EXTENSION DISTRICT H-4391-A AND REMOVING ALL
PENDING LIENS FOR THIS IMPROVEMENT NOT HEREBY
CERTIFIED.
WHEREAS, the City Commission met on the loth day of
September, 1992, pursuant to due legal notice of said meeting
under Section 30 of the City Charter, as amended, to receive all
objections to the confirmation of the preliminary assessment roll
for the cost of FLAGLER STREET HIGHWAY IMPROVEMENT (THIRD
BIDDING) AND FLAGLER STREET HIGHWAY IMPROVEMENT EXTENSION (THIRD
BIDDING) IN FLAGLER STREET HIGHWAY IMPROVEMENT DISTRICT (THIRD
BIDDING) H-4372 AND FLAGLER STREET HIGHWAY IMPROVEMENT EXTENSION
DISTRICT H-4391-A in the area bounded by Flagler Street between
I-95 and Biscayne Boulevard; and
WHEREAS, no objections thereto by any person interested in,
or affected by, said assessments were sustained by the
Commission, and said assessment roll appeared, in all respects,
regular and in accordance with the requirements and provisions of
the City Charter, as amended;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

Section 1, The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The prima facie assessments, as apportioned
and indicated on the preliminary assessment roll for FLAGLER
STREET HIGHWAY IMPROVEMENT (THIRD BIDDING) AND FLAGLER STREET
HIGHWAY IMPROVEMENT EXTENSION (THIRD BIDDING) IN FLAGLER STREET
HIGHWAY IMPROVEMENT DISTRICT (THIRD BIDDING) H-4372 AND FLAGLER
STREET HIGHWAY IMPROVEMENT EXTENSION DISTRICT H-4391-A arv,
hereby, in all things, confirmed and sustained for any and all
lots or parcels of ground described therein.

Section 3. The sums and amounts assessed against each of
the lots or parcels of ground in said preliminary assessment roll
are less than the amount that each of said lots or parcels of
ground is especially benefited by said improvements, and such
assessment amounts are in proportion to the special benefits that
the property received.
Section 4. The total assessment cost of said FLAGLER
STREET HIGHWAY IMPROVEMENT (THIRD BIDDING) AND FLAGLER STREET
HIGHWAY IMPROVEMENT EXTENSION (THIRD BIDDING) IN FLAGLER STREET
HIGHWAY IMPROVEMENT DISTRICT (THIRD BIDDING) H-4372 AND FLAGLER
STREET HIGHWAY IMPROVEMENT EXTENSION DISTRICT H-4391-A in the
amount of $135,056.53 be, and the same is hereby, approved and
confirmed.

It Is respectfully recommended that the City Commission adopt
the attached Resolution confirming the preliminary assessment
roll for FLAGLER STREET HIGHWAY IMPROVEMENT (3RD BIDDING) AND
FLAGLER STREET HIGHWAY IMPROVEMENT EXTENSION (3RD BIDDING)
IN FLAGLER STREET HIGHWAY IMPROVEMENT DISTRICT (3RD BIDDING)
H-4372 AND FLAGLER STREET HIGHWAY IMPROVEMENT EXTENSION
DISTRICT H-4391-A.
BACKGROUND:
Construction of FLAGLER STREET HIGHWAY IMPROVEMENT (3RD
BIDDING) AND FLAGLER STREET HIGHWAY IMPROVEMENT EXTENSION (3RD
BIDDING) IN FLAGLER STREET HIGHWAY IMPROVEMENT DISTRICT (3RD
BIDDING) H-4372 AND FLAGLER STREET HIGHWAY IMPROVEMENT
EXTENSION DISTRICT •H-4391-A has been completed, and the
preliminary assessment roll for this Improvement is ready to be
presented to the Commission for confirmation. The construction
for this highway Improvement Is located in the area bounded by
Flagler Street betwwen 1-95 and Biscayne Boulevard.
The total assessment cost of the highway Improvement amounted
to $135,056.53.
A public hearing is scheduled for September 10, 1992, to hear
objections to confirmation of the assessment roll. If no
objections are sustained, it will be In order for the
Commission to adopt the resolution confirming the assessment
roll.
A section has been Included cancelling and removing pending
liens placed against properties not benefited by the
Improvement.

following is a true and correct statement of the total cost of that part of the worn in
FLAGLER STREET HIGHWAY IMPROVEMENT ORD BIDDING) H-4372 AND FLAGLER STREET HIGHWAY
IMPROVEMENT EXTENSION ORD BIDDING) H-4391A which is the contract price and the estimated
cost of the incidental expenses thereof, with description of lots or parcels of land
liable to liens therefor, the linear foot frontage of construction of each lot or parcel,
the total assessment chargeable against each lot or parcel computed according to frontage
and in proportion to special benefits received and not in excess of such benefits; the
name of the owner of each lot or parcel where such can be ascertained by me after diligent
inquiry; a statement of all other things required of the Preliminary Assessment Roll by
Section 56, as amended, of the City Charter; and in accordance with the list of street
locations appended hereto and made a part hereof.
