon its adoption. FINDINGS OF FACT NAME OF DEVELOPMENT: The Jackson Memorial Hospital Parking Garage NAME OF DEVELOPER: The Public Health Trust of Dade County AUTHORIZED AGENT OF DEVELOPER: Augusto Maxwell PROJECT DESCRIPTION: The Highland Parking Structure will be located on approximately 1.9 acres in the area known as the Jackson Memorial Hospital Complex in the City of Miami. The site is located on the north side of N.W. 18th Street between Bob Hope Boulevard and N.W. 8th Avenue. Major access roads to the site include N.W. 20th Street; N.W. 7th Avenue, and S.R. 836. The Highland Parking Structure satisfies long-term strategies identified in the Jackson Memorial Hospital Medical Center Master -2- 92- 687 � a Plan for organized development of the Medical Center. The building provides 1,522 new parking spaces along the eastern periphery of the Medical complex, saving available land in the core of the hospital complex for development of medical facilities. Traffic circulation is centered along Bob Hope Boulevard, a major arterial street, promoting a smooth flow of traffic in the Medical Complex. A pedestrian/vehicular bridge at the second level provides access for overflow parking from an existing parking structure located at the southwest corner of Bob Hope Boulevard and Northwest 18th Street. The bridge provides a safer route over Bob Hope Boulevard to the Medical Complex. Retail/commercial and office space is organized within the building to soften the impact of the structure on the existing neighborhood and promote pedestrian activity along surface streets. Retail/commercial space will be constructed on the lower level of the building facing Northwest 18th Street. Shops will face a paved, landscaped pedestrian concourse, promoting street level activity. Office space will be constructed facing Bob Hope Boulevard. Proposed development by use and area includes the following maximum development intensity: Office (sq. ft.) a maximum of 85,000 Retail/Commercial (sq. ft.) a maximum of 32,950 Parking Garage (sq. ft.) a maximum of 511400 (Parking Spaces a maximum of 1,522) The project conforms to the requirements of Zoning Districts G/I Government Institutional and SD-10 the Jackson Memorial Hospital Medical Center Overlay District as contained in Zoning Ordinance 11000; a zoning variance for reduction of front setback on N.W. 8th Avenue (10 feet required, 0 feet provided) has been approved by the Zoning Board and no special exceptions are contemplated for execution of this project. The comprehensive plan future land use designation for the parcel is Major Public Facilities, Transportation and Utilities which allows the proposed parking to serve adjacent medical facilities and office/retail mixed -use. The project also reflects suggestions received at the Miami Large Scale Development committee meeting of July 7, 1992. The project will be constructed substantially in accordance with plans and design schematics on file prepared by Heery Architects & Engineers, Inc. dated July 1992. THE APPLICANT, ITS SUCCESSORS, AND/OR ASSIGNS, JOINTLY OR SEVERALLY, SHALL: 1. Meet all applicable building codes, land development regulations, ordinances and other laws. 2. Work with the City of Miami Public Works Department and the Law Department to amend the Code of the City of Miami to permit the installation of private vehicular bridges over the public right-of-way and to secure all necessary -4- 92- 687 agreements for the bridge structure that may be required by the City Commission including hold harmless clauses releasing the City of Miami from any liability for damage or injury sustained on Bob Hope Boulevard as a result of construction of the overhead vehicular bridge. 3. Incorporate into design plans twenty-five (25) foot visibility triangles at street intersections and ten (10) foot visibility triangles at all driveway exits as required by zoning Ordinance 11000, Section 908.11. In addition, locate all driveways a minimum of five (5) feet from the side lot line where they cross the base building line as required by "Off -Street Guides and Standards". 4. Coordinate with Dade County Public Works Department all modifications to the existing traffic signalization at the intersection of Bob Hope Boulevard and N.W. 18th Street made necessary as a result of the construction of the vehicular bridge over the intersection including traffic signals, control boxes and subsurface wiring. 5. Prior to issuance of a building permit, provide a letter from the Florida Department of Community Affairs stating that the project does not meet the threshold of a Development of Regional Impact as defined by the state. 6. Prior to issuance of a building permit, allow the Miami Police Department to conduct a security survey, at the option of the Department, and make recommendations concerning security measures and systems. Submit a report to the Planning Department, prior to commencement of construction, demonstrating how the Police Department recommendations, if any, have been incorporated into the project security and construction plans, or demonstrate to the Planning Director how such recommendations are impractical. 