Od City Manager DATE OrT I f -e 992 FILE SUBJECT: Continued Funding from 18th Year CDBG REFERENCES : Discussion Item ENCLOSURES: October 22, 1992 The Department of Housing & Urban Development (HUD) has historically been opposed to core funding of Community Based Organizations (CBOs) and continues such opposition. Pursuant to letter of 9/17/92, attached, they are of the opinion that CBOs should not -be funded on a routine basis using Community Development Block Grant funds. They should only be funded on a project specific basis and a percentage of the allocation could be used for activity delivery cost (administration). However, based on our conversation with HUD officials, they are willing to accept a transition period meaning that we can maintain the $50,000 CBO funding for FY 92-93, provided that the agencies meet contractual requirements. In return, HUD is willing to bring to Miami a consultant firm to provide technical assistance to the CBOs in order to improve the quality of services being provided by the agencies and improve their performance. Based on the aforementioned discussions with the U.S. Department of Housing -and Urban Development (HUD), the City of Miami could continue funding the following CBOs until June 30, 1993 in an amount not to exceed $50,000 for FY 92-93, provided that no additional monies will be disbursed until all contractual requirements have been met and complete reports from the agencies have been received by the Department of Community Development: 1. Therefore, no recommendation can be made at this time. While HUD will provide the CBOs with technical assistance in order to strengthen their capacity to carry out economic development projects at a neighborhood level during the balance of the 92-93 FY as part of the core funding phaseout period, please keep in mind that there will not be enough monies to fund all agencies once the new project specific funding policy is instituted. No agency will be guaranteed funding and no agency should have an expectation of receiving funding once this policy becomes effective next July. This Office has not recommended "disregarding" CBOs. An important issue pointed out in the monitoring letter was the City is not maintaining evidence to show compliance .with a National Objective. Even if the activity carried out *by the CBO is eligible, if a National Objective is not met, expenditures for the activity are subject to repayment. Another important issue in our, monitoring letter was the spending of CDBG funds for CBO staff and administrative costs and receiving little in return. This is the basis for cautioning the City that it is at risk if funding for these activities is continued. Several of the CBOs funded by Miami have been funded for a number of years, and have not produced tangible results showing benefit to low and moderate income residents. There has apparently not been a system in place to evaluate results on an annual basis and make funding decisions based on the evaluation. Our monitoring has indicated the CBOs have not had a measurable impact on the low and moderate income neighborhoods. This is partially due to the way in which these activities are structured. Each subrecipient is given $50,000 per year for special economic development activities. The scope of service in the subrecipient agreement is not sufficiently detailed tq ensure eligible -activities are undertaken and adequate records. are maintained to document compliance with a National Objective.. Some of the CEOs funded are not qualified to provide technical assistance to businesses. Because of the lack of a detailed work program and ineffective monitoring, the CBOs continue to be funded whether they -can show accomplishments or not. As a consequence, ineligible activities and activities which do not meet..a National Objective are carried out by the CBOs. This puts the City at risk of repaying amounts expended for these activities. 92- 683 3 01 Other programs and methods for encouraging empowerment of low income residents without use of CDBG funds or CBOs exist and should be pursued. These would include programs to encourage affordable housing and job training and placement programs. CDBG funds should be used only for eligible activities which will meet a National Objective. Other sources of funding, including banks, foundations, volunteer resources, or general fund revenues should be pursued to assist in accomplishing the neighborhood benefits the City wants. The specific goal to be achieved should be identified for each neighborhood to be assisted. The resources appropriate to addressing• that goal should then be assembled. Activities undertaken should be monitored closely to ensure the desired result is achieved in a reasonable time. The agencies as a whole have not produced as expected by either IiUD or the City. However, some of the nonperformance problems are a result of the economic recession affecting our country and our city, especially in our poorest neighborhoods. In addition, it is apparent that some agencies are not fully documenting their CDBG eligible activities or the time spent pursuing the completion of a project. CBOs in general seem to experience difficulties in keeping accurate programmatic records and understanding and following reporting requirements. The Department of Community Development has met with each agency to discuss their individual problems. We have renegotiated work programs and submitted copies to HUD for their review and approval on September 29, 1992. As a follow up to the meeting spearheaded by Vice Mayor Alonso and Commissioner Dawkins in Washington, DC with the Acting Assistant Secretary for Community Planning and Development, the Department of Community Development formally requested technical assistance for CBOs in order to support economic empowerment programs at a neighborhood level. Community Based Organitations (CnOs) and Community Dovelopment Corporations (CDCs), and continues such opposition. Pursuant to U.S. HUD's letter of September 17, 1992, attached, they are of the opinion that C00s and CDCs should not by funded on a routine basis using Community Development block Grant funds. Moreover, it is U.S. HUD's position that CBOs and Ct)Cs should only be funded on a project specific basis and a percentage of the allocation could be used for activity delivery cost (administration). U.S. HUD's position relative to this issue has been further clarified in the attached letter dated July 7, 1992, wherein U.S. IIUD determined that the Allapattah Business Development Authority Inc. (ABDA) was eligible for CDBG funding since their housing related activity involved a specific project planned in the City. Presently, ABDA is scheduled to develop a 52 unit townhome project on the former City -owned Fern Isle Nursery in the Allapattah neighborhood. In April of 1992, the City Commission approved the allocation of pith Year Community Development Block Grant Program funding to the following Community Development Corporations: 1) Allapattah Business Development Authority 2) CODEC, Inc. 3) Little Haiti Housing Association 4) Lost Little Havana Community Development Corporation 5) Florida_ Housing Cooperative, Inc. 6) Greater Miami Ne igbhorbuode Inc. 7) St. John Community Development Corporation 8) Tacolcy Economic Development Coryoration 9) wynwood Community Economic Development Corporation To date, approximately six hundred (600) units of new housing have been developed in the City by Community Development Corporations. Another important issue in our, monitoring letter was the spending of CDDG funds for. CEO staff and administrative costs; and receiving little in return. This is tho basis for cautioning the City that it is at rink if funding for those activities in continued. Several. of the CDOs funded by Miami have been funded for a number of years, and have not produced tangible results showing benefit to low and moderate income rosidonts. There has; apparently not been a system in place to evaluate results on an annual basis and make funding decisions based on the evaluation. Our monitoring has indicated the CS0s have not had a moasurablo impact ot) the low and moderate income neighborhoods. This is partially due to the way in which these activities are structured. Fach subrecipient in given $50,000 per year for special economic development activities. The scopo of service in the subrecipient agreement is not sufficiently detailed to ensure oli.gible activities are undertaken and adequate records are maintained to document compliance with a National Objective. Some of the CBOs funded Are not qualified to provide technical Assistance to business;es. Because of tho lack of a detailed work program and ineffective monitoring, the C009 continue to be funded whother they can show accomplishments or not. As a consequence, ineligible activities and activities which do not meet a National Objective are carried out by the CBOs.
