J-92-735 10/8/92 RESOLUTION NO. 9 2 - 6'71 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENTS TO EXISTING INDIVIDUAL CONTRACTUAL AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY AND AS SPECIFIED HEREIN, THEREBY PROVIDING FOR EXTENSIONS TO SAID AGREEMENTS FOR THE PERIOD OF OCTOBER 11 THROUGH OCTOBER 31, 1992, WITH THIRTEEN (13) NEIGHBORHOOD ECONOMIC DEVELOPMENT COMMUNITY BASED ORGANIZATIONS ("CBOS") TO IMPLEMENT ECONOMIC DEVELOPMENT PROGRAMS AND NINE (9) NEIGHBORHOOD BASED HOUSING COMMUNITY DEVELOPMENT CORPORATIONS ("CDCS"), TO STIMULATE HOUSING AFFORDABLE TO LOW AND MODERATE INCOME FAMILIES AND INDIVIDUALS IN THE CITY OF MIAMI; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENTS TO EXISTING CONTRACTUAL AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY AND AS SPECIFIED HEREIN, THEREBY PROVIDING FOR EXTENSIONS TO SAID AGREEMENTS FOR THE PERIOD OF SEPTEMBER 11 THROUGH OCTOBER 31, 1992, WITH KIDCO CHILD CARE, INC. ("KIDCO") FOR THE OPERATION OF A CHILD CARE PROJECT, AND WITH DeHOSTOS SENIOR CENTER ("DeHOSTOS"), FOR THE OPERATION OF AN ELDERLY CARE PROJECT, BOTH LOCATED IN THE WYNWOOD TARGET AREA; ALLOCATING FUNDS THEREFOR FROM THE EIGHTEENTH (18TH) YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM. WHEREAS, the City Commission is committed to economic development, the expansion of trade and commerce, and the development of housing within the affordability range of families and individuals of low and moderate income in the City of Miami; and WHEREAS, the promotion of economic revitalization in the neighborhoods of the City of Miami is an important part of the City's economic development strategy; and CITY COMMSSION MEETING OF OCT 0 8 IM2 Rewlutlon No. 9 2 - 671 WHEREAS, the City Commission recognizes that participation of both the public and private sector is necessary to foster the development of housing; and WHEREAS, the City Commission is desirous of continuing neighborhood economic development programs with various CBOs, and housing revitalization programs with various CRCs, and funds are available from the Eighteenth (16th) Year Community Development Block Grant Program for such purposes; and WHEREAS, on March 12, 1992, the City Commission approved Resolution No. 92-190.1 to fund neighborhood economic development community based organizations and neighborhood based housing community development corporations; and WHEREAS, pursuant to Resolution Nos. 92-430 and 92-431, adopted July 9, 1992, the City Commission authorized the funding for KIDCO and DeHostos for the period of July 10 through September 10, 1992; and WHEREAS, pursuant to Resolution No. 92-459, adopted July 9, 1992, the City Commission authorized the City Manager to enter into agreements with thirteen (13) CBOs and nine (9) CDCs for the period from July 1 through September 10, 1992; and WHEREAS, pursuant to Resolution No. 92-549, adopted September 10, 1992, the City Commission authorized the City Manager to extend agreements with said thirteen (13) CBOs and said nine (9) CDC for the period of September 11 through October 10, 1992; and WHEREAS, the City Commission has authorized the City Manager to extend the agreements with said thirteen (13) CBOs and said -2- 92- 671 nine (9) CDCs for the period of October 11 through October 31, 1992; and WHEREAS, the City Commission has authorized the City Manager to extend the agreements with KIDCO and DeHostos for the period of September 11 through October 31, 1992; and WHEREAS, at the October 22nd, 1992 meeting, the City Commission will reevaluate each agency and reconsider their funding for the remainder of the 1992-1993 contract year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. O Discussion Item City Manag ENCLOSURES :October 8, 1992 The Department of Housing & Urban Development (HUD) has historically been opposed to core funding of Community Based Organizations (CBOs) and continues such opposition. Pursuant to letter of 9/17/92, attached, they are of the opinion that CBOs should not be funded on a routine basis using Community Development Block Grant funds. They should only be funded on a project specific basis and a percentage of the allocation could be used for activity delivery cost (administration). However, based on our conversation with HUD, they are willing to accept a transition period meaning that we can maintain the $50,000 CBO funding for FY 92-93, provided that the agencies meet contractual requirements. In return, HUD is willing to bring to Miami a consultant firm to provide technical assistance to the CBOs in order to improve the !?i quality of services being provided by them and improve their performance. Based on the aforementioned discussions with the U.S. Department of Housing and Urban Development (HUD), the City of Miami could continue funding the following CBOs until June 30, 1992 in an amount not to exceed $50,000 for FY 92-93, provided that no additional monies will be disbursed until all contractual requirements have been met and complete reports have been received by the Department j of Community Development: 1. This Office has not recommended "disregarding" CBOs. An important issue pointed out in the monitoring letter was the City is not maintaining evidence to show compliance with a National Objective. Even if the activity carried out by the CBO is eligible, if a National Objective is not met, expenditures for the activity are subject to repayment. Another important issue in our monitoring letter was the spending of CDBG funds for CBO staff and administrative costs and receiving little in return. This is the basis for cautioning the City that it is at risk if funding for these activities is continued. Several of the CBOs funded by Miami have been funded for a number of years, and have not produced tangible results showing benefit to low and moderate income residents. There has apparently not been a system in place to evaluate results on an annual basis and make funding decisions based on the evaluation. Our monitoring has indicated the CBOs have not had a measurable impact on the low and moderate income neighborhoods. This is partially due to the way in which these activities are structured. Each subrecipient is given $50,000 per year for special economic development activities. The scope of service in the subrecipient agreement is not sufficiently detailed to ensure eligible activities are undertaken and adequate records are maintained to document compliance with a National Objective. Some of the CBOs funded are not qualified to provide technical assistance to businesses. Because of the lack of a detailed work program and ineffective monitoring, the CBOs continue to be funded whether they can show accomplishments or not. As a consequence, ineligible activities and activities which do not meet a National Objective are carried out by the CBOs. These would include programs to encourage affordable housing and job training and placement programs. CDBG funds should be used only for eligible activities which will meet a National Objective. other sources of funding, including banks, foundations, volunteer resources, or general fund revenues should be pursued to assist in accomplishing the neighborhood benefits the City wants. The specific goal to be achieved should be identified for each neighborhood to be assisted. The resources appropriate to addressing that goal should then be assembled. Activities undertaken should be monitored closely to ensure the desired result is achieved in a reasonable time. U.S. HUD's position relative to this issue has been further clarified in the attached letter dated July 7, 1992, wherein U.S. HUD determined that the Allapattah Business Development Authority Inc. (ABDA) was eligible for CDBG funding since their housing related activity involved a specific project planned in the City. Presently, ADDA is scheduled to develop a 52 unit townhome project on the former City -owned Fern Isle Nursery in the Allapattah neighborhood.