7. Within six (6) months from the issuance of the Major Use Special Permit, provide a letter indicating coordination with members of the Fire Plan Review Section to discuss the scope of the project, owner responsibility, building development process and review procedures, as well as specific requirements for fire protection and life safety systems, exiting, vehicular access and water supply. " 8. Within six 6 months from the issuance of the Major Use Special Permit, provide a letter assuring that the Jackson Parking Garage and office/retail development has addressed all concerns of the Solid Waste Department. 9. Within six (6) months from the issuance of the Major Use Special Permit, provide a letter assuring that the Jackson Parking Garage and office/retail development has addressed all concerns of the Southern Bell. M '-5- 92- 687 10. Revise design plans to show a connection to an existing 8- inch water main along N.W. 18th Street abutting the property if fire flows can be met . If not, show connection to an existing 24-inch water main at N.W. loth Avenue. Revise design plans to show a connection to an existing gravity sewer main at N.W. 8th Avenue abutting the property. 11. Incorporate the following into the project design and operation to minimize the cumulative adverse regional impact of the project, its traffic and associated pollutant emissions on air quality; a. Actively encourage and promote ridesharing by establishing a car and van pool information program; b. Provide local and regional mass transit route and schedule information in convenient locations throughout the project, including office complex lobbies and within and adjacent to retail areas; c. Encourage transit use by provision of bus shelters, development of turnout lanes, or provision of other amenities to increase ridership; and d. Provide on -site bicycle storage facilities to encourage use of alternative modes of transportation. 12. Prior to the issuance of a building permit, provide a complete directional signage concept plan specifying the location and design of all signage directing traffic flow into, within and out of the parking garage. 13. For the purposes of water conservation, utilize low water use plumbing fixtures, self -closing and/or metered faucets, and other water conserving devices. 14. Incorporate the use of water sensors and other low water volume landscape irrigation techniques to reduce the project demand on the region's potable water supply. 15. Designate gratis space in design plans of the roof for a communications antenna and supporting structure for the City's emergency and general government communications system, including sufficient space near/under the roof for necessary support equipment. The applicant and City must mutually agree to the location, number and size of any such equipment, installation or space designation. Such aerials, antennas and appurtenances will be installed and maintained at the expense of the City of Miami. The applicant will retain the right of architectural review and approval, which shall not be unreasonably withheld. Applicant, however, reserves the right to reject the installation of equipment that requires additional structural support under the roof system. -6- 92- 687 16. If, in the future, daycare is to be included in the project and is located in space above the second floor, prior to commencement of construction of the project, submit a letter of approval from the State of Florida Department of Health and Rehabilitative Services for the location of a day care facility and submit detailed plans. If located elsewhere on the subject property, then submit detailed plans for the proposed day care center to the City of Miami. Section 936.5 of Zoning Ordinance 11000 requires outdoor play area of a minimum size of 400 square feet or 45 square feet per child, whichever is greater and the National Fire Protection Association (N.F.P.A.) 101 Life Safety Code requires a minimum of thirty-five (35) square feet per child of indoor floor area; design plans for the day care facility shall be revised to accommodate these minimum requirements. Within twenty-four (24) months from approval of a certificate of occupancy or when the building is 50% occupied, whichever comes first, ensure that a day care center is open during normal work week hours and continuously operating with a minimum capacity for one hundred (100) children, unless the Planning Advisory Board relieves the Applicant of all or part of such requirements upon a showing that there is insufficient demand to justify the operation of such day care facility. 17. Record, within 30 days of the effective date of the development order, notice of the adoption of the development order with the Clerk of the Dade County Circuit Court pursuant to Section 380.06(15), F.S., specifying that the development order runs with the land and is binding on the applicant, its successors, and assigns, jointly or severally. 18. Prepare a Minority Participation and Employment Plan to be submitted within ninety (90) days of the issuance of this Major Use Special Permit; it being understood that the City's Minority/Women Business Affairs and Procurement Ordinance 10538 is a guide. 