HomeMy WebLinkAboutR-92-0605J-92-585(a) 9/24/92 RESOLUTION NO. 605 A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD TO GRANT A SPECIAL EXCEPTION FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 6, SECTION 612, TO ALLOW THE CONSTRUCTION OF A SURFACE PARKING LOT TO SERVE THE BUSINESS LOCATED ON THE ABUTTING COMMERCIAL DISTRICT, SUBJECT TO THE CURBCUT BEING SLANTED TOWARDS DOUGLAS ROAD, ALL THE CONDITIONS OF RESOLUTION ZB 127-85, AND A REVIEW BY THE PLANNING, BUILDING AND ZONING DEPARTMENT ONE (1) YEAR FROM THE DATE OF ADOPTION OF THIS RESOLUTION, FOR THE PROPERTY LOCATED AT 3650-3670 FLORIDA AVENUE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN); ZONED R-1 SINGLE FAMILY RESIDENTIAL WITH AN SD-12 BUFFER OVERLAY DISTRICT; SAID SPECIAL EXCEPTION HAVING A TIME LIMITATION OF TWELVE MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED. WHEREAS, the Miami Zoning Board at its meeting of July 20, 1992, Item No. 10, duly adopted Resolution ZB 91-92 by an eight to zero (8-0) vote, granting a special exception subject to City Commission approval, as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the special exception as hereinafter set forth; and CITY COM CSSION MEETING OF, S E P 2 4 1992 Resolution No. 92- 605 1 I WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve the special exception and to affirm the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDAs Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Miami Zoning Board to grant a special exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 6, Section 612, to allow the construction of a surface parking lot to serve the business located on the abutting commercial district, subject to the curbcut being slanted towards Douglas Road, all the conditions of Resolution ZB 127-85, and a review by the Planning, Building and Zoning Department one (1) year from the date of adoption of this Resolution, for the property located at 3650-3670 Florida Avenue, Miami, Florida, also described as Lots 9, 10, and 11, Block 25, FROW HOMESTED, as recorded in Plat Book B at page 106 of the Public Records of Dade County, Florida, Zoned R-1 Single Family Residential, with an SD-12 Buffer Overlay District, said special exception having a time limitation of twelve months in which a building permit must be obtained, is hereby affirmed and the special exception is hereby granted. !WM 92- 605 Section 3. ZB 127-85 on September 9, 1985, under Zoning Ordinance 9500. ANALYSIS The SD-12 Buffer Overlay District was created to provide parking to serve abutting commercial districts where necessary. The proposed surface parking lot will help to alleviate any parking problem, and as presented, will not have an adverse impact in the area. ZONING BOARD At its meeting of July 20, 1992, the Zoning Board adopted Resolution ZB 91-92 by a vote of 8-0, recommending approval of the above, subject to the curbcut to be slanted towards Douglas Road, and all the conditions of Res. ZB 127-85. One reply AGAINST and two in FAVOR were received by mail.
