RESOLUTION NO. 9 - 575
A RESOLUTION DESIGNATING AS A CATEGORY "B"
PROJECT THE ACQUISITION OF PLANNING AND
DESIGN SERVICES INCLUDING PREPARATION OF
CONSTRUCTION DOCUMENTS FOR THE TOWER THEATER
RENOVATION PROJECT; AUTHORIZING THE CITY
MANAGER TO ADVERTISE FOR THE REQUIRED
PROFESSIONAL SERVICES; APPOINTING A
CERTIFICATION COMMITTEE OF NOT LESS THAN
THREE QUALIFIED PROFESSIONALS FROM THE CITY'S
STAFF; AUTHORIZING THE CITY MANAGER TO
APPOINT A FOURTH CERTIFICATION COMMITTEE
MEMBER WHOSE PROFESSIONAL EXPERTISE IS IN THE
AREA OF CULTURAL FACILITIES PLANNING
SUBSEQUENT TO RECEIPT OF THE PROPOSALS, AND
APPOINTING HERBERT J. BAILEY, ASSISTANT CITY
MANAGER, AS CHAIRPERSON OF THE COMPETITIVE
SELECTION COMMITTEE, ALL IN ACCORDANCE WITH
FLORIDA STATUTES SECTION 287.055, AND CITY OF
MIAMI CODE SECTION 18-52.3.
WHEREAS, the City of Miami is desirous of restoring to
Little Havana a traditional center for Spanish language films and
providing space to showcase the growing professional performing
arts organizations emerging from Miami's immigrant minority
communities; and
WHEREAS, the Tower Theater Renovation Project conforms with
and is an integral component in the City of Miami Comprehensive
Neighborhood Master Plan, the City's Latin Quarter Specialty
Center Plan, the Little Havana/Calle Ocho Revitalization Strategy
Plan and the Metropolitan Dade County's Comprehensive Cultural
Facilities Master Plan; and

WHEREAS, the City Manager recommends that the acquisition of
planning and design services including the preparation of
construction documents for the Tower Theater Renovation Project,
be designated a Category "B" Project in accordance with the
provisions of City Code Section 18-52.3; and
WHEREAS, City Code Section 18-52.3 also requires the
establishment of a Certification Committee of not less than three
professionals qualified in the fields of endeavor or practices
involved in the project, to review the qualifications,
performance data and related information provided by those
responding to the City's Request for Professional Services; and
WHEREAS, in order to enhance the expertise of the
Certification Committee it is desirable to appoint an
appropriately qualified professional whose expertise is in the
area of cultural facilities planning as the fourth Certification
Committee Member, subsequent to the receipt of the Proposals, to
participate in the Certification Committee's required activities;
and
WHEREAS, the City Manager recommends that Herbert J. Bailey,
Assistant City Manager, be appointed as Chairperson of the
Competitive Selection Committee, in accordance with the
provisions of City of Miami Code Section 18-52.3;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The acquisition of planning and design

services including the preparation of construction documents for

the Tower Theater renovation Project is hereby designated a
Category "B" Project, in accordance with the provisions of the
City of Miami Code Section 18-52.3, which established procedures
for contracting for certain professional services and also
established competitive negotiation requirements with regard to
the furnishing of such services.
Section 3. The City Manager is hereby authorized to
advertise for the aforementioned professional services and to
issue a Request for Proposals for Professional Services document
related to the procurement of such services, in accordance with
the City Code.
Section 4. A Certification Committee is hereby appointed
consisting of the following City staff: Jose Casanova,
registered Architect, Department of Planning, Building and

Zoning; Karl Thompson, registered Engineer, Department of Public
Works and Maria M. Perez, Project Representative, Department of
Development and Housing Conservation.
Section 5. The City Manager is hereby authorized,
subsequent to receipt of the responses to the City's Request for
Proposals for Professional Services document, to appoint a fourth
member to the Certification Committee, whose professional
expertise is in the area of cultural facilities planning with no

vested interest and/or financially remunerative relationship with
any of the firms or individuals being considered during the
Certification and Selection process.

Section 6. Herbert J. Bailey, Assistant City Manager, is
hereby appointed as Chairperson of the Competitive Selection

Committee, in accordance with the provisions of City of Miami

Code Section 18-52.3.
Section 7. Following its review in accordance with
provisions of the City Code, the Competitive Selection Committee
shall reports its findings, together with supporting information,
to the City Manager and shall file a copy of its findings with
the City Clerk.
Section 8. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution designating as a Category "B" Project the
acquisition of planning and design services including preparation
of construction documents for the renovation of the Tower Theater
building property located at 1508 S.W. 8 Street, Miami;
authorizing the City Manager to advertise for the required
professional planning and design services; appointing a
Certification Committee of not less than three professionals
qualified in the fields of endeavor or practice involved in the
project from the City's staff; authorizing the City Manager to
appoint a fourth Certification Committee Member, subsequent to
receipt of the proposals, whose professional expertise is in
cultural facilities planning; and appointing Herbert J. Bailey,
Assistant City Manager, as Chairman of the Competitive Selection
Committee, all in accordance with City of Miami Ordinance No.
9572 adopted February 10, 1983, and City of Miami Code Section
18-52.3 which established procedures for contracting for such
professional services and also established negotiation
requirements with regard to the furnishing of such services.

The Department of Development recommends the attached resolution
designating as a Category "B" project the acquisition of planning
and design services for the renovation of the Tower Theater
property, hereinafter to be known as the "Tower Theater Renovation
Project".
The Tower Theater property was acquired by the City of Miami in
January of 1992 to restore to the heart of Little Havana a
traditional center for Spanish language films and to showcase the
growing professional performing arts organizations emerging from
Miami's immigrant minority communities.

The Tower Theater Renovation Project will include refurbishing all
mechanical, electrical, plumbing, life/safety systems, and
installation of theater equipment and seating to create two
community based theater spaces within the structure to showcase
films and live performances in drama, dance and music.
The Tower Theater Renovation Project is included in' the
Metropolitan Dade County Comprehensive Cultural Facilities Master
Plan, currently in preparation. The Master Plan will ultimately,
establish a hierarchy of regional theaters serving all levels of
local arts organization's needs. The Tower Theater offers a
strategic mid -range facility that is large enough to meet the
needs of established local minority arts groups but small enough
to offer an affordable space scaled to the growing community based
arts resources.
It is therefore requested that the attached Resolution be approved
in its entirety at the September 10, 1992 Commission Meeting.
