A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT
AMOUNT NOT TO EXCEED $109000, IN THE CONTRACT BETWEEN
THE CITY OF MIAMI, FLORIDA AND GARCIA,-ROSS
CONSTRUCTION COMPANY, DATED JANUARY 30, 1992, FROM
$511,587.00 TO $521,587.001 FOR THE WILLIAMS PARK
REDEVELOPMENT PROJECT B-2981, CAPITAL IMPROVEMENT
PROJECT NO. 331351, WITH SAID FUNDS TO BE PROVIDED
FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10938 FROM
FUNDS ALREADY APPROPRIATED TO THE PROJECT; FURTHER
RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE
HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES
BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS
OF THE CITY COMMISSION.
WHEREAS, there exists a contract dated January 30, 19929
between the City of Miami, Florida and Garcia -Ross Cosntruction
Company for the Williams Park Redevelopment Project B-2981,
Capital Improvement Project No. 331351; and
WHEREAS, an increase in contract not to exceed $10,000 is
required to cover the cost of necessary extra work involving the
installation of additional aluminum railings at the handicap
access ramp into the swimming pool, additional electrical work on
the existing air conditioning system, additional lighting
fixtures in the restrooms and air conditional room, an additional
roof exhaust fan on the pool building, a slip -resistant concrete
sealer on the swimming pool deck, and cleaning or replacement of
existing lavatory and shower drains; and

WHEREAS, the Director of Public Works, the Director of Parks
and Recreation and the City Manager recommend the increase in
contract to cover the additional costs; and
1 WHEREAS, the City Manager has made a written finding that a
s valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds to cover the increase are available from
monies already appropriated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager contained . in the ft-eanble to this
Resolution are hereby ratified by an affirmative vote of four -
fifths of the Members of the City Commision and are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this Section.
Section 2. The contract between Garcia -Ross Construction
Company and the City of Miami, Florida, dated January 30, 1992,
for Williams Park Redevelopment Project B-2981, Capital
Improvement Project No. 3313519 is hereby increased in an amount
not to' exceed $10,000, from $511,587.00 to $521,587.00 with funds
for the increase to be provided.from monies already appropriated
to the project.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing an increase in contract in the
amount of $10,000.00 in the contract between the City of Miami
and Garcia -Ross Construction Company for the Williams Park
Redevelopment Project B-2981; and further ratifying the City
Manager's written finding that the increase resulted from
emergency circumstances.
BACKGROUND:
The Department of Public Works and the Department of Parks and
Recreation, in an effort to serve all residents of the City of
Miami, have determined that it is now appropriate and in order
for the City Commission to ratify the City Manager's decision to
increase the existing contract dated January 30, 1992, between
the City of Miami and Garcia -Ross Construction Company for
Williams Park Redevelopment Project B-2981 in an amount not to
exceed $10,000 for necessary extra work, and to ratify the City
Manager's emergency finding that allowed the extra work to
continue.
The City Commission awarded a contract to Garcia -Ross
Construction Company for construction Of Williams Park
Redevelopment Project, Project No. 331351, in the amount of
$511,687 on December 5, 1991.- Generally, the project consisted
of renovations to the existing recreation and pool buildings,
construction of a new swimming pool, and other miscellaneous site
improvements. As the project progressed, the need for additional
work beyond the original project scope became apparent. The
additional work is outlined below.

1. Additional aluminum railings were constructed at the
handicap access ramp into the pool and in the mechanical
room to comply with current code requirements.
2. Additional electrical work was needed on the existing air
conditioning system to conform with current code
requirements.
3. Ten additional lighting fixtures were installed in the
restrooms and air conditioning room to increase lighting
levels for safety reasons.
4. An additional roof exhaust fan was installed on the pool
building to conform with current code requirements.

None of the items described above were included in the original
scope of work. Failure to correct or address these problems
could have endangered the health, safety and welfare of our
citizens. It was decided that the most cost effective and
expeditious manner to address all of these problems was to allow
the contractor already working on the project, Garcia -Ross
Construction Company, to accomplish the extra work.
The increase in contract to cover all of the aforementioned extra
work will not exceed $10,000. Funds for the increase are
available from monies already appropriated to the project in the
City's Capital Improvement Appropriation Ordinance, Project No.
331351.

Increase In Project Scope

ENCLOSURES:
Based on information supplied to me by the Director of the
Department of Public Works, I have found that an emergency
existed justifying the authorization for Garcia -Ross Construction
Company to undertake additional work at the Williams Park
Redevelopment Project beyond the original scope of their
contract.
The reasons for the emergency need and subsequent authorization
to perform additional work are as follows:
The City Commission awarded a contract to Garcia -Ross
Construction Co. for construction of Williams Park Redevelopment
Project, Project No. 331351, in the amount of $511,587 on
December 5, 1991. Generally, the project consisted of
renovations to the existing recreation and pool buildings,
construction of a new swimming pool, and other miscellaneous site
improvements. As the project progressed, the need for additional
work beyond the original project scope became: apparent. The
additional work is outlined below.
1. Additional aluminum railings were constructed at the
handicap access ramp into the pool and in the mechanical
room to comply with current code requirements.
2. Additional electrical work was needed on the existing
air conditioning system to conform with current code
requirements.
3. Ten additional lighting fixtures were installed in the
restrooms and air conditioning room to increase lighting
levels for Safety reasons.
4. An additional roof exhaust fan was installed on the pool
building to conform with current Bode requirements.

5. A skip -resistant concrete sealer was applied to the
entire swimming pool deck.
6. Several of the existing lavatory and shower drains were
either clogged or collapsed and needed replacement.
None of the items described above were included in the original
scope of work. Failure to correct or address these problems
could have endangered the health, safety and welfare of our
citizens. It was decided that the most cost effective and
expeditious manner to address all of these problems was to allow
the contractor already working; on the project, Garcia -Ross
Construction Company, to accomplish the extra work.
The increase in contract to cover all of the aforementioned extra
work will not exceed $10►000. Funds for the increase are
available from monies already appropriated to the project in the
