J-92-858 10/22/92 RESOLUTION NO. 9 2 - 681 A RESOLUTION WAIVING BY 4/STHS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A PUBLIC HEARING, THE PROHIBITION CONTAINED IN CITY CODE SECTION 2-302 AS SUCH PROHIBITION APPLIES TO MARTIN FINE, ESQ., WHO SERVES ON THE DOWNTOWN DEVELOPMENT AUTHORITY BOARD AND MANUEL ALONSO-POCH, ESQ., WHO SERVES ON THE CITY'S ZONING BOARD, IN RELATION TO THEIR PROVIDING PROFESSIONAL BOND COUNSEL SERVICES AS SET FORTH IN ARTICLE VIII OF CHAPTER 54 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED. WHEREAS, Martin Fine, Esq. is currently serving as a member of the Downtown Development Authority Board and is a Senior Partner in the law firm of Fine Jacobson Schwartz Nash Block and England, P.A.; and WHEREAS, Manuel Alonso-Poch, Esq. is currently serving as a member of the Zoning Board of the City of Miami and is President of the law firm of Manuel Alonso-Poch, P.A.; and WHEREAS, both individuals are seeking to provide professional bond counsel services to the City of Miami as set forth in Article VIII of Chapter 54 of the Code of the City of Miami, Florida, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMUSS1 A MEETING OD OCT 2 2 1992 Resolution Mo, t Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The waiver set forth in Section 3 hereof is based upon the recitals and findings contained in Section 1 hereof and upon the following findings: (a) The City of Miami desires to retain Martin Fine, Esq., a Senior Partner in the law firm of Fine Jacobson Schwartz Nash Block and England, P.A. and Manuel Alonso-Pooh, Esq., President of the law firm of Manuel Alonso-Pooh, P.A., as such individuals are uniquely qualified to provide professional bond counsel services to the City of Miami, and which relationship would be in violation of City Code Section 2-302 were there not a waiver of the prohibition contained in said Section 2-302. (b) The herein proposed transaction will be in the best interest of the City of Miami in providing professional bond counsel services. Section 3. The prohibition contained in Section 2-302 of the City Code is hereby waived by a 4/5ths affirmative vote of the City Commission, after a public hearing. Section 2. F-902 T0: Honorable Mayor and Members of the City Commission City of Miami FRAM: Clark Cook executive Director Miami Parking System nATF: October 1.4, 1992 SLt13�TBCT: Resolutioe to Appointment of Bond Counsel The Off -Street Parking Board has approvad the refinancing of certain long-term bonds in order to take advantage of the current low interest rates. in that connection, we are requesting, at the October 22, 1992 meeting, the Commissions approval of the appointment of the law firm of Rine Jacobson Schwartz Nash & Block and the minority firm of Manual Alono-Poch to provide bond counsel services to the Department. As a result of a bid process directed by the City Attorney, the above firms submitted the lowest qualified bid of $10,000 plus $3,000 of expenses. These fees will be paid from bond proceeds. The Bonds being refinanced are not General Obligations of the City of Miami, but are backed solely by the revenues of the Department of Off-street Parking. HJM:ns:hm101592/1 92- 681 y2- 682