19. Prepare a Minority Contractor/Subcontractor Participation Plan within ninety (90) days of the issuance of this Major Use Special Permit; it being understood that the City's Minority/Women Business Affairs and Procurement Ordinance 10538 is a guide. THE CITY SHALL: 1. Establish the effective date of the Major Use Special Permit as the date the thirty (30) day appeal period for such permit ends. -�- 92- 687 _0 a CONCLUSIONS OF LAW The Jackson Memorial Hospital Parking Garage, proposed by the Public Health Trust of Dade County, complies with the Miami Comprehensive Neighborhood Plan 1989-2000, is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations and further, pursuant to Section 1703 of Zoning Ordinance 11000: (1) The project will have a favorable impact on the economy of the City; and (2) The project will efficiently use public transportation facilities; and (3) The project will favorably affect the need for people to find adequate housing reasonably accessible to their places of employment; and (4) The project will efficiently use necessary public facilities; and (5) The project will not negatively impact the environment and natural resources of the City; and (6) The project will not adversely affect living conditions in the neighborhood; and (7) The project will not adversely affect public safety; and (8) The public welfare will be served by the project; and (9) Any potentially adverse effects of the project will be mitigated through conditions of this Major Use Special Permit. The proposed development does not unreasonably interfere with the achievement of the objectives of the adopted State Land Development Plan applicable to the City of Miami; and The proposed development is consistent with and shall comply with the considerations and objectives set forth in Chapter 380, Florida Statutes. Pursuant to Section 1705, zoning Ordinance 11000, the specific site plan aspects of the project i.e., ingress and egress, offstreet parking and loading, refuse and service areas, signs and lighting, utilities, drainage and control of potentially adverse effects generally have been considered and will be further considered administratively during the process of issuing a building permit and certificate of occupancy. The administration may permit minor non -substantial changes of square footage for various uses or minor changes in the number of parking spaces provided, without a further public hearing. Since this project permits a maximum development capacity, plans may be substituted and permitted with a lesser development j capacity without a formal amendment to this Major Use Special Permit. -9- 92- 687 PLANNING FACT SHEET APPLICANT Lucia Dougherty, Greenberg, Traurig, et. al. PETITION Consideration of approving a Major Use Special Permit, with conditions per Article 23, Ordinance 11000, the Zoning Ordinance of the City of Miami, for the Jackson Memorial Hospital Highland Parking Garage consisting of approximately 511,000 square feet of parking, 32,950 square feet of retail and 85,000 square feet of office space, a paved landscaped pedestrian concourse and provision for a pedestrian/vehicular overpass over Bob Hope Blvd. to an existing parking structure, and referencing two variances to be considered by the Zoning Board. PLANNING RECOMMENDATION Approval BACKGROUND AND ANALYSIS In 1991, at the request of the Public Health Trust of Dade County, a Master Facility Plan for the University of Miami, Jackson Memorial Medical Center was prepared. The plan identified the "critical need for additional parking to accommodate patients, visitors, physicians and staff." To address this issue, the plan listed the following objective. "Provide adequate parking facilities, both surface and structured parking for staff, faculty, patients and visitors. Parking will be decentralized and placed in strategic, peripheral locations to minimize pedestrian/vehicular intersections and unnecessary penetration of the campus by vehicles." To meet the objectives of the Plan, a 3-phased approach over an 8 to 10 year period was recommended. The Highland Parking Structure satisfies long-term strategies identified in the Plan for organized development of the Medical Center. No roadway Improvements within the vicinity of the proposed parking garage are scheduled by the City of Miami or Dade County. This department supports this major use special permit application. An integral part of the proposed parking garage includes a "vehicular bridge" over Bob Hope Boulevard connecting the existing and proposed parking garages thereby minlmizing pedestrian vehicular Intersections and congestion, a concept supported by this department. In order to accomplish this goal, the Code of the City of Miami must be 'amended to permit the Installation of private vehicular bridges over the public right-of-way. The Public Works Department will prepare this legislation for presentation to the City Commission. The first reading of this ordinance is tentatively scheduled for the September 10, 1992 Commission meeting. This department will also work with the Public Health Trust to secure all. necessary agreements for the bridge structure that may be required by the City Commission. Zoning Ordinance 11000, Section•905.11 requires twenty five (25) foot visibility triangles at street intersections and ten (10) foot visibility triangles at all driveway exits.
