ON NOVEMBER 20-22, 1992; AUTHORIZING THE i CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC AND ESTABLISHING A TEMPORARY PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF yf' PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; FURTHER ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF SAID EVENT; CONDITIONED UPON THE ORGANIZERS PAYING FOR ALL THE NECESSARY COSTS OF CITY SERVICES AND FEES ASSOCIATED WITH SAID EVENT AND OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT . PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, Miami Book Fair International Inc. will conduct the 1992 Miami Book Fair International Street Festival on November 20-22, 1992; and WHEREAS, certain streets shall be closed to through vehicular traffic, establishing a pedestrian mall during specified dates and hours to insure the safety of the participants and pedestrians attending said event; and WHEREAS, said organization has requested that retail peddlers be restricted within the specified area of the event for a specific period of time during the event; CITY COMMISSION N,EETING OF S E P 1 0 1992 Resolution No. 92- 537 i w � P1 ' WS NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY ' OF MIAMI, FLORIDAt �k Section 1. The recitals and findings contained in the ,a .. preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this . Section. Section 2. in order to effectuate safe passage and # establish a temporary pedestrian mall during the 1992 Miami Book t Fair International Street Festival to be conducted by Miami Book Fair International, Inc., the following streets as specified below are hereby closed to through vehicular traffic, as follows: io. ' "' - From 6:00 P.M. on Wednesday, November 18, 1992 to 12:00 Noon on Monday, November 23, 1992: Northeast First Avenue from Northeast Third Street to Northeast Fifth Street. Northeast Second Avenue from Northeast Third Street to Northeast Fifth Street. = Northeast Fourth Street from Biscayne Boulevard to Northeast Second Avenue. November 20-November 22, 1992 from 7:00 A.M. to 7:00 P.M.: Northeast Third Street from Northeast First Avenue to -Northeast Second Avenue. Included in the herein closures are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. IV- -2- 92 537 Section 3. Said closing of streets is subject to the q issuance of permits by the Departments of Police and Fire, Rescue and inspection Services. Said permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 4. Pursuant to the provisions of City Code Section 39-13, all retail peddlersoccupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid on November 20-22, 1992, during the hours of 8:00 A.M. to 7:00 P.M. in the area of the public right-of-way included within and adjoining the streets and avenues described in Section 1 hereinabove, for two blocks in all directions. Section 5. The herein approvals and authorizations are hereby conditioned upon the organizers paying for all necessary costs of City services and applicable fees associated with said event and obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee. Section 6. Odi Commission Agenda Item City Manager ENCLOSURES; September 10, 1992 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing street closures and the restriction of retail peddlers in the vicinity of Miami Dade Community College, Downtown Campus, in connection with the 1992 Miami Book Fair International Street Festival to be conducted by Miami Book Fair International, Inc. on November 20-22, 1992. These authorizations are conditioned upon the organizers paying for any costs of City services and applicable fees and the requirement that the City will be insured against any potential liability. BACKGROUND: The Department of Community Development has prepared the appropriate legislation which authorizes the closure of certain streets and the restriction of retail peddlers in the vicinity of Miami Dade Community College, Downtown Campus, in connection with the 1992 Miami Book Fair International Street Festival to be conducted by Miami Book Fair International, Inc. on November 20- 22, 1992. This is the Ninth Annual Book Fair International, a week-long event of lectures, book exhibitors and street festival. Attachment: (1) Proposed Resolution 92- 5 3?
