' 10/1/92 92- RESOLUTION NO. 628 A RESOLUTION AMENDING SECTION 8 OF RESOLUTION N0. 86-11, ADOPTED JANUARY 9, 1986, AS AMENDED, THEREBY MODIFYING CERTAIN COMPENSATION BENEFITS AND EMOLUMENTS TO BE RECEIVED BY CESAR H. ODIO AS CITY MANAGER OF THE CITY OF MIAMI, FLORIDA, WHEREAS, on November 26, 1985, the City Commission adopted Resolution No. 85-1175 which appointed Cesar H. Odio as the City i Manager; and WHEREAS, on January 9, 1986, the City Commission adopted Resolution No. 86-11, pertaining to compensation benefits and emoluments to be received by Cesar H. Odio as City Manager of the City of Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: , Section 1. Section 8 of Resolution No. 86-11, adopted January 9, 1986, as amended, pertaining to compensation benefits and emoluments to be received by Cesar H. Odio as City Manager of the City of Miami, Florida, is hereby amended to read as follows: "Section 8. (a) Cesar H. Odio's annual salary for pension purposes will be reported at $122,200.00 effective October 1, 1991 and at $140,000.00, effective October 1, 1992. All salary increases for pension purposes approved herein above Cesar H. Odio's current annual salary of $106,261.00 less any increases in payroll deductions related to such salary increases for pension purposes, will be reimbursed by Cesar H. Odio to the City as long as he remains on the City's payroll. After these salary increases for pension purposes are implemented, Cesar H. Odio's take-home salary will be the same as that received prior to such increases. CITY COMMISSXON MEETING OF 0Cr 0 8 1992 Resolution No. 92- 628 (b) If Cesar H. Odio resigns from City employment or is dismissed from City employment at any time hereafter, the City shall pay him the severance benefits of two (2) weeks per year of service with the City, aggregate salary in addition to any other benefits due to him. Such severance benefit may be withheld and shall not be paid for the period Cesar H. Odio remains in the City's emplcy, performing such duties he may be assigned and receiving the full amount of his present salary/benefits. No such severance benefits shall be paid if he is dismissed for acts constituting gross negligence or criminal conduct." Section 2. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 8th day of tob , 1992.
